Denny Chin Confirmed: Will Be Only Asian-American Judge Serving Full-Time On US Court Of Appeals

WASHINGTON (AP)— The Senate has voted 98-0 to confirm Judge Denny Chin to fill an opening on a New York-based appeals court. He will be the only Asian-American currently serving on a U.S. Court of Appeals.

Chin is a U.S. district judge in New York. He will serve on the 2nd Circuit, covering New York, Connecticut and Vermont.

There are 23 judicial nominations pending on the Senate calendar.

Japanese-American Judge Atsushi Wallace Tashima sits on the U.S. Court of Appeals for the Ninth Circuit, but because of his status as senior circuit judge, is in a state of semi-retirement.

Chin was the judge who presided over the Bernie Madoff case and handed him a 150 year prison sentence.

I knew of Judge Chin as an attorney in the early 1990's well representing an Plaintiff in a sexual discrimination suit, a secretary to the executive of our client, a well known oil company. Shortly after the trial and after an appeal in the 2nd Circuit he will most likely will be part of, he was appointed to the USDC - Southern Dist. of NY. At that time, he was only of a tiny few of Asian herritage to ever be appointed a Federal Judge. His many years in the critical SDNY, his involvement with a wide range of civil and criminal matters including ones of some media attention, will have prepared him well there. He joins with Circuit Judge Jose Cabranes, who I also worked on a case as a defendant corporation when he was early in his career as a USDJ in the Dist. of CT.

I don't care if every judge is a Polynesian hermaphrodite with one eye and bad breath.

As long as they are defenders of the constitution, and see that as their highest duty.

I could care less about any details after that.

I'm happy to see Denny Chin get confirmed to the Court of Appeals. I'm based in the Midwest but I had the occasion to appear before him a few years ago on behalf of one of the parties to a complex international lawsuit. I found Judge Chin to be well-prepared, extremely smart, and fastidiously fair. I don't say that because of the outcome (in fact, our side lost), but because of his judicial temperament and intellect. Judge Chin is also the guy who threw out Bill O'Reilly's defamation suit against Al Franken. (You can be sure that O'Reilly will trash Chin for that reason alone, probably without mentioning being excoriated by Judge Chin's opinion.) Denny Chin is young enough to be considered for the Supreme Court, and he is far better qualified than many of those currently serving. Not that that's saying much.... Congratulations and best wishes, Judge Chin!
