Nebraska Abortion Law: Mental, Physical Screening Required For Women And No Abortion After 20 Weeks

LINCOLN, Neb. — Nebraska could become the first state to require doctors to screen women for possible mental and physical problems before performing abortions under a bill that received final approval from the nonpartisan Legislature on Monday.

Republican Gov. Dave Heineman's office said Monday he will sign the bill Tuesday, along with another groundbreaking abortion measure lawmakers are expected to pass then. That bill would ban abortions after 20 weeks based on the assertion that fetuses feel pain.

Both bills are likely to be challenged in court. Abortion rights activists describe the measure passed Monday as a drastic shift in abortion policy that would block abortions by scaring doctors who might perform them. They say the second bill is aimed at blocking late-term abortions in one of the few states where there's a doctor willing to perform them.

Abortion foes defend both bills. They say the one passed Monday could help prevent post-abortion medical problems and brings pre-abortion screenings in line with what is done before other types of medical procedures.

The bill requires a doctor or other health professional to screen women to determine whether they were pressured into having abortions. Doctors also must assess whether women have risk factors that could lead to mental or physical problems after an abortion.

The bill is unusual, however, in spelling out what doctors must look for. They include any risk factors cited in peer-reviewed journals indexed by two major medical and scientific listing services during the year before a planned abortion. The risks could be "physical, psychological, emotional, demographic, or situational," according to the bill.

"It's very difficult to know for certain if you're complying with this bill," said Kyle Carlson, an attorney for Planned Parenthood of the Heartland. "There's an undetermined amount of documentation you have to go through to know all the...risk factors."

Also, the information could change daily as articles in peer-reviewed journals are released.

The lawmaker who introduced the bill, Sen. Cap Dierks of Ewing, has said the reviews are manageable because there have only been a couple hundred published studies on the topic over the last decade or so.

Abortion opponents also say the requirement is important because otherwise doctors would follow accepted medical standards – which are likely to be set by fellow abortion providers.

"We're dealing with destruction of early, unborn life, so we ought to take extra care," said Greg Schleppenbach of the National Catholic Conference.

Doctors would have to tell patients whether they had any of the risk factors cited in the journals, but they could perform abortions even if risk factors existed.

If a screening was not done, a woman could file a civil suit. Doctors would not face criminal charges, nor would they lose their medical licenses.

Abortion opponents acknowledge that it could reduce the number of abortions in the state, which numbered 2,551 last year.

Planned Parenthood of Heartland will "figure out a way to make this work" and continue providing abortions, spokeswoman Julie Stauch said. But doctors at some hospitals might stop, she said.

Women already undergo an extensive screening for medical problems that might be complicated by an abortion and the procedure isn't performed if the risks are too great, Planned Parenthood officials said. With the new requirements, women could be overwhelmed by a flood of possibly irrelevant information, Stauch said.

She likened it to being handed an enormous list of options by a doctor after being told you might have cancer.

"Does it make your decision easier or harder? And does it make it harder for valid reasons?" she said.

Whoa! Am I seeing this right?

They want an MD to do a psychological evaluation (why not a psychiatrist?) and if a woman is deemed unfit to make the decision to have an abortion they will make her have the baby? If she's unfit to decide on an abortion, is she fit to be a parent? Am I the only one who thinks this is crazy?

I also have a question about the "fetus feels pain" argument. The same people who think that's important are the exact same people who encourage life-saving surgeries for severely pre-mature babies. It is my understanding that those surgeries are done without anesthetic. Do they believe that the babies don't feel pain? So it's wrong to cause a few seconds of pain to an un-wanted fetus, but you can torture a preemie for weeks and months and that's alright? Seems like a pretty strange place to draw a line.

The number of abortion clinics in America is declining at an alarming rate. When they are gone, it won't matter whether abortion is legal or not. Why does freedom of speech protect emotional and verbal assault? People are advertising their intent online to kill abortion doctors. Pro-lifers make getting to an abortion clinic akin to walking a gauntlet. When are we going to make that kind of harrassment and stalking illegal?

