Polanski Agreed To Pay $500,000 In Civil Suit

Roman Polanski

LOS ANGELES — Film director Roman Polanski agreed to pay his sexual assault victim $500,000 to settle a lawsuit 15 years after he fled the United States, according to court documents provided to media outlets Friday.

Polanski and the victim, Samantha Geimer, reached the deal in October 1993. The terms of the settlement were confidential, but the amount was disclosed in court documents because of a two-year struggle to get Polanski to pay.

Court records do not indicate if Polanski, now 76, ever paid. The last court filing in August 1996 shows Polanski owed Geimer $604,416.22, including interest.

Polanski's attorney, David Finkle, said he couldn't remember details of the case and declined comment.

"It's ancient," Finkle said.

A phone message left for Geimer's attorney, Lawrence Silver, wasn't immediately returned. Geimer and her family also have not returned calls this week seeking comment.

Polanski was accused of plying Geimer, then a 13-year-old girl, with champagne and part of a Quaalude pill during a modeling shoot in 1977 and raping her. He was initially indicted on six felony counts, including rape by use of drugs, child molesting and sodomy.

Polanski pleaded guilty to unlawful sexual intercourse and a judge sent him to prison for a 90-day psychiatric evaluation. However, he was released after 42 days by an evaluator who deemed him mentally sound and unlikely to offend again.

The judge responded by saying he was going to send Polanski back to jail for the remainder of the 90 days and that afterward he would ask Polanski to agree to a "voluntary deportation." Polanski then fled the country the night before he was scheduled to be sentenced, Feb. 1, 1978.

Polanski, who won an Academy Award for best director for "The Pianist," was arrested last weekend in Switzerland on a fugitive warrant in the case.

Geimer, who long ago identified herself, sued Polanski in December 1988 when she was 25 years old, alleging sexual assault, intentional infliction of emotional distress and seduction. She has since joined in Polanski's bid for dismissal and has forgiven him.

In a December 1995 filing, Silver said "defendant has failed to pay any part of the sum due or the interest due on the attached note." Silver added that he talked to Finkle, who agreed Polanski was in default.

Silver then sought some of Polanski's earnings by canvassing Hollywood for his wages. Among those who were contacted about Polanski were the Directors Guild of America, International Creative Management, Warner Bros. Inc. and Sony Studios.

ICM head and Polanski agent Jeff Berg declined comment.

If Polanski hasn't paid over the past 14 years, it's unclear if he would have to pay interest. The court documents state he'd owe $128.42 per day, for a total of about $650,000.

Was she ready for that close-up Mr. Polanski?

He harmed a child in horrible ways. Does money or time buy forgiveness? He has never shown any remorse. His life has been a charmed one for all these years. A dream come true many would say. Going about his life without a care in the world. Life is good. Unless you were that innocent thirteen year old child, to you he was the nightmare come true. The actual Bogyman in the flesh. Older flesh intent on taking her innocence evermore cried the raven. . She would find no relief from waking up, and the world being the same as her few yesterdays. Could he capture that in his work and be even greater in his mind. He took what can never be replaced or undone, then ran a world away. She stayed and lived a very different life for one so young. Her life was directed by Polanski from that moment on. Was she ready for that close-up Mr. Polanski? I think not.

Today she expresses words of forgiveness for his grievous sins. She forgives while he forgets and believes he shouldn’t have to be bothered. Other soulless one’s agree publicly with him. Her feelings I can understand, she is human. My feelings would see him share her pain. Do these supporters need to learn decency and morals in some script. Let him baby-sit for all their children.

Any way you could stuff all that into a haiku?

I read all 400 plus comments you have made since Sept. and found that you contribute nothing of value ever. Very pathetic life you have one would suspect. Some people add to this world, then there is you. Get a hobby and a life. Leave me alone, I pity you and your useless comments to date. You took the name of a great character to new lows.

By the by (again :o), two interesting articles, the first by Eugene Robinson ("Polanski: Hollywood's Shame") and the second in the NYT ("The Polanski Case: A Gallic Shrug") at the following URLs respecitvely:

I read the GALLIC SHRUG.. & the other is a big Yawn..

what people seem t o get is--:Polanski outside of t his incident have NOT been embroiled in another scandale like this one.. IF HE DID.. certainly.. NO ONE WILL BE SUPPORTING HIM NOW.

Also.. the main event-- the lynch mob keep forgetting to consider-- HE IS NOW FINALLY MARRIED.. since 1989.. with 2 teenage kids.. THIS IS THE PRESENT ROMAN THE EUROPEANS KNOW.. he's not known to fool around either..

what's more-- the actual victim have forgiven him.. AND NO ONE REALLY TRUST LA DA'S office.. lol.. if they waited this long to grab him.. THERE'S ALWAYS INTERPOL if they were so gung-ho to get him.

If this arrest happened in the early 1980's?/ no one will make a noise to support him.

As for HOLLYWOOD.. he's a shame?? really?? HE WON HIS OSCAR FOR THE PIANIST.. that's all he needed to know he's been forgiven. The ones deriding him in the press/media--.. cannot /do not vote for the Oscars.. they don't really count as far as that goes.. NOW.. OSCARS.. is a whole other kettle of fish.. THAT'S THE ACADEMY OF MOTION PICTURES.. you need to be invited.. to join.. a rarified CLUB.. and his supporters are members of the ACADEMY.

