Elena Kagan 'Gay' Whisper Campaign Enrages Rights Groups

Leading gay rights group are accusing Republicans of trying to rile up their conservative base by launching a whisper campaign against potential Supreme Court Justice Elena Kagan -- suggesting the current Solicitor General is a closeted lesbian even though she's not.

In its first entree into the upcoming Supreme Court nomination process, the group Human Rights Campaign blasted the increasingly public discussion of Kagan's sexuality, calling it a play "straight out the right-wing playbook."

"Even though the majority of Americans couldn't care less about a nominee's sexual orientation, the far right will continue to be shameless with their whisper campaigns to drum up their base and raise money off of prejudice," Michael Cole, a spokesperson for the group emailed, in a statement to the Huffington Post

In a separate interview, Jean-Marie Navetta, spokeswoman from PFLAG -- Parents, Families & Friends of Lesbians and Gays -- accused people of trying to manufacture scandal out of thin air.

"People love taking part in rumors like this, whether they're gay or not, because it implies that there's some sort of scandal going on there. And the bottom line is, it doesn't matter and it shouldn't matter," she said. "But we hear it all the time... it's a gossip point for people. And I think it could certainly be used, or be perceived to be used by some as a way to discredit [Kagan], even though we all know that it does not matter and it should not matter."

The comments come a day after CBS published a blog by Ben Domenech, a former Bush administration aide and Republican Senate staffer, in which he asserted that choosing Kagan would help Obama "please" much of his base, because she would be the "first openly gay justice." The White House reacted strongly to the assertion, relaying that Kagan is, in fact, straight. It was the first public pushback by the administration in defense of any potential Supreme Court nominee.

Even before the CBS post, a top conservative religious group was already insisting that a nominee's sexuality would play a major role in his or her confirmation process. This past week, the organization Focus on the Family abruptly reversed its position from the last Supreme Court confirmation battle by declaring it would oppose a gay Supreme Court pick, no matter who the nominee is.

"We can assure you that we recognize that homosexual behavior is a sin and does not reflect God's created intent and desire for humanity," said Tom Minnery, the group's senior vice president. "Further, we at Focus do affirm that character and moral rectitude should be key considerations in appointing members of the judiciary, especially in the case of the highest court in the land. Sexual behavior -- be it heterosexual or homosexual -- certainly lies at the heart of personal morality."

The fact that the rumor campaign surrounding Kagan has been settled doesn't necessarily mean that the issue is off the table, Republicans still seem poised to make gay rights a prominent feature of the confirmation process -- should she be chosen as Justice John Paul Stevens' replacement. Already conservative websites are latching on to a brief signed by Kagan and 40 Harvard Law School professors in which they argued that the military's "Don't Ask Don't Tell" policy was discriminatory against gay troops.

"Let's just say that if somebody is gay, it clearly becomes political fodder," said Navetta, when asked if the effort could damage Kagan's chances for the court or confirmation. "And I'm not implying one way or the other that she is or is not [gay]. I'm just saying that its no myth that people's sexual orientation can and does become an issue in political campaigns. We've seen it before."

My gaydar goes off when I see her pics. But who knows? Who has a right to know? It would be more positive if she were lesbian and the admin made it clear that they didn't resort to homophobia in selection of a judge. Sure the right will be their normal hateful selves, but they are also the racists who claim Obama is not a "naturally born citizen." Yet here the administration "leaps to her defence" proclaiming she is strait, not that horrible thing "lesbian." Among Arizona's lesbian community is convinced that Janet Napolotano is a lesbian but she is proclaimed straight in order to get her appointment approved.
Not much courage in this administration.

What I find much more offensive is that NINE people make laws for over 300 MILLION and they sit for life on the court. There should never be that kind of power in 9 individuals and they should never sit for life...........There should be terms. What is pathetic is to see someone like Douglas rolled into court everyday, catatonic. His aides did all his work. That is so wrong in so many ways, yet I didn't hear any complaints from anyone. It may have been fine in the days when our nation consisted of a much smaller population but not anymore.
Both of those items, in my opinion, take precedence over her sexual orientation.

Republicans are getting really old to listen to. WHO CARES IF SHE IS GAY OR NOT. Get with the times. This is not the stone age. Republicans sound so unintelligent. with their close-minded antics that continuously circle our media and our laws.

Why is geography and regional representation never brought up in the Supreme Court nomination process?

The western US is known for being more libertarian politically, yet this is not represented on the court.

