SAN FRANCISCO — Sexual orientation can be fluid, but the vast majority of people have identities that are consistently heterosexual, gay or bisexual throughout most of their lives, a social psychologist testified Friday in a trial challenging California's gay marriage ban.

Lawyers for two same-sex couples suing to overturn the voter-enacted ban called University of California, Davis researcher Gregory Herek as their final expert witness to bolster their argument that sexual orientation cannot be easily changed.

The point is central to the plaintiffs' effort to show that gays deserve the same judicial protection as racial and ethnic minorities.

The trial, which ended its ninth day, is the first in a federal court to consider whether state bans on gay marriages are unconstitutional.

"Most heterosexual men and women, if they were asked the question and thought about it, would report similarly that they don't feel they made a choice to be heterosexual," Herek said.

The plaintiffs are expected to finish presenting evidence on Monday, with lawyers for Proposition 8 sponsors then beginning their case. Chief U.S. Judge Vaughn Walker, who is hearing the case without a jury, said he would delay closing arguments for two weeks after the defense rests so he can review the testimony.

On Friday, Herek said he recently conducted a survey asking people if they decided to be gay, lesbian or bisexual. Eighty-eight percent of the gay men who responded said they had no choice at all about their sexual orientation. The figure was 68 percent for lesbians.

Herek also said it's clear that gay men and lesbians are looked down upon and even regarded with disgust because of long-standing social stigmas.

"If two men were to walk down the street holding hands in many places, that would elicit a great deal of negative reaction, and that is an example of the stigma that everyone knows lesbians and gay men experience because they are gay," he said.

Proposition 8 was by definition an extension of embedded social stigmas, he contended.

Howard Nielson Jr., a lawyer for Proposition 8 sponsors, cross-examined Herek about whether sexual orientation is as fixed as Herek implied.

Nielson cited some of Herek's writings stating that some people who regularly engage in sex with people of the same gender do not necessarily identify as gay, while others may have same-sex attractions they never act on.

He also quoted the work of Sigmund Freud and pioneering sex researcher Alfred Kinsey to suggest that sexual orientation can and sometimes does change over a person's life.

Herek acknowledged that was true, but added: "Most people display consistency in their attractions and behaviors. We do see some examples where some people express attraction but do not have the sexual behavior."

Nielson also drew on pretrial testimony from plaintiff Sandy Stier, who is seeking the right to marry her female partner of 10 years. Stier said she had been married to a man for 12 years before she fell in love with a woman.

Nielson read from a transcript in which Stier said she had not always been interested in women and at one time was physically attracted to her ex-husband.

"At that point in her life, Miss Stier would not have been gay, correct?" Nielson asked.

Herek said many men and women who identify as gay have had opposite-sex partners.

Under Nielson's questioning, Herek readily acknowledged that scientists do not know if people are born gay or straight, become that way as a result of their early experiences, or some combination of circumstances.

There is absolutely no empirical evidence whatsoever to support the "notion" that Gays are more likely to be pedophiles.

This is a scare tactic used by those who oppose giving "Gays" any rights whatsoever.

My 3 closest friends have all been in the same monogamous, and faithful, homosexual relationship since either college or even high school. They are in their 40s and 50s now. They clearly have the moral high ground versus the average, cheating, divorced and remarried, so called Christian, heterosexual in this country today.

Apparently, the heteros really believe that children brought up by heterosexual, divorced parents are really better off than children adopted from infancy by a stable homosexual couple. This is because the heteros are misled by an Old Testament that was written when procreation was most important for a culture to survive due to the high mortality and short life expectancy of their time. And because of the propaganda from the Christian church based more on the hate and violence of the Old Testament than on the unconditional Love of Jesus' teachings in the Gospels of the New Testament.

Clearly, the majority of the heteros are the real sinners and hypocrites.

These claims about pedo_phillia are complete and utter nonsense and the product of a s!ck and twisted mind.

I'm realistic in believing this f!ght for equality is one that we can win. But not with the votes of the populace; Our victory lies with the courts.
The rights of the minority are not dependent upon the vote of the majority.

