WASHINGTON — Defying the Obama administration, the House Judiciary Committee voted Thursday to remove from the USA Patriot Act a tool for tracking non-U.S. citizens in anti-terrorism investigations.

The committee, dominated by Democratic liberals, also voted to amend the anti-terrorism law to curb the government's surveillance and seizure powers.

The bill went to the full House on a 16-10 vote along party lines, with Republicans casting all the votes in opposition. GOP lawmakers said the legislation would hinder law enforcement and intelligence agencies in fighting terrorism.

The legislation would allow the Patriot Act's never-used "lone wolf" section to expire at the end of the year. The provision permits the government to spy on non-Americans even when they're not linked to a recognized terrorist group.

The Justice Department has asked that the "lone wolf" authority be continued, even though it hasn't been needed yet. Patriot Act revisions before the Senate would retain the tool, but the House Democrats said normal criminal investigative tools could be used instead.

Three sections of the Patriot Act expire at year's end, giving lawmakers the opportunity to amend the law.

Congressional liberals believe the act tilts too far in favor of law enforcement and intelligence agencies while failing to protect Americans' privacy against government snooping and seizures.

The bill before the Senate, approved by that chamber's Judiciary Committee, would make it easier than the House legislation for authorities to obtain tangible items, including business and library records, and conduct wiretaps.

In addition to eliminating the "lone wolf" language the House bill would place restrictions on national security letters, which are FBI demands for information that do not need a judge's approval.

Liberal lawmakers argue that restrictions on court-ordered seizures mean little unless there are curbs on the FBI's authority to issue the letters.

Under the bill, before issuing national security letters the FBI would be required to demonstrate that the information requested is connected to a foreign power or its agent.

The bill also would force the government to justify to a judge the need for a gag order, which prevents the recipient of the letter from disclosing it.

The Justice Department inspector general has reported that the FBI in the past improperly collected and retained improper information from the security letters.

The House bill's curtailment of some government authority is certain to upset law enforcement and intelligence officials, but sponsors only need a simple majority to pass it.

The 100-member Senate needs 60 votes to advance a bill, and the compromise bill before that chamber – crafted by Judiciary Committee Chairman Patrick Leahy, D-Vt., and others – was designed to overcome that hurdle.

A wildcard in the debate is the Obama administration's Justice Department. So far, the department's only public stance been to seek continuation of the three expiring sections. Several lawmakers demanded that the Obama administration provide it's position on the changes.

The House bill's also would:

_Require the government, in requesting a roving wiretap, to demonstrate to a judge that the target is a single person. This would avoid a fishing expedition that could ensnare innocent people, supporters say.

_Require the government to produce more evidence to a court than currently needed, in order to obtain records from businesses, libraries and booksellers. An even higher standard would be needed for obtaining library and bookstore records.

_Set a December 2013 expiration for the roving wiretap and records seizure sections. Congress would have to revisit the legislation to keep those sections in force.

In gaming parlance, this is known as having one of your best weapons or abilities "nerfed" because it has an unfair advantage. But I'm not surprised at all.

Of course the Justice Dept. (i.e the FBI) wants to keep the provisions because it makes their jobs easier. And I'd wager that if any of you were president you'd be for it too-- because if something happened, it would be your ass. The GOP would have a field day if you were for repealing these provisions and the nation suffered another terror attack.

The Patriot Act and the Military Commissions Act are two main tools to destroy the Bill Of Rights and the constuitution. As long as those two antidemocratic murderers of rights are in place Obama has no right to call himself a man of or for the people. Because it is the people's rights those two so called laws destroy.

It's not that the Patriot Act is a bad intention by its very nature, the problem is that politicians can't be trusted not to abuse it. We need to be protected from ourselves.

Bush/Chene­y/Rice/Rum­sfeld and others had AMPLE warning of a 9/11 attack months before the 9/11, and NOTHING was done to assure any margin of safety! That was before any of the privacy intrusions clauses of the patriot act!

Therefore, the patriot act is proven unnecessary! But, the administration must act on good intelligence!

And notice that the patriot act was passed and signed into law 45 days after 9/11 attack without debate. In the best of cases, it might normally take that long just to draft the legislation, which was very comprehensive and far reaching. In other words, the Patriot Act was ALREADY WRITTEN, before the attacks. Which was followed up with the Anthrax attacks, later traced to US military weapons lab, delivered specifically to get the bill passed without debate, to drive home the message. This was not the first coup d'etat on US soil to take place while america slept and not likely to be the last. Wake up people. Because if you are waiting until you are shackled to a rail car and heading off to a concentration camp to decide to protest, that might be a little to late for you.

Title II - Roving wire-taps, sneak & peek warrants & other inclusions that allow law enforcement to inappropriately gain information on citizens without a warrant.

That is quite contrary to the fourth amendment of the constitution:

"The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized."

How about, nobody read the bill before they signed it?

I doubt that you read the entire thing since it takes judges 20 hours to read it and it's full of legal jargon most people would never understand.

The bill goes agaist multible of our civil liberties.
National security letters can be served to gain your information from ISP's, Librarians, Accountants, Banks under the threat of imprisonment if the person who receives the letter talks about it to you or even speaks under oath during the trial in which the documentation obtained is being used.

Sneek and peek allows the government to go in and go through your things without probable cause and currently there are no limits on this amendment. This provision has mostly been used in drug busts and not in "terrorist" related cases. Under normal search warrants the officials are only allowed to obtain a limited number of information based on the authority granted by a Judge after proving probable cause, but due to the Patriot Act anything illegal or suspicious can be taken and used against you.

It allows Indefinite Imprisonment, and blocking you from being given a lawyer, face your accuser or go infront of a judge. Thus taking away the right to a speedy and public trial and putting you through cruel and unusual punishment since you are innocent until proven guilty.

So it violates the 1st, 4th, 5th, 6th, 8th and 13th amendments.

The entire "Patriot Act" should be repealed. Period.
It was the result of extreme over-reaction by a very emotional GOP led administration.
It is time to correct the wrongs, and put a stop to it now.
America stands for liberty and freedom. Those that wish to take that away should look to moving to a choice of many other countries that do not believe in freedom and liberty. They have a choice. Dont make us change America to suit their ideas.