Of the nine current Justices only two were born west of the Mississippi and none of them went to law school out west. Is the curriculum and instruction at all western US law schools inferior to institutions in the East? or just the connections?

The Midwest has two Justices and one is retiring and it looks like his replacement will be someone from New York city who went to Harvard.

Also, why are there no Americans of asian descent on the Supreme Court? Has one ever been nominated? and why is there only one protestant christian one the court in a country where protestants are the majority faith?

In the new testament it is revealed that all men are so far from being able to maintain the moral code of the OT. And so man has no right to carry out OT type punishments on his fellow man.

Our civil and criminal laws are based on defending individuals from other individuals.

Alot of the intra personal/moral/immoral laws mentioned in the OT have been left out of the civil/ctiminal law because of the obvious universal flawed state of man in that area and the influence of the NT in softening the hars punisments in the OT.

At some point along the way these self inflicted sins between individuals and themselves became outside of the secular civil/criminal law. Frowned upon as weird/strange/abnormal/unnatural/unxlean/detestable/an abomination, but not crimes under the civil/criminal law.

Both Alito and Scalia have always had the hots for Thomas. It's well known in judicial circles and among most Ivy League law students that they're both dying to be dominated by a strong black Republican. They often imagine him sans robe. It's true.

Common sense is out the window. Good is called bad and bad is called good. Perversion is defended and cleanliness is ridiculed.

Celebit preists should be optional because it's just doesn't make sense, and we see the results of the celebit policy.

All of our politicians are corrupt and they hide behind their pro-perversion policies like they are some great heroes.

The only reason why we're all still here is the small amount of srtrong willed plains/forest/mountain/river/lake/ocean men who have got a clue about common sense/right and wrong/the bold origins of this once great nation.

And because of the multitude of defiled nations that we so stupidly have anything to do with, that in comparison to us still make us have some value as a cleaner type nation than theirs are. But we are such unbelevable hypocrates, self-destrucyive behaviors, dumbed down with nosense value systems, a complete mess, but an imbalanced/out-of-whack-misapplied-hit-or-miss-unstudied-Christian type-forgiveness haphazardly applied social/legal policy.

A real mess.

These 3 passages show that most modern Christians have been highly misled, decieved, and lied to.

We are still supposed to follow the OT as our users/owners/guide/shop manual/rule-law guide book.

The NT just helps us to interact with it better and to achieve much better results from both.

The harsh punishments listed in the OT were designed to keep the race clean and pure. Worthy of the level at which they were designed for. It's not about being harsh because of lack of sympathy.

It was about reality. Impure abhorrent behavior defiled a person and lingered on so they had to be eliminated pronto so as not to comtaminate, ruin, and destroy the potentially blessed, but highly infallible, easily corrupted and/or polluted race.

It's just the way it is. We were designed higher than but similar enough to animals that we had to follow a higher code that was written down or spoken.

To bring us to our proper higher role than the animals who we should not be mistreating by the way.

As we evolved we developed sympathy, not for the sin, but for the sinner, the person.

But over time we too have become corrupted by the pleas of the sinners, for us to accept their behavior so that they can be a part of normal society,

and so as not to make them feel so bad about who they are and what they do.

As you can see where our liberalism, non-adherence, and ignoring the OT law has led us to.

Let's start taxing these religous organizations that want to influence policy in this country and we would see how fast there moral outrage would suddenly come only from there pulpits and not their bank accounts. They are using tax free money to be political machines. Maybe they need to use it for what it was intended for, like helping the needy and feeding the hungry.

Your being able to get along with them shows that you are a very strong type. The type that would defend the innocent from a bully.

I also would never agree or go along with a prankster who said, hey lets do something to shake up that gay guy over there,

Ok, do you follow me?

But it does say in the bible that it's prohibited/proscribed behavior.

It is also common sense that it's weird, abnormal, unclean, and very unheathy.

I try to follow the bible as close as I can because I feel we must, or else, get it?

I also find that most of the bible does make common sense. It's is the user/owners/guide/shop manual/rule-law guide book for the human race.

Climb down from your soapbox. Nobody is listening. Try studying a grammar or spelling book instead of the Bible. It'll help when you post the next time. You might want to look up the constitution while you're at it. Feel free to pick and choose the parts of the Bible that you want to follow. Don't pick and choose what the rest of us should follow. We are a nation of laws not biblical commandments. As for your many long-winded posts, do you really think that anyone read them all. You are talking to yourself. There's medication for that (it'll help your religious ideation, too).
