RICHMOND, Va. — The new federal ban on flavored cigarettes took effect on Tuesday, marking one of the first visible signs of the Food and Drug Administration's new authority to regulate tobacco.

The ban on manufacturing, importing, marketing and distribution includes candy-, fruit- and clove-flavored cigarettes, which health and federal authorities say are more appealing to youth. It does not include a ban on menthol or other flavored tobacco products like cigars – issues that the FDA is studying.

"Candy- and fruit-flavored cigarettes are a gateway for many children and young adults to become regular tobacco users," said Dr. Lawrence R. Deyton, director of the FDA's Center for Tobacco Products.

Citing research studies, Deyton said that 17-year-old smokers are three times as likely to use flavored cigarettes as smokers over the age of 25. FDA officials also said that almost 90 percent of adult smokers start smoking as teenagers and the ban will help stop more than 3,600 young people who start smoking daily.

The FDA sent a letter to the industry last week discussing the ban, its plans for enforcement, including the definition of a cigarette under the ban. Officials are encouraging consumers to notify authorities of any potential violations of the ban.

Executives from leading health groups urged the FDA last month to take a closer look at attempts to sidestep the ban by making superficial changes that turn a cigarette into a small cigar in order to keep selling flavored products.

The move came after word that the nation's top distributor of clove cigarettes – California-based Kretek International Inc. – began offering small filtered spice-flavored cigars that are close to the size of a cigarette but are wrapped in tobacco rather than paper.

Officials did not address any specific products in a conference call with reporters.

In June, President Barack Obama signed the law that allows the FDA regulate the industry. Its authority includes the ability to ban certain products, reduce nicotine in tobacco products and block labels such "low tar" and "light." Tobacco companies also will be required to cover their cartons with large, graphic warnings.

The law won't let the FDA ban nicotine or tobacco outright, but the agency will be able to regulate what goes into tobacco products, make public the ingredients and prohibit marketing campaigns, especially those geared toward children.

Richmond, Va.-based Altria Group Inc., owner of market-leading Philip Morris USA, supported the legislation, while its chief rivals – No. 2 Reynolds American Inc. and No. 3 Lorillard Inc., both based in North Carolina – opposed it. The latter two have joined in a lawsuit with other smaller tobacco companies challenging specific marketing regulations of the law.

My problem is that the FDA went about this the wrong way. First, I support Obama giving the FDA the power to regulate the Tabacco Industry - NOT THE HEALTH OF OTHERS. This is a serious issue, because in this country, and only this country, is the view that REGULATING = BETTER HEALTH misapplied to something as silly as clove cigarettes instead of something serious like Pollution and contaminated water. We should be banning High Fructose Corn Syrup (or place caps on how much can be in food products) and start banning GMO products that have not undergone proper clinical trials before being sold on Supermarket shelves. Even if I choose not to SMOKE, that doesn't give anyone in my elected Government the right to take away others' rights to SMOKE.

I hope a lawsuit makes it to the great Court of Last Resort, and I hope they throw the gavel at the FDA for this ridiculous, in my opinion, panhandling to health insurance companies who don't want to provide services to smokers. I've changed from three different health care providers and insurance companies because I refuse to be part of any industry/business that discriminates against smokers, and this decision is made both as a non-smoker who is part of the "UNITED" states of America - which is made up of smokers and non-smokers, whether you like it or not. So we need to stand united!

umm what happened to my right of freedom. if i am willing to pay the cost of cloves then i should be able to smoke them. it is my life. my life my right. i started smokin young and it was regular cigs. i smoked then moved to cloves as an adult. kids are goin to smoke regardless. so why take my right away. they will still smoke. this is bull crap. and they are trying to make our country a socialist country in so many ways. is really starting to not like the country i am from lately and that is bad. its my right as an american to smoke what i want.

cloves got me deported from london, cloves were a staple in my 80's punk rock days. i would rather see bud light and football and hooters banned over cloved. what the hell is wrong with the fda? they do nothing all year long to stop any of the food issues and thick pick cloves out the mess we are in. what a joke!

The only thing I will smoke are Cloves. (Djarum Specials)

I can not stand american cigs and if I do not have a clove I won't smoke.
(cloves done leave that dirty grimy taste on a person teeth either like reg cigs do.

Cloves generate either a "wow those smell good" or "those are horrible" reaction from people.

People used to buy me a beer for a clove back when we could smoke inside bars where I live.

IF The FDA really wanted or cared about the American people/Childern in our country, they would ban High Fructose Corn Syrup from the United States. Companies could cut the amount of sugar they add in our foods by half and many of the products would taste as good and in some cases even better.

That alone would alleviate alot of our health care problems due to the USA having the most overweight citzens in the world.

first of all. FDA. i hate you. you think that making no cloves in the u.s is helping people quit. yes this may be true stat wise. but otherwise i do not wish to quit and cloves are the only thing i smoke all day every day. after long days in school and long work days, parties and shows. id like to go outside and smoke my clove. but you just have to be impossible don't you? you have to ruin others. i mean sure im going to smoke another cig but its not as satisfying. and i will never be happy with it will it get the job done. probably.. and just to let you know im 17. and i want cloves. even if they are bad for me. i dont care. you shouldnt be able to control MY life.

This is downright offensive. We already have laws in place to prevent minors from smoking - this infringes on the rights of adults to make decisions for themselves. It's their bodies, they can do as they please with it. If the government really wants to stop minors from smoking, then it should increase the penalties, make it illegal for minors to smoke, and add some teeth to the legislation that already exists. Stop stomping on adults' abilities to decide what's best for themselves.

BTW: thanks to the Fascist FDA and Das President - I've discovered buying Blacks directly from Indonesia.

When I buy 3 cartons it works out to a little over $3 per 20 Cloves (inc. shipping). As opposed to the $7 to $9 per pack with all the heinous taxes I was getting ripped off here!

Yay - I no longer have to pay tons of taxes to support medical care for all the fat obese pigs that don't pay ANY tax penalties for their disgusting habits.