I'm assuming you've read Robinson's piece and that your last paragraph is both rhetorical and meant to convey irony. (If not, Robinson's last two paragraphs make it clear that he isn't asserting that Hollywood is ashamed but rather its double standard is shameful. Robinson writes:

[Start of Quoted Text] Hollywood was there, all right, whenever the tragedy was distant, the victims were anonymous and the “compassionate” concert or telethon had acceptable production values that made all the stars look their best. How heroically they rearranged their busy schedules!

The brutalization of one young girl, it seems, leaves Hollywood's big heart awfully cold. [End of Quoted Text] (. . . since it's a friend of theirs. The double standard is shameful and is a shame.)

Although I understand the position that not all members of "Hollywood" can be indicted for supporting Polanski, the silence from those non-supporting others is deafening. For now, until someone from that group comes out explicitly against Polanski, I'm good with Robinson's position that Hollywood is morally pretentious and morally bankrupt.

at this town...
(this town will be similar to the town where Heidi lived with her Aunt)
You will make teenage advances to her...
offering to carry her books, etc...as if you were making them to a tiny, pretty girl...
but she will find it awkward
almost to the point of ridiculousness
(she doesn't need to be hideous...just tall and plain...perhaps it is a boy who she is finding herself at... a boy called Heinee))(I can't find a pi sign here)

There will be yet another town along the way..
this time the girl will be in her twenties and you will be in your fifties...
and a train ride from point A to the mountain...
where you will become Jack Nicholson
and not say too much at all...

The mountain will occur off and on throughout the drama
as she talks to YOU at your age now
to try to put this mess in order.

Well, isn't this just lovely and normal.
04:42 PM on 10/04/2009
we occasionally get glimpses of the real Heinee (hey knee) and YOU
at the ages at which they are speaking as opposed to the ages they appear to be at the seaside (where she is about eleven and YOU are about seven)
She will be introduced to your character by the seaside as being named Zeon
(this comes from my imaginings as I read a story years ago...titled something like "Table for five')

We meet Heinee again in the town
a bit furthur up the land relief (I love those pop up books)
where YOU turn up a little older
She keeps ending up at a teenager
who somehow has learned to allow her to direct their life
(method acting at its worse)
without her knowing she is not at herself
she thinks she is in a dream
walking as her own body
in another town..
she meets you
at a teenage boy
somehow she is taller than you are
even though you are both the same age

I was trying to send this to you at the conference you are supposed to be giving this week...
I dreamt it last night...
organised it rahter...
this is just a synopsis...

you work with popular books...

Setting

From the mountains of Heidi and Grandfather...
to the town below...
to the tiny Greek village with the lemonade and salty fish.

Heidi becomes Heinee in my story
(its not really who she is...its what she says)

In classic ward robe fashion...
she wanders between the seaside and the town and the cabin on the hill
spending time with
YOU

At the seaside
you talk to her in boy form...
she is a child also...
about the sea
and the culture of the Greek Islands
and the lives of the rich and disfuncional

She is not really there...
she is somehow partially in spirit form
you see her as a whole
she sees you as a whole
but we see how the people of the village carry on around and through you
(kind of like running on the track in Nintendo WII fit)

I remembered a very old interview of an actress who was quite a star in former Yugoslavia. She gave the interview some ten years ago. She started out as a child star in the seventies and was remarkably beautiful. She recounted how when she was fourteen and already had one or two films that'd been very successful locally, her mother took her to meet Polanski, in the hopes he would launch her international career. The epilogue as she told it is that Polanski didn't like her and she came back home. But I now realize that this was the deal. The ambitious mothers would take their daughters to him, and if "all went well" he'd make them a star and/or have a bit of fun in the process.
But all of that is between Mr Polanski and the legal system. It won't stop me from watching his movies and thinking he's a brilliant director, especially in the time where there aren't that many left.
And I don't know if he should go to jail or not. But if he does, he's not that likely to make another movie.

It still has God as a God
Militarism...
just like the other religions...

Judaism and Christianity both share one God...
Islam has the one God too
we only acknowledge different prophets
that's all.
02:14 PM on 10/04/2009
Will you put up my story if I am permitted to acknowledge...

that like Islam and Judaism and Christianity

Militarism is becoming a new religion
in its desire to take away the bad on this earth.

(the hashish scene I referred to came from a movie...)

I am wondering where my familial
Hashem to Washem
religious story
(joining Protestantism to Judaism with a military edge)
has gone?

En automne...
avec les changement des couleurs des feuilles...
la mort devient belle.

In autumn
in lands where you get to see the changing of the colour of the leaves
the season of death
death becomes beautiful.

Becoming.

I finally understand the Blue's Clues story
about the Menorrrah...

how the flame kept burning after the oil was all gone.

Roman Candles...

Through the darkness...
when an explanation
gets one person off-the-hook

we must wonder
who is
running the show

if we do not wonder
we are lost

he has been gone for 30 years
it did not get better over here.
