Dominic Carter JAILED: NY1 Reporter Gets One-Month Sentence For Assaulting Wife

SUFFERN, N.Y. — Former cable TV newsman Dominic Carter was sentenced Thursday to 30 days in jail for an attempted assault on his wife and was ordered to stay away from her for up to two years.

An angry suburban judge called Carter "a classic case of a domestic violence abuser" and ordered him to undergo psychiatric treatment for violent tendencies. He also imposed 52 weeks of domestic violence classes and told Carter's wife, Marilyn, "Mrs. Carter, your life is at stake."

Carter, who was an influential reporter at New York City's NY1 until the domestic violence charge was made public, was led away in handcuffs and appeared to be on the verge of tears.

As he headed for the Rockland County jail, Carter told his 21-year-old daughter, "It's on you, Courtney, to be a big girl."

Defense attorney Marvin Gotkin called the two-year order of protection "almost medieval."

"I have never heard a court tell a husband he has to stay away from his wife for two years," Gotkin told Ramapo Town Justice Arnold Etelson.

Marilyn Carter, 52, declined to comment. She had called police in October 2008 and said her husband hit her. He denied it and she recanted, but he was convicted of attempted assault.

Carter's appeals lawyer, Julia Kuan, said both the conviction and the sentence would be appealed.

Etelson said he might modify the order of protection order if he is satisfied that Carter is cooperating with psychiatric treatment and if it is in his wife's best interests. But he barred her from visiting Carter in jail.

Etelson pronounced the sentence after reciting a litany of domestic violence police calls involving the Carters that went back 13 years.

The judge also said that at a hearing last month, Carter claimed he was being railroaded because he is black.

"I'm a black man in America," the judge quoted Carter as saying. "I'm being railroaded." The judge denied any racial discrimination in the case.

On Thursday, before being sentenced, Carter told the judge he had been "humbled and humiliated." His voice breaking, he also apologized to his wife "for not being a better husband."

NY1 said Wednesday that Carter's contract was not renewed and the leave of absence he had taken was over.

Carter's nightly "Inside City Hall" program was must-see TV for city politics junkies. He had interviewed every major New York City and state politician and moderated many political debates, including one in October between the city mayoral candidates.

But the story of his wife's accusation broke just before Election Day, and Carter, who would have anchored NY1's vote-count coverage, found himself on the sidelines. He said earlier this month that he couldn't bear watching the returns.

Carter, 45, also said the loss of salary might force his family to give up their home in Pomona and move elsewhere. Besides their daughter, the Carters have a 17-year-old son.

At Carter's trial in October, Rockland County prosecutor Richard Moran played a recording of Marilyn Carter's 911 call and presented photos of her swollen lip, cut ear and bruised arm and leg.

Marilyn Carter acknowledged on the witness stand that she made the 911 call but said the real assailant was a day laborer whose name she couldn't remember. She said she told police her husband had beat her because she was angry about an argument involving their son's medical treatment.

But the judge said her revised story was "nothing short of preposterous" and found Dominic Carter guilty of attempted assault. He said Marilyn Carter's injuries were not serious enough to warrant an assault conviction.

The judge implied Thursday that he believes Dominic Carter was behind the day laborer story and said Carter could have been charged with suborning perjury. He said Marilyn Carter could have been charged with perjury, except her account typified "the victimization that she has endured."

My question is why in the world is this successful gentlemen with a black lady in the first place? The African American woman is taught to compete,fight (called stand up to) their husbands and white women are taught to love and be loved by their husband. I was once with a black lady and she found out I was havin an affair with a coworker and needless to say she came to my job ,flattened my tires, bust my windows and attempted to assault my coworker and me.Need I add she was sent on her way with no charges filed as I sat in the police car until my female coworker explained to the officer what occured.We had crazy makeup sex for days.This happened with every job afterwards though none of the times I was actually cheating. Well, I took online courses and got a better and more stable job after we finally broke up.I have been happily married to my lovely all american blonde for 12 years and has never had a disagreement that became more than a conversation. There are many more successful blacks with white ladies then the opposite.Anyone remember the incident of Barack the candidates wife having jealousy issues on the campaign trail and even punishing him for it. My point exactly

I don't know him personally but after hearing him speak at the Manhattan DA's office one year I just found him to be a bit suspect...idk what is was but there was something missing...I feel for his daughter shes a beautiful girl...

Now if she called the cops and lied (she recanted her story ) then she is the one who I hopes suffers for years to come. Go get a job MS Carter you need to provide now.

Sounds like you have some issues yourself, how else can anyone defend his behavior. She recanted because that is what victims of abuse do.

I have no problem with the 30 day sentence although the 2 years part seems a little heavy handed as opposed to serious therapy and counseling. Too bad for Dominic Carter he's a sharp correspondent and I enjoyed him as part of the NYC journalism scene. But clearly he has some very dark personal issues and I hope he works them out and can return to what he does best. NOW what I don't understand is why Hiram Monserrate was allowed to walk (with a minor conviction) back into state senate job after slicing the face of his girlfriend (and his rough handling was caught on tape?) Explain please.

I made excuses for what my ex did to me - the broken nose, black eyes, hair pulled out of my head from being slammed into a wall. The change in the wife's story may be outrageous, but it smells of coercion. I got smart and left before the 1st anniversary but I also didn't have any kids with my ex (thankfully). It's hard to explain the behavior, the excuses that women use, especially if there are kids involved. If this guy did it, he needs jail time and much more than 30 days.

Wife would have been better off just leaving him, now she got the government involved and the whole family is going to suffer. If he's abusive and he works and your family needs to salary, lave and threaten him that if he doesn't take care of you, you'll report the abuse. Just dumb on her part, but he probably had another woman and she confronted him and he struck her and she was getting revenge. Now the revenge is on the entire family.

speculation... why must there be another woman? i think the other woman , was his job. think about it , NYC-politics, changes from top-down. i believe Carter did his job 24/7 causing his personal life to suffer not a 9-5 gig. nice if you could have it both ways. at the end he presented the news as anyone would have wanted it done.

This country is slowly eroding into an overpowering judicial system that is abusing its authority. I do not condone or endorse any usage of physical violence but what concerns me is that all it takes is words these days to have someone locked up. One does not even have to have bruises or any evidence of assault...just their mere words is sufficient to impose jail time. The wife recanted her story but the judge decides that it actually happened. What is alarming is that there are those that fabricate accusations of violence and nothing had happened. I personally know of stories such as these. I know of a woman that put an order of protection on a man she claimed she was terrified of and then after the order was issued...she would show up at his apartment and taunt him. The order of protection does not prohibit her from going to his home or calling him. But if he goes near her or call her...he is subject to up to six months of incarceration plus fines...regardless whether or not she initiated the contact. It is a double standard of which I as a woman deplore. I do not know what has happened in this situation but I always look upon these "cases" as suspect for sometimes in the quest for "equality" the scale tilts so far that equality is no where to be found and another kind of imbalance of justice takes place.

So true, my ex said that she was going to call the cops and say that i hit her. I left with the clothes on my back. She called me the next day, and said she was just joking. I never came back, and she was eventually evicted for failure to pay rent.

Women, you can't live with them and you can't kill them.

I blame marriage, if marriage licenses were made to expire people would be able to go their own way instead of trying to beat each other up after the love has gone.

That's a big red flag, a license that never expires. Licenses that people have to enable them to do things they like and want to keep always expire. Marriage licenses don't because they know nobody is going to want to renew theirs. Like a 2 year cell phone contract that locks you in, if they gave you great service they wouldn't have to worry about you walking. Marriage, you're locked in for life.
