Israel Admits Harvesting Organs From Dead Bodies Without Permission

(AP) JERUSALEM - Israel has admitted that in the 1990s, its forensic pathologists harvested organs from dead bodies, including Palestinians, without permission of their families.

The issue emerged with publication of an interview with the then-head of Israel's Abu Kabir forensic institute, Dr. Jehuda Hiss. The interview was conducted in 2000 by an American academic, who released it because of a huge controversy last summer over an allegation by a Swedish newspaper that Israel was killing Palestinians in order to harvest their organs. Israel hotly denied the charge.

Parts of the interview were broadcast on Israel's Channel 2 TV over the weekend. In it, Hiss said, "We started to harvest corneas ... Whatever was done was highly informal. No permission was asked from the family."

The Channel 2 report said that in the 1990s, forensic specialists at Abu Kabir harvested skin, corneas, heart valves and bones from the bodies of Israeli soldiers, Israeli citizens, Palestinians and foreign workers, often without permission from relatives.

In a response to the TV report, the Israeli military confirmed that the practice took place. "This activity ended a decade ago and does not happen any longer," the military said in a statement quoted by Channel 2.

In the interview, Hiss described how his doctors would mask the removal of corneas from bodies. "We'd glue the eyelid shut," he said. "We wouldn't take corneas from families we knew would open the eyelids."

Many of the details in the interview first came to light in 2004, when Hiss was dismissed as head of the forensic institute because of irregularities over use of organs there. Israel's attorney general dropped criminal charges against him, and Hiss still works as chief pathologist at the institute. He had no comment on the TV report.

Hiss became director of the institute in 1988. He said in the interview that the practice of harvesting organs without permission began in the "early 1990s." However, he also said that military surgeons removed a thin layer of skin from bodies as early as 1987 to treat burn victims. Hiss said he believed that was done with family consent. The harvesting ended in 2000, he said.

Complaints against the institute, where autopsies of dead bodies are performed, at the time of Hiss' dismissal came from relatives of Israeli soldiers and civilians as well as Palestinians. The bodies belonged to people who died from various causes, including diseases, accidents and Israeli-Palestinian violence, but there has been no evidence to back up the claim in the Swedish newspaper Aftonbladet that Israeli soldiers killed Palestinians for their organs. Angry Israeli officials called the report "anti-Semitic."

The academic, Nancy Sheppard-Hughes, a professor of anthropology at the University of California-Berkeley, said she decided to make the interview public in the wake of the Aftonbladet controversy, which raised diplomatic tensions between Israel and Sweden and prompted Sweden's foreign minister to call off a visit to the Jewish state.

Sheppard-Hughes said that while Palestinians were "by a long shot" not the only ones affected by the practice in the 1990s, she felt the interview must be made public now because "the symbolism, you know, of taking skin of the population considered to be the enemy, (is) something, just in terms of its symbolic weight, that has to be reconsidered."

While insisting that all organ harvesting was done with permission, Israel's Health Ministry told Channel 2, "The guidelines at that time were not clear." It added, "For the last 10 years, Abu Kabir has been working according to ethics and Jewish law."

Is this “news” so captivating because some people relish finding Israel in an indefensible position? What do you call those people?

Here’s some related news.

Due to the massive shortage in organs for transplant, the government is planning to harvest the organs of all brain dead people in government hospitals even without the consent of relatives.

This move, known globally as presumed consent, is aimed to prevent the illegal organ trade and will help thousands of people waiting for corneas to gain sight.

British Prime Minister Gordon Brown has backed a system of "presumed consent", allowing
organs to be removed unless a person has specifically opted out of a national register
or their family objects. It is hoped the change will overcome an acute shortage of organ donors

The New York-based Presumed Consent Foundation is pushing for legislation to make "presumed consent" a matter of course. A presumed consent law would mean that everyone would automatically be considered an organ donor. Individuals opposed to the idea could "opt-out" by entering their name on a national registry in a process similar to the "Do Not Call" list aimed at keeping telemarketers at bay.

And in our own country, H.B. 2111, 78th Reg. Sess. (Tex. 2003) amended the Texas Anatomical Gift Act to create a presumption that, upon the death of a state resident, over the age of 18, his or her body (as well as parts thereto) would belong to certain state agencies.

The Israel practice is disgraceful and thankfully, it has been stopped. I object to it on the moral grounds that it just seems wrong. The practice contravenes Jewish law, and I expect Israel to adhere to the moral teachings of the Jewish people. To fail in this is a disservice to the Jewish community.