I so feel sorry for the women in Nebraska who are being hemmed in by the religious fanatics on what they can or cannot do w/ their bodies.

Mmm... aren't those religious/conservative people SO adamant of having GOVERNMENT in general out of the PEOPLES' lives? IF that is the case WHY are they FORCING govt laws onto women & what they can do w/ their bodies?

Until those religious/conservative fanatics lift a finger to help those children ALREADY in the US Foster care system, please stop your hypocritical opinion of preventing Women from choosing abortion...

Sarcasm that is really far out there! If we were to assume that before this law, women couldn't vote, couldn't go anywhere without a male escort, were forbidden to choose whom they would marry, be stoned for fornication, and had to wear a Scarlet Letter if they got pregnant prior to marriage, like Jesus' mom . . . then this law is progress. But I've been in Nebraska, and I didn't see any evidence of Sharia, or Old Testament law in Omaha, but then I wasn't looking for it.

The best solution is for pro-choice women to leave states which deny choice. Nebraska only has room for fundamentalist women. Let them alone. It would be a good idea for Nebraska high schools to let their students know that they should leave the state after high school if they're not fundamentalist. It's not like Nebraska has anything to offer women with post-secondary educations anyway.

Not so easy if you have a job and other children to support. Besides, running away doesn't help; the terrorists just apread their hateful beliefs more with one less person to confront them. We, of course can't shoot them at their church, so we just have to support enlightened, and people who like women and consider them to be equals, to replace the Scarlet Letter carriers in the Nebraska Congress. Gee, it's time for bed, or time for me to quit teaching English, when I see the SYNTAX of the previous sentence! There's a tax on everything, isn't there?

At some point, you need to consider the welfare of your family.

I brought my family to Canada 5 years ago and have not looked back. We're safe and happy in a tolerant society, with public health care and constitutional equality for women!

My poor mom wants us to move back to middle America and I just say "Well, get them to change everything I and will. Let me know when they ratify that ERA, will you? "

States like Nebraska deserve a massive brain drain. When their fundamentalist utopia collapses, you can always go back if you want.

I have been pregnant twice and each time it was my choice whether or not those children were born. Preach all you want but you will not be the person raising and supporting the child, therefore, you have nothing to say about whether or not IT is born.

I do not believe in abortion but I do believe in women's rights and that includes the the right to choose. I have a daughter and 4 granddaughters, I'm tired of of us being told that because we are female we are second class citizens. This law just reinforces the fact that even in 2010 we women are still viewed as nothing more then wombs and v*ginas.

Btw, I live in NE and would move in a heartbeat if I could.

Not only do these folks wnat to return to the dark ages for women, they're against all types of birth control, too, because it's not the "innocent" life they really care about (obviously they don't give a hoot once it's born) - it's the fact that someone had sex!!

Or, better yet, for all the women the decide must carry to term, then each sperm contributor must pay 60% of her costs, if she can work and 100% if she can't. This includes everything, food, (she's eating for two), housing, doctor bills, transportation... EVERYTHING.

And if woman finds at the moment of birth that she wants to be a mother, and decides to keep this child which she's has likely bonded with, then the sperm donor, cum father is responsible for 100% of costs until the child is 2.

Since it's most often the case that the baby was made outside the context of an intimate relationship, and even if it is (one assume those seeking abortion have not planned to be a parent at the moment) both parents are required to take parenting classes for each stage of development

The father is responsible for 50% of the child's expenses, after year 2

Exception: If the child is born with a birth defect/disability or s/he shows to have genetic disease with onset of symptoms prior to the age of maturity, 100% of costs are the father's responsibility--as the mother will have to stay home to give this special needs child every advantage to a live an autonomous life.

Seems to me the only way to fairly legislate women to carrying to term is to make equal legislation to make the father responsible for his part in the birth of an unplanned for child.

I am for sex education in school. Put it out there bluntly! Babies are cute, loveable, etc. but they are also a huge responsibility. Prevention would be best. Population control needs to happen. Mother Earth cannot possibly feed us all and keep away with the GMO Food!
