WASHINGTON — The Supreme Court has agreed to consider reinstating the sex trafficking and forced labor conviction of a man dubbed the "S&M Svengali."

The justices said Tuesday they will hear an appeal filed by federal prosecutors in the case of Glenn Marcus, convicted after a sensational trial that dealt with mutilation and extreme humiliation. Arguments will be held early in 2010.

Last year, the 2nd U.S. Circuit Court of Appeals ruled the conviction violated the Constitution because Marcus was convicted of breaking a law, the 2000 Trafficking Victims Protection Act, that wasn't in place when some offenses happened.

In September 2007, Marcus was sentenced to nine years in prison for abusing a woman he photographed for his Web site, which reveled in sadomasochism. She was identified only as "Jodi."

Justice Sonia Sotomayor took no part in the court's consideration of the case. She was on the appeals court panel that ruled in Marcus' favor and joined in the panel's decision. But she wrote separately to suggest that the ruling, though required by a string of 2nd Circuit cases, might not be in line with the Supreme Court's view of the case.

The ruling turned on authorities' use of the 2000 law to prosecute Marcus for incidents spanning from 1999 to 2001. Marcus' attorneys argued, and the court agreed, that the law was applied retroactively.

"Marcus's relevant conduct differed materially before and after October 2000, such that there is a reasonable possibility that the jury may have convicted him based exclusively on pre-enactment conduct," the appeals court said.

But Sotomayor pointed out that the high court has been willing to overlook errors that "do not seriously affect the fairness, integrity or public reputation of the judicial proceedings." Sotomayor said that standard would have allowed Marcus' forced-labor conviction to stand.

Prosecutors claimed Marcus crossed the boundaries of both civilized society and the S&M community by holding his victim against her will.

The woman met Marcus in 1998 and agreed to be one of his "slaves." He carved the word "slave" on her stomach with a knife, shaved her head and systematically punished her, according to the appellate decision. He also forced her to write for the Web site while he kept every penny it earned through advertising and membership fees.

During their last encounter, he beat and whipped her while hanging her from a beam, then forced her to write about the incident on the Web site, the decision said.

At his trial, the woman said she felt like she was literally in hell.

The defense argued Marcus and the woman had a "contract" to engage in a master-slave relationship. While potentially offensive to the general public, it was consensual and even pleasurable to the participants, the defense said.

Marcus had liaisons with the woman in homes in Maryland, Washington, D.C., and New York City, and on Long Island.

The case is U.S. v. Marcus, 08-1341.

I did some digging and read some of the case.

This woman did definitely seek of her own free will to live on the absolute razor's edge of this life-style. The cutting of the word "slave" was like a goodnight kiss on a first date compared to what she freely sought out for years and years. I mean short of blinding or killing her there wasn't anything more extreme he could have done to her. And she ate it all up. Every last bit of it, and came back for more.

However, at some point, she decided she wanted out and he blackmailed her by threatening to send images of what she was into to people she didn't want to find those things out. The man was a monster.

However, he was not convicted for any of abuse he dolled out, but for not paying her. And yet, her livelihood, rent, food and all the rest was paid for by the sites profits. I think the guy is guilty a million times over of a million different things, but I don't think he was guilty of the charges that he was convicted of: not paying her.

You do not put someone in jail for a crime they didn't commit because you're outraged at one they did but can't get him for. This woman was stupid and foolish to think anything positive could have come of this. I have no sympathy for her, or him.

You can have ex post facto imposition of criminal statutes so long it's, uh, seen as "fair" when the very reason we don't allow that is because it's actually unfair? This is a seriously bad doctrine. This is not how a nation of laws works.

He may or may not have crossed the lines of S&M "behavior".

If there was a Master/slave contract signed, then she agreed in principle to giving up certain (if not all rights). It is quite common that M/s contacts as such require the relinquishment of earnings by the slave to the Master. Some even require that property owned by the slave be turned over. If she entered into this agreement willingly, then this aspect ought not be held against him.

