Joe Arpaio's Sheriff's Office Faces Possible Sanctions For Destroying Racial Profiling Records

PHOENIX — A federal judge will decide whether to impose sanctions against the Maricopa County Sheriff's Office for its acknowledged destruction of police records in a lawsuit that accuses deputies of racially profiling countless Hispanics in immigration sweeps.

U.S. District Judge Murray Snow heard arguments Thursday over whether the law enforcement agency should be punished for throwing away and shredding officers' records of traffic stops and for not handing over all its e-mails about the sweeps.

Since early 2008, Maricopa County Sheriff Joe Arpaio has run 13 immigration and crimes sweeps consisting of deputies and posse volunteers who flood an area of a city – in some cases heavily Latino areas – to seek out traffic violators and arrest other violators.

The lawsuit alleged that officers based some traffic stops on the race of Hispanics who were in vehicles, had no probable cause to pull them over and made the stops so they could inquire about their immigration status.

Arpaio is known for tough jail policies, including housing inmates in tents in the desert, and pushing the bounds for how local law enforcement agencies can confront illegal immigration.

He has repeatedly denied the racial profiling allegations, saying people pulled over in the sweeps were approached because deputies had probable cause to believe they had committed crimes and that it was only afterward that deputies found many of them were illegal immigrants.

Peter Kozinets, an attorney for the handful of Latinos who filed the lawsuit, said the traffic-stop records would have helped show that the agency used the stops to racially profile Latinos and that the e-mails would have provided details of how the immigration patrols were planned and carried out.

Kozinets asked the judge to draw an unspecified "adverse inference" about the actions of the sheriff's office, that depositions be reopened for sheriff's officials who have already given testimony and that the agency pay for the costs associated with reopening depositions and litigating the records dispute.

Timothy Casey, an attorney representing the sheriff's office, rejected that argument.

"My clients acted in good faith," he said.

Casey said the traffic-stop records were discarded, but that it was an honest error and that the sheriff's office has handed over some e-mails about the sweeps. An unknown number of other e-mails were deleted, and the agency has been unable to recover those written before October 2009.

After the racial profiling allegations were raised in the lawsuit, Kozinets said the sheriff's office destroyed "stat sheets." Those are documents that officers completed during the sweeps to record the number of contacts with the public, criminal arrests and civil citations, and provide a short narrative section where officers can briefly summarize arrests or other incidents.

Manuel Joseph Madrid, a supervisor of the sheriff's human smuggling squad that led the sweeps, said in a deposition that he threw away and shredded stat sheets after he tabulated totals and that he was never told to preserve them.

Through an unintentional mistake, a top official in the sheriff's office didn't send the request to keep documents to others within the office, Casey said.

The judge said he would first rule on the sanctions request on the traffic-stop records and would later rule on the request about the e-mails after the sheriff's office turns over some e-mails that have been recovered.

Yes, it's our problem. However, he sends his "posse" out to the old people to tell them what will happen when some commie leftist sheriff gets elected and makes them fear for their safety. Which is funny, because the only time you see his posse 'round about those parts is -- election time. They are responsible for more people getting away with crime due to their lack of responsiveness. So the elderly, who are not the least bit interested in anything else, come out in droves to vote that showboating, malicious racist back into office. The only good news is that his and his people "above the law" attitude has gotten federal notice and his worship numbers are dropping.

Hmmm...had it not been for America's "naked aggression" against Mexico in 1848, Arizona would be part of Mexico. Kinda funny, how hypocritical America is. When Iraq invaded Kuwait in 1990, President George Bush 41 emphatically declared, "America will not tolerate naked aggression!" Oh, really? Umm...since when? Since America stole every square inch of land from the Mexicans and Indians that they could possibly get away with?

Learn a bit of history, will ya? And believe me, it ain't pretty.

My previous reply was not intended for your post, but to reality who posted previous about Mexico trying to sue to enter the United States etc.

Your post is correct but those who are unable to recall history will believe that what Sheriff Arpio is conducting is based on immigration reforms as they see it.

Arpaio's a mentally-challenged creep whose fun-in-the-sun is about over. However much the racists want to support him, the Constitution is much bigger than all of them. Boot him out of office, and even all the way back to Italy, where his people came from. We don't need "his kind" here to muck things up for real Americans.