I feel fortunate that we'll someday witness an end to the dis_crimination, ha_te crimes and outright scorn of gay Americans. My only regrets are that it took so damn long and all those who've come before us and the pain they endured. What their lives, what my life, would have been like if only we'd been given the chance.

Time will judge those who h@te us to be on the wrong side of history.

We do share a responsibility to make what's wrong right and leave the world and better place for those who will come after us.

Somewhere in America tonight a young man will cry himself to sleep, afraid that his deep dark secret will be found out. He will feel isolated and alone, unable to express the feelings he cannot yet understand. He's afraid his friends and family will abandon him or that he will be harassed, beaten up or mur_dered if his secret is revealed. He'll cry and ask God what is wrong with him and he'll think about sui_cide.

I know this because I was once that young man.

Perhaps in your lifetime or my sons, but I don't foresee it in mine, that "gay" isn't considered a dirty word or the person a freak.

All of these are words that are used to instill fear and loathing in a very uninformed and uninquisitive population. Far too many people are content to watch TV, listen to the radio or blindly follow someone talking loud enough rather than do any actual research. Too many people are willing to allow their own personal prejudices get in the way of reality. Many people preach the bible, label themselves christian and swear they are bigots because god said it was okay and yet they have no idea what "Christian" actually means. No cameras in the courtroom because too many people would get to see just how utterly ignorant these arguments truly are, not because there are bands of drag queens, leathermen and dykes on bikes waiting to assassinate anyone.

America - land of freedom, liberty and opportunity............unless, of course, you're gay in which case get in the other line.

It's a long, difficult road but it will be well worth the journey one day.

It is so obvious why people 'choose' to turn gay. Life gets so much easier after the change.
Churches open their doors to you.
Better jobs become available.
You have your choice of establishments to have a drink.
You can join the military and expect rapid advancement.
And of course no matter where you live your neighbors will accept you without question.

Heck, I wish I was gay.

I recommend this APA article http://individual.utoronto.ca/james_cantor/blog1.html for those interested in research of the question at hand. The article concludes that there is no correlation between homosexuality and pedophilia.

I find the article unconvincing for the same reason as I have found other articles unconvincing. The author engages, almost admittedly, in intellectual gymnastics to reach a conclusion opposite of that suggested by the raw data.

And yet you haven't pointed to a specific instance of this alleged "hair splitting" or "intellectual gymnastics."

Either the data points to a correlation between child sexual abuse and homosexuality, or it doesn't.

There's no grey area here.

If you have a compelling argument to raise, or some other credible studies to cite, then let's see them.

I'm not convinced you're at all qualified to be making these remarks in the first place. Do you have a background in science? Psychology, perhaps?

From the article linked above: "when the proportion of male child victims exceeds the proportion of gay men in the population, some people conclude that gay men are responsible for a disproportionate number of cases of pedophilia."

That is the obvious and straightforward conclusion to the data.

Much of the rest of the article is an attempt to avoid the clear conclusion with the kind of stupidity that can only be believed by people who have educated themselves right out of common sense.

To wit: "Scientifically informed discussion of the relationship between homosexuality and pedophilia requires (1) careful use of specific terminology and (2) an understanding of the basic structure and etiology of human sexuality."
.
And thus the intellectual gymnastics and linguistic parsing begins. Ooh, "scientifically informed discussion". In other words, "if you don't agree with me you're just too stupid to understand." Yeah, great argument. NOT.

It is obvious that you lack the training to read and interpret scientific analysis. Raw data is just that, raw. it requires analysis (usually statistical as in this case) to draw relevant conclusions. All of the best minds engaged in psychological research at this time agree that the data shows no correlation between homosexuality and chid abuse. It is nothing more than pure intellectual egotism on your part to believe that your non-scietinfic interpretation of the data is correct and all the other analysis by trained professionals is wrong.

It is a common problem today that people with little or no advanced degrees feel that they are qualified to dispute the findings PhD's and other research professionals who have spent the better part of their life studying the issues. Popular consensus does not make for scientific fact.

That's interesting, the article formerly had a long report of the back and forth between a prop 8 proponent named Tam and how he lied on the witness stand and believed internet information about most pedophiles being gay. It is no longer there.