And, if the contact she signed did not explicitly lay out that cutting and mutilation were "hard limits", then she didn't do her "due diligence". Every person I've known, Master and slave, knows there are limits that have to be respected. Furthermore, if the contact did not have some "release clause" then she is also at fault. Again, virtually every contact that I've seen has included a mechanism for the slave to "exit" the relationship and contact.

The claim that it was a living hell for her...she signed up for it - a living hell is what she was seeking. Most slaves into S&M ENJOY pain and degradation and humiliation.

I think the sexual nature of the case overwhelmed the material facts. She entered into a contract, and it sounds as if she didn't protect her interests. Perhaps she was too naive to know better. Perhaps she wanted a relationship where she had no rights. She should be reminded to "be careful what you ask for"

No, there is significant case law to indicate that one cannot contract to an illegal activity (ie, you can't consent to be murdered).

However, whippings, mutilitations, etc conducted in S&M "scenes", are generally accepted by the courts as consentual. Periodically, there are cases where the courts revisit this.

Also, this is precisely why Master/slaves in 24/7, live-in situations have contracts. They are generally written to protect the interests of the parties (the slave as to what is given up; the master as to what can be taken/done) as well as the S&M community at large.

Your basic position is that if I stand in a county fair and say I can take any punch, and then when someone punches me and I don't like it, I can press charges against the guy for assault.

It is illegal to 'own someone' like buy them off people without a contract of consent. But I am a 'slave'. I serve my master and him alone. S and M relationships are difficult to understand from the outside. For instance, I enjoy being whipped however carving, as this girl consented too, is a hard limit for me. If there was a contract and she signed it, she wasn't crazy. Some people ask why I do it, well the simple answer is, I like it. The answer for her was she wanted it, she liked it, but then he crossed a line in 'her' mind and voila, charges. But since she signed a contract there wasn't a whole lot the courts could do. People do this because they like it.

this is such a weird case. who the hell agrees to be someone's slave and is surprised that it's hell? idk if I'm missing something but as a descendant of slaves (the permanent involuntary kind...you know, the real ones), thus whole mess is absurd. these people need help, not lawyers.

I'm sure that this is confusing to you and I could never imagine what it was like for your descendants. Nor would I ever want to be a "real" slave. But please do not assume that all people who choose this lifestyle are mentally unstable, I can assure you that most are not. Why does someone choose to become a 'slave'? There are many reasons. If you are really interested, I would recommend reading a book called "Different Loving".

In no way do I want to defend Marcus, but is that an inference that people who are into consensual S&M are outside of civilized society?

Because to me, that reads no different than to say "both civilized society and the LGBT community".

S&M is just one example. Survivalists, teabaggers­,birthers. They all ignore what there told by authorities. Sexual exploration is a part of human nature. Whatever the sexual orientation there are people who explore realms that a lot of people don't. Straight, gay, bi etc etc curiosity and sexual tastes vary. S&M is one place that humans like to go. It goes beyond the idea of creating pain there's a whole realm of experience for those who partake. It's a form of pleasure you have to read about to understand. In any event for anyone naive enough to think Missionary is the only"nary"....you are wrong big time.

They are only "outside civilized society" in this area. You're talking about an extreme form of S&M. There are people you would never think to be into S&M because their lives are mainstream. I've known curators at a museum in Boston and lawyers etc. You have to understand the psycology of the participants to understand why they enjoy it.

I have seen at these glbtq community centers alot of predators that call them selves s&m pulling in young lgbtq youth and telling them they agreed to be traumatized.

Read about it before you make uneducated pronouncements. Humans are "depraved species" for a lot of reasons....bigotry, violence, S&M is not one of them just certain aspects or those who violate the rules. You have to be pretty depraved to send an entire country to war because you feel like it. To lie and exploit the trust of your countrymen. Bush and Cheney are probably two of the biggest sadomasochists this country has seen and it wasn't sexual !!! Although they probably got a rise from it.

Find out why that women contracted to be his slave while you're at it. Like I said educate yourself a little to understand the dynamics.