When this story first broke, many found it incredible and wanted to see proof. One liberal commentator said that people who defended Israel were accusing Israel’s critics of anti-Semitism. I didn’t see or hear such accusations, but I suppose some such accusations were actually made.

I do find it interesting that the story has gained such traction. After all, the story is old, and the practice has been stopped. Perhaps it can be because Israel is held to a higher standard.

Now, before you say I am throwing around a charge of anti-Semitism, allow me to explain.

I believe that Israel should always uphold the highest standards of ethical behavior. Besides the moral argument, it should be recalled that doing so is a strategic imperative for Israel. Furthermore, the cold truth is that if a country disgraces itself, bad on them. If Israel behaves disgracefully, it reflects on Jews worldwide, and that includes me and my family.

I just read this and I am amazed. I sent it to my boyfriend, who is an Israeli physician. His response: "I am blown away". No matter how you look at this, the symbolism here cannot be overstated. Doing this to anyone without permission is wrong. Doing it to your enemy during war is worse. I am shocked. I can't even believe anyone would risk the kind of reaction this would provoke.

This story highlights the irresponsibility of the American government. This is what happens when weapons are given to people who apparently do not possess the moral fortitude to use these arms in a responsible manner. Continued welfare to Israel needs to be predicated on some kind of American oversight into the actions of the Israeli government, and the ability to reverse or veto Israeli laws that are not in keeping with our own legal code.

Our leaders have decided to prop up Israel's military and economy and what do they do with our support? They steal organs from those whose voices and lives have been snuffed out by American weapons. It is disgusting and shameful that we consider such countries to be our allies.

BEWARE OF FALSE CLAIMS!
Some pro-Israel posters here are falsely claiming that the initial Swedish report said that Israel was intentionally killing Palestinians to seize body organs. Before you believe such smears, read what that author had to say at the time of publication:

"What I'm doing in my article is giving a range of examples of very active organ trafficking going on [in Israel]," he said....

"...Bostrom stressed that he has no proof that Israeli soldiers were stealing organs, and that the purpose of his opinion article was to call for an investigation into numerous claims in the 1990s that such activity was going on. One of those claims is from the family of Bilal Ahmed Ghanem, a 19-year-old Palestinian man who was shot and killed in 1992, allegedly by Israeli forces, in the West Bank village of Imatin.

"I was present that night, I was a witness," Bostrom said.

He said Ghanem's body was taken away and returned several days later by the Israeli military with a cut in his midsection that had been stitched up. Ghanem's family said they believed that his organs had been removed..."

"...I was in the West Bank 50 times in the early '90s when I experienced this," Bostrom said. "I think it should be further investigated."

The kidney sellers in Iraq, I was told by one Palestinian kidney transplant patient in March 2001, are mostly young men, foreign workers from Jordan, and poor Iraqis who are housed in a special wing of each hospital in dorms that could be called "kidney motels", while they wait for the blood and cross-matching tests that will turn them into the day’s "winner" of the kidney lottery. In Iraq the transplant package, complete with pre- and post-operative care and with fully equipped modern apartments provided in the hospital complex for accompanying relatives, is only $20,000, up, we were told, from only $10,000 several years ago. In fact, it was the appearance of these successful transplanted Palestinians in the after care clinic of Hadassah hospital that prompted Jewish patients to pursue alternative transplant options for themselves.

BRAZIL: Poor Sell Organs to Trans-Atlantic Trafficking Ring

RIO DE JANEIRO, Feb 23 (IPS) - At least 30 Brazilians have sold their kidneys to an international human organ trafficking ring for transplants performed in South Africa, with Israel providing most of the funding, says a legislative commission in Brazil.

The Pernambuco state legislature's investigative commission began its enquiry in December and has since helped federal police and justice authorities untangle concrete cases of human organ sales.

Two Israeli citizens, Gedalya Tauber and Eliezer Ramon, and six Brazilians were arrested in Recife, capital of Pernambuco state, in the northeast. They are believed to be active members of the group that recruited people in the area to sell their kidneys, the commission's chairman, Raimundo Pimentel, told IPS.