I am a dark-skinned Native American who has dealt with racial profiling. While working for a company in Pensacola, they regularly sent us through Alabama in a work van (a converted Ryder van). Twice on the same day, we were pulled over on the interstate for no reason whatsoever (other than for DWNA -- Driving While Native American). Even though my crew had no drugs, guns, etc., the state troopers searched us, then searched the van (pulling everything out, going through our suitcases and clothes, and, failing to find anything, called dog teams in to search everything). This happened twice on the same day, mind you, in two different Alabama counties. Needless to say, my co-workers resented my presence, since those stops (taking hours of our time) had cost the company hundreds of dollars in lost time, not to mention the embarrassment.

Here's my point: Racism and illegal racial profiling occur all across this racist country. Arpaio just gets more publicity than others.

What do you think it'll take to stop all the organized crime along the border, and on the reservations? Do they need to build more prisons, more police, bigger bullets, more citizen involvement, more surveillance cameras, more drug dogs, more concrete barriers? Should the Tribes be running their own prison system, dealing with problems directly among tribal members? Should Mexico finally re-occupy all their northern cities, and re-establish lawful government, there? Should we just close border crossings?

There was a Sheriff a few years back who also involved in alleged racial profiling in Volusia County Fl. he is no longer in office but the process goes on and on all under the guise of law and order.

By the way the name Arpaio sounds a bit foreign and non anglosaxon to me. Why don't we do some ivestigation on the sheriff? Did his forefathers come to the US illegally from Italy or something? Let's deport him , you know, you can never be too sure....

Arpaio's grandparents immigrated from Italy, allegedly "legally." If they indeed entered America legally, then it was because of America's historically racist immigration policy, which was slanted toward granting legal status to almost any European who wanted to come here (while denying that same right to almost all non-Europeans). Such a flawed immigration policy has warped the minds of people like Arpaio. They seem to think that because their own people were so readily granted legal immigration status in America, then they must be the "all-Americans," while those who were not so readily granted legal immigration status (non-whites) are less-than-desirable people who need to be harassed, put in their places, and even run out of the country.

Ironically, this Italian-descended character "Arpaio" (whose ancestors have been here for all of two generations) loves nothing better than to harass Mexicans/ Mexican Americans, whose own ancestors have been on this continent for millennia. The Mexicans' Native American ancestors were migrating across this land when Arpaio's people were squashing grapes with their feet somewhere in Italy. Now, all of a sudden, Arpaio thinks that he's the "Immigration God" whose purpose is to cleanse the American landscape of these swarthy, dark-skinned, dusky people.

What - a - crock. I say, hang him by his meatballs and send him back to Italy, where he belongs.

Your interesting comment brings to mind the irony and hypocrisy of immigration.Case in point, Mr. Arpaio's "native " land , Italy has recently been in the spotlight lately. A small town in Italy, Rosarno, recently chased out African seasonal immigrants.

What is interesting is that for a long time, Italy was known for the large amounts of immigrants it sent abroad seeking work and a better life. Now they have the superior hand and treat others like cr$p especially the non whites.

Whenever we talk about immigration, there is always alot of blabbing but no one will acknowledge what we all know is true. Non whites will always be unwelcome, while Europeans will "assisimilate. Case in point, France's current president, whose ancestors are Hungarian, there is no question whether he is French and can be the president. However, whenever there is talk of a non white candidate there is the question of whether this person really shares the "national identity/ identité nationale"

Or president Obama who is questioned on his citizenship, but never Mccain who was born in Panama.

our system of government gives the power to the County Sheriff to either ignore or enforce Federal law. The President of the United States cannot tell the County Sheriff what to do in his own county.

From 2004 through November 2007, Arpaio was the target of 2,150 lawsuits in U.S. District Court and hundreds more in Maricopa County courts, with more than $50 million in claims being filed, 50 times as many prison-conditions lawsuits as the New York City, Los Angeles, Chicago, and Houston jail systems combined. Allegations of cruel treatment of inmates as well as living conditions have been cited by Amnesty International in a report issued on the treatment of inmates in Maricopa County facilities.

In her book on prison policy The Use of Force by Detention Officers, Arizona State University criminal justice professor Marie L. Griffin reported on a 1998 study commissioned by Arpaio to examine recidivism rates based on conditions of confinement. Comparing recidivism rates under Arpaio to those under his predecessor, the study found "there was no significant difference in recidivism observed between those offenders released in 1989-1990 and those released in 1994-1995."

Apparently you're completely ignorant of the fact that crimes against Hispanics have increased dramatically since the commencement of Arpaio's raids, since even legal people with brown skin are now scared to report crimes to the police; you're also oblivious to the fact that the Maricopa County Sheriff's Office has hundreds of felony warrants which have remained unexecuted for months because resources and personnel have been assigned to immigration raids, rather than the arrest of real criminals.
