LOS ANGELES — The founder of TMZ.com is promising a fight, saying the Los Angeles County Sheriff's Department illegally obtained his phone records in its investigation into who leaked a report on Mel Gibson's 2006 drunken driving arrest, including details on the actor's anti-Semitic tirade.

Harvey Levin's comments came during a speech Monday night at UCLA at an event hosted by the Radio and Television News Association of Southern California. He said he considers the department's actions an assault on the First Amendment.

"It breaks federal law. It breaks state law," Levin said. "It's outrageous. We've met with lawyers and are charting our course of action. This is not going to go away."

Sheriff's Department spokesman Steve Whitmore said the phone records were obtained legally.

"This was signed by a judge, it was consulted with the district attorney's office before any of this was done," Whitmore said. "It was absolutely legal.

"The First Amendment is paramount for the Sheriff's Department," he said. "This was not about him (Levin). This was about looking at the unauthorized release of documents."

Gibson was arrested for misdemeanor drunken driving on July 28, 2006, on Pacific Coast Highway in Malibu. His anti-Semitic slurs, detailed in a report leaked to the celebrity Web site, provoked outrage, and the "Braveheart" actor and director later apologized.

The officer who arrested Gibson, Deputy James Mee, became the target of a criminal investigation into whether he leaked the arrest report. Records obtained during that investigation showed several calls between Levin and Mee's home. But authorities determined it was impossible to say who made the calls on Mee's end of the line.

Prosecutors eventually declined to charge Mee, citing a lack of proof that he leaked details about the case.

Gibson pleaded no contest in August 2006 and was given three years probation, fined $1,400 and ordered to attend Alcoholics Anonymous meetings. Earlier this month, a judge agreed to expunge his drunken driving conviction after he successfully completed the terms of his probation.

I like Mel Gibson the actor, but not a fan of the person.

However, Harvey Levin is a true voyer sc#m bag. His business model is to appeal to the worst in us for entertainment and money.

Why didn't anyone request the video and other material from the Mel Gibson arrest under the California Public Records Act. I know some may have when the story first broke and Baca's office turned it down citing investigatory files exemption. The investigation has long since concluded, Gibson's probation period is over so now seems like the perfect time to request the video under Govt. Code section 6250 et seq.

Gibson doesn't have a greater expectation of privacy then any other person whose 911 call or DUI stop video taped appears on the local news or dumbest criminal video real. The Smoking Gun, or Harvey Levin should be all over this since Sheriff Baca's office has lied before. Once they said they had never issued a certain celebrity a concealed weapon permit, so the reporter asked for all applications for release of all concealed weapons permits approved or not, realizing it was a losing batter the county counsel's office decided to the records proving the Sheriff's office has a problem with lying, especially when it comes to celebrities.

Getting a Los Angeles Superior Court Judge to sign off on a warrant, yeah that is hard. Sounds like the Sheriff is acting like federal inmate Anthony Pelicano.

Perhaps you need to read the article again, specifically where it states:

They engage in a practice called redlining whereby if you live in they consider a "marginal" neighbor (i.e. peopled with Blacks and Latinos) they wont' allow you to subscribe. This happened to a friend of mine who really lived in what I consider a nice neighborhood.

That is what defines our laws and rules today: You can commit ANY crime as long as You buy politicians who will then make a law protecting You from prosecution.

It started with gag orders and confidentiality agreements. How can a contract be valid that is designed to hide crimes? It is not only a right of any citisen to get a criminal sent to prison. it is our duty.

To illegally obtain documents does not make the crime legal. But it makes it impossible to charge anyone. And that is against those whose laws those are.

In California, a person is charged with a second DUI if he is convicted within ten years of the first DUI. A second DUI has more severe consequences, including a year and a half alcohol prgram and jail time.. A third one within that ten year period carries a mandatory 120 days in jail and license suspension of at least a year and half (or maybe more). The fourth carries a mandatory prison sentence. How could the judge expunge this conviction after three years? Does this mean that his next conviction will count as his first? If so, how come other convicted drunk drivers don't get their records expunged after finishing their probation? Why was Gibson treated differently?
