LOS ANGELES — A German man was charged Thursday with trying to extort $100,000 from former supermodel Cindy Crawford and her entrepreneur husband Rande Gerber over a photo of their daughter bound to a chair and gagged, authorities said.

Edis Kayalar, 26, has not yet been arrested. He was recently deported to Germany and believed to be in Stuttgart, authorities said.

He was charged with one count of extortion. If convicted, he could face up to two years in prison. It was not clear if he has an attorney in the U.S.

The photo was purportedly taken by the couple's former nanny earlier this year and shows the girl, then 7, bound to a chair wearing shorts and a T-shirt.

The daughter told her parents, who were unaware of the photo, that the nanny took the picture as part of a "cops and robbers" game, according to an affidavit filed in the case and first obtained by The Associated Press.

The nanny, whose name wasn't released, has not been charged. She was fired a week before Kayalar called the couple.

Kayalar stole the photo from the nanny and repeatedly sought to get money from Crawford and Gerber, starting in July, according to the document.

Kayalar initially said he wanted to return the photo because he was a good person and didn't want to see it land in the tabloids, the affidavit said.

Gerber later met with him at a bar, where Kayalar showed him a copy of the photo and said he also took a handwritten note from the nanny's apartment that read, "The baby sitter went crazy and tied everyone up and they need your help! Please."

The nanny said she had taken the photo as a prank and was going to post it and the note on the front door of the family's house, according to the affidavit. The nanny never went through with the joke.

Gerber eventually got the photo from Kayalar and paid him $1,000 in cash "for his trouble," the affidavit said.

But Kayalar is accused of demanding more money while saying he had another copy of the photo.

"He believed he could have received $500,000 from the tabloids for the photograph and that he deserved more money from them," the document said.

Kayalar was taken into federal custody for an immigration violation three months ago and deported. However, he called Crawford and Gerber again on Nov. 1 and threatened to sell or release the photo to the media if his demand for $100,000 wasn't met, the affidavit said.

Kayalar said he "was not trying to destroy a little girl's life, but the release of the photograph was not going to be something positive for the victims' image," according to the document.

Kayalar allegedly gave Gerber a German bank account number and routing information and saying the money should be wired within three days or the photo would be made public.

The last contact was an e-mail sent Tuesday to Kayalar at the direction of the FBI that indicated the payment would be made later this week. No money has since been paid to Kayalar.

Crawford's spokeswoman Annett Wolf issued a statement saying, "Rande Gerber and Cindy Crawford intend to pursue any and all available legal action against anyone who aids the perpetrator in the distribution or sale of the photograph of their daughter."

Crawford, who divorced actor Richard Gere in 1995, married Gerber in 1998. They have two children.

Wow, the nanny should be arrested too! Who the he// takes a pic of a kid like that for a prank? What BS. The Gerbers need to really take more time and effort to find a decent nanny. I have friends who are nannys and they are appalled at this story.

I was once overseas in a bathroom of a countryclub and I was alarmed by sobs of a little girl and voices of a nanny telling her in the locked stall that she won't tell her parents what has happened. I knew her mother, she was a society woman, probably visiting her hairdresser while who knows what was happening to her daughter. I was living in Germany, and a twelve year old girl from the neighborhood was dying to take my month old baby for a walk in the streets in her carriage, but I refused because I was afraid something might happen to her. A neighbor who had a baby the same time, accepted, and they ended using this girl all the time.Somet­imes I regretted my decision. It is not possible to be 100% with your kids, but stuff does happen when you are not with them. Cindy Crawford is a multimillionaire, she is all over the place, from hawking a skin creme line, to putting her name on a line of furniture and bed linen . She jetsets with the rich and famous in San Tropez . With this lifestyle and schedule, she cannot have much time for her kids. She has gorgeous kids, and knowing the predatory practices of the paparrazi, I think she is too trusting when she always poses with them . If I were her, I would try to protect them a little more by keeping them away from the media lenses.

this is a really odd situation. i bet cindy crawford is mortified, even more so that she had no idea that her kids had played this game, which i bet she wouldnt have approved of. then the babysitter actually took pictures of it that can be construed any kind of way.

bad situation, but its playing out like this only because she is famous and has mega bucks, otherwise it wouldnt have happened.

but i do feel bad for her and her children.

If the average person thinks kids today grow up too fast with the images from mags and TV, internet, etc. what do you think about LA??

I bet Cindy and Rande's daughter has aged 3 years faster than the regular kids at her age..and that's saying something. Lisa Rinna talked to Howard Stern and told him in an interview (google it) that she and Cindy took bj technique classes together. Cindy said in a recent interview that LA 60 year old women look like 20 years old in the back. These women are obsessed with staying young and hip in that LA culture. They're busy working out and doing stuff that it's no wonder their children are with nannies. Lord knows they have enough money to not have to work. But if they enjoy it, well, that's another thing.

I played cops and robbers all the time as a kid, but nobody older than me, say an adult... tied me up and bound my mouth with duct tape. That would have been way too weird and over the line.

I have to say that there is a flaw in the story from these two. How is it that the nanny who did this was conveniently fired before this guy contacted them? Yeah, right! They most likely knew of the photo and only fired the nanny once the picture was in this guys poession. they are not only lying to cover up an poor image problem, but they fired an employee over it.

The guy is not an American. He is a German and now living in Germany. US law is not world law and means absolutely nothing over here. They will have to try to sue him in German courts.

Where were the parents while a babysitter was making child bondage porn?

I can understand that some people end up neglecting their children because they're too poor, stupid, drug addicted, or otherwise ruined to do anything else. I can recognize that the doomed middle class end up neglecting their kids because they spend their entire lives at work.

But why do egregiously wealthy celebrities persist in having children they so obviously have no interesting in rearing? Is it some sort of consumer greed where they feel they simply have to have everything, including small people?

It makes me want to write a fan letter to Paris Hilton, applauding the apparent moral honesty that has lead her to acknowledge she's too selfish, shallow, and distractible to be a parent, and encouraging her to continue to palliate any such urges with an endless series of superficial lovers and equally stupid small dogs.

If you aren't prepared to devote a third of your adult life rearing a child, then get a god damned puppy.

The article states the woman was their nanny, not an occasional babysitter. Sounds like they might want to tighten up whatever background check they do before they hire the next nanny.

What a wildly presumptuous and ridiculous post!

Is it that they are rich celebrities that you can't see your way past envy to reason?

Most people, rich or poor, turn over care of a substantial amount of their child's care to others, as in 5 days a week of public school, lessons, the occasional babysitter for nights out, etc.

Don't make assumptions about the Gerber's child rearing because someone tried to commit a crime against them.. They are the victims in this and the story reveals no signs of their having done anything wrong.

Now, get out their and make your life something to be proud of so you won't have to tear down those who you think have it so much better.

Child bond-age p0rn? Really? and as everyone knows, parents must constantly watch their children at all times, never going to work or out at all away from them. Anyone who hires a babysitter is evil and a bad parent. Even if they fire them for this type of thing.

The only fishy thing is that maybe the babysitter was involved, which was why she was fired... but I'd never say such a thing without evidence because that would be irresponsibly commenting on something without all the facts, kinda like you did. *wink*
