TMZ has obtained legal docs in Jesse's divorce from Janine Lindemulder. James filed several declarations, accusing Janine of various acts of brutality -- including punching him, bludgeoning him in the back of the head with a flowerpot, swinging a steel bone sculpture at him, trying to run him over with her car, socking him in the eyeball because he used her parking space, and going Naomi Campbell on him with a cellphone.

This woman is living in a half way house how can she even think about seeking custody of a 6 yr old child--didn't know you could move the kids in while doing time??? I don't care if jj cheated on sb that is not the issue. the issue is who can provide a more stable home--right now it appears to be jj with or without sb.

That is a very dangerous assumption. Beatings are not earned. We can not assume that he was ever physically aggressive, just because she was. Further, they are both abusing the children by allowing that behavior to continue in the home. Growing up with domestic violence is a shattering experience. It does not matter who the aggressor is or who the victim is, the whole family suffers. No one deserves to be abused and your comment is the same sort of logic that allowed this issue to thrive.

These were accusations Jessie apparently made during his divorce but his wife still got custody of their child so the court must not have thought too much of it so whose to say he was telling the truth then or now, he’s a proven liar.

Anyway, no doubt these accusations are now being used as a smear campaign against his ex-wife who is in a fight to keep her parental rights against millionaires while she currently has no means of support. How is taking the parental rights of the mother away so Sandra can adopt the child against the mother’s will in the child’s interest? While everyone is shedding a tear for Sandra, I’ve thought she’s been really cruel to this woman who was never accused of harming her child but being an “ex” drug users and an “ex” porn worker. Porn people are raising their children every day of the week it’s not a crime to be a porn worker.

Hopefully millions of dollars can’t buy everything including someone else’s kid. Both Jessie and Sandra have behaved selfishly and Jessie is a massive hypocrite so perhaps now they are beginning to reap some of what they've sown.

Child custody is strongly favored towards biological parental custody - especially in today's financially overburdened courts. If Janine Lindemulder was unable to keep custody, most likely there was good cause.

My retired mother acts as a Child Advocate in the courts. Children cannot testify on their own behalf in parental rights cases, so adults that are specially trained as advocates interview the children, observe their home environment (whether that be with their birth parents or other guardians), interview their teachers and guidance counselors, review psychological documentation on the children and the various attached guardians, send their findings to a committee for review...and THEN act as the voice for the child in the courts making a request for their proper care. They act in complete and total favor for the child - not any of the child's guardians.

It is extremely expensive to run the foster care system, and in Palm Beach county (where my mother acts as an advocate), it has only gotten more expensive because they've contracted out the group home care to private companies. The number of children in the county that are being monitored numbers in the thousands.

Whereas once the motivation of the courts used to be in solid favor of getting the child into the healthiest environment possible - whether that be with foster parents or a group home or indeed the biological parents - the motivation now has an economic bent, which pushes, often prematurely, for the reunification of the child with the biological parent. It is the least expensive of all the available options. This can come as soon as the parent passes one clean drug panel, a mere 3 months after the last panel that had negative results. Three months!

As you can guess, my mother has decided to only continue on the cases that she's already been assigned, but will not take on any more, as all of her work is for naught. She currently just saw a case turn over three young boys back to their biological mother - boys who did not want to go back with her, and would have rather stayed with their grandparents (who were receiving additional foster parent income for their care).