The "sellers" were taken to the South African city of Durban, where the transplant surgeries took place at St. Augustine Hospital. The recipients were mostly Israelis, who receive health insurance reimbursements of 70,000 to 80,000 dollars for life-saving medical procedures performed abroad.

different. The law relating to the organ donation issue is the Law
of Anatomy and Pathology. Section 6 of that law states that a
doctor is allowed to operate on a body and use any part of it in
order to save life. This is subject to one condition: namely, three
doctors qualified for this task must sign a document declaring
that the operation is indeed being performed for the purpose of
saving a life. The law states that, by definition, cornea, kidney
and skin transplantations are also considered life-saving procedures.
The law does not require the approval of either the donor
or the family. However, there is the obligation to notify the family
before the operation takes place [8]. Clearly, not only does the
law ignore the question of expressed consent, it also leaves the
individual with no option of objecting to the harvesting of his or
her organs upon death".

Read the whole article. There are the customs of Presumed Consent, and Expressed Consent. Israel now belongs to the group of countries that works under the policy of Expressed Consent, which requires "opting into" organ donation. A large number of European countries currently work under the policy of Presumed Consent, under which an individual must actively "opt out" of organ donation, otherwise he/she are automatically considered to have consented. The countries that accept this include Austria, Belgium, France, Italy, Norway, Spain, etc.

For Pete's sake, WHY!!!??? work so hard to misconstrue in an effort to demonize an entire people.

I provided a discussion paper on Presumed Consent in Israel, in response to those who asked whether express consent was the law (see below)
But if you want to imply a "demonisation of an entire people", you're barking up the wrong tree.
You DO have a brutal occupation of a people the International community can't do diddly squat to ameliorate their condition, and when those people say their children's organs are being harvested, what court, what police force, what media will look into it? The Occupying force's? The apologists who equated this with racial prejudice? Please.
I'm just asking, under Israeli law, what mechanism do the occupied have to opt out of 'presumed consent' or to register their 'express opposition' to the donation of their child's organs when the bodies are returned to them post mortem?

Last comment I have and then I can't even bear to post here anymore on this topic.

It is European law, US law, and the law of every country that abides by the UN charter that grave robbing and desecration of corpses is a war crime. It is a crime in every civilized society. It is recognized in China, Japan and all Southeast Asian countries as a defilement.

What would you like for your own loved one to think if they got back your desecrated corpse? To know they sold your parts on the open market?

If you do not, and more importantly, CAN not see the wrong in that, you are on a ride to heII and you won't be taking me, or any other civilized person with you.

Can someone explain to me how robbing the dead suddenly became acceptable? Some of the people posting on here seem to think it is just fine since they don't know the person, but I was taught that you don't even do it to your enemies. It's against the UCMJ in the US. This isn't even robbing, this is desecration. Have you no honor?

WBMD, we gather from Ergon, that you are right, if the families of those who were "harvested", were notified "before the operation is performed" no crime has committed under Israeli law.
However, this does not in any way, make Israeli actions less offensive to ordinary human feeling. I would argue that such feelings cannot be dismissed as mere "anti-semitism," and must dealt with on an honest basis.
If it is not will be seen as duplicity on the part of the Jewish State. And, given the ambiguity of this term, there is grave danger of this duplicity can be attributed to non-Israeli Jews.
As Ibsaltzman says Israel acts in ways that are deeply dangerous to all Jews everywhere.

In light of these developments, the allegations described by the Aftonbladet need to be investigated by an independent inquiry. We do not know how deep these atrocities actually run.

I believe there are individuals worldwide who handle corpses involved in isolated incidents of organ selling, as greed is a human trait not linked to nationality. All of us are capable of the best or worst given the right or wrong circumstances. It appears are there citizens from certain countries who seem to have organized themselves to take this to a systematic level. Based on the number of known incidents though, it looks like Israel may be one of them. While it may not be "official" government policy, there have to be high government officials involved, along with payoffs, bribes etc. When you you have a nation who believes the ends justifies the means, that saving it's own people ( via organ transplants as one example ) is paramount even if commiting atrocities or crimes against others, that rationalizes these actions based on past transgressions against themselves, it's not a stretch to draw these conclussions. With a government cloaking itself in self-righteousness, loathe to ever admit any wrongdoing unless clearly and publicly exposed, it makes it difficult to take anything they say at face value. This is a bed of Israel's own making. We happen to be talking about organ transplants, if we were talking human trafficking for sex, we would be discussing different countries, if we were talking drug trafficking we would be talking different countries also. People need to stop letting paranoia or blind patriotism prevent the righting of wrongs
