Wave Of Arizona Lawsuits Expected Over Immigration Law

PHOENIX — Politicians weighed in on Arizona's tough new immigration law Tuesday, while Mexico cautioned its citizens about an "adverse political atmosphere" in the state and a Phoenix man said he was aiming to get a referendum to repeal the measure on November's ballot.

In California, Meg Whitman, the Republican front-runner in the California gubernatorial primary, said that Arizona is taking the wrong approach to with its tough new law.

"I think there's just better ways to solve this problem," Whitman said in a telephone interview with The Associated Press.

But Sen. John McCain told CBS's "The Early Show" that his state needed such a law because the Obama administration has failed to "secure our borders." The Arizona Republican called the situation in his state "the worst I've ever seen," and that ineffective border enforcement has resulted in drugs pouring into the southwestern United States from Mexico.

In Mexico, the Foreign Relations Department urged Mexicans in Arizona to "act with prudence and respect the framework of local laws" and said that the law's passage shows "an adverse political atmosphere for migrant communities and for all Mexican visitors."

Meanwhile, Jon Garrido, who produces a Hispanic website and ran unsuccessfully last year for Phoenix City Council, said he's been flooded with inquiries and that he's optimistic about putting a referendum to repeal the law on Arizona's November ballot. Qualifying a referendum requires submission of at least 76,682 voter signatures within 90 days after the current legislative session.

Opposition to the law has grown since it was signed Friday by Republican Gov. Jan Brewer, with civil rights leaders and others demanded a boycott of the state.

Brewer has said Arizona must act because Washington has failed to stop the flow of illegal immigrants and drugs from Mexico. The state is the nation's busiest gateway for people slipping into the country.

The measure – set to take effect in late July or early August – would make it a crime under state law to be in the U.S. illegally. It directs state and local police to question people about their immigration status if there is reason to suspect they are illegal.

"If you look or sound foreign, you are going to be subjected to never-ending requests for police to confirm your identity and to confirm your citizenship," said Alessandra Soler Meetze, executive director of the American Civil Liberties Union of Arizona, which is exploring legal action.

Currently, many U.S. police departments do not ask about people's immigration status unless they have run afoul of the law in some other way. Many departments say stopping and questioning people will only discourage immigrants from cooperating to solve crimes.

Under the new Arizona law, immigrants unable to produce documents showing they are allowed to be in the U.S. could be arrested, jailed for up to six months and fined $2,500. That is a significant escalation of the typical federal punishment for being here illegally – deportation.

People arrested by Arizona police would be turned over to federal immigration officers. Opponents said the federal government could thwart the law by refusing to accept them.

Supporters of the law said it is necessary to protect Arizonans. The state is home to an estimated 460,000 illegal immigrants. Brewer has ordered state officials to develop a training course for officers to learn what constitutes reasonable suspicion that someone is in the U.S. illegally.

The crux of opponents' arguments is that only the federal government has the authority to regulate immigration.

"If every state had its own laws, we wouldn't be one country; we'd be 50 different countries," said Thomas Saenz, president and general counsel of the Mexican American Legal Defense and Educational Fund.

Oh....invite more of a culture that is antichoice and anti women's rights....

I can't wait.

Culture is something naivity here forgets....Mexico has a horrendous women's rights record because abuse of women is culturally ingrained.

Man, are you folks gonna get a big surprise.....the individuals you tout as hard working are also very conservative when it comes to women and pregnancy. They are also not too pro gay rights either....

Careful what you wish for when importing culture.

Jack was particularly unintelligent & you are particularly Un-American. I was under the false opinion we defeated your type of thinking in Germany 75 years ago. Obviously, we merely succeeded in bringing it to our shores.

The MAJORITY of TRUE AMERICANS honor & respect our Constitution. Imprisoning those who provide jobs to illegals is both Constitutional & effective. Racial profiling will not be effective & is patently Un-Constitutional. True Americans do not honor or follow Adolph.

Since conservatives are so in favor of this bill, I wonder, how will it be applied?

Let's say you are in Arizona and you have a room full of 100 people. Half are white, the other half hispanic. Half of those 100 are also illegal the other half legal.

How are you going to stop those illegal immigrants in the room? You can't ask everyone for id because if you do it without cause then you violated the 4th amendment and asking everyone would be a police state. What would give you cause to ask one person over asking another? You can't just ask the hispanic half because if you do you are not applying the law equally and racial profiling, which is violating the 14th amendment.

So how do you plan on stopping those you think are illegal? How will you apply the law that requires you to detain people who you suspect are illegal?

No problem, except for that upopular requirement that Probable Cause is required. 100 people sitting in a room does not in & of itself create any legitimate Probable Cause to believe a crime has been commtted.

This statement is what is wrong with politicians. The problem has been there long before Obama took office, yet it is Obama's fault. I wish McCain would take some responsibility. Republicans had control for 8 years, had they wanted to act they could have. This isn't a problem that arose over night, magically, when Obama took office.

The Mainstream media, the Washington Elite, liberals, and other out of touch people and groups are aghast that someone, anyone has the gall to actually enforce our immigration laws.

They were so sure that they had everyone lined up to roll over and play dead while they float another amnesty letting 20 million illegal immigrants and probably another 100 million of their relatives, through family reunification, into the US.

Sorry folks. The days of your being able to provide shelter to law breakers, using race as a justification to protect the law breakers, is ending. That is why so many of you are in a panic about the Arizona law.

No panic here...but you'll be in one when they have to raise your taxes to cover the cost of law enforcement training, hiring new officers, paying incarceration expenses and defending all the laws suits that are going to come out of this.

A voice of reason, information, and consideration. Thank-you for reminding all of us the true costs of some of the hate-legislation. If we could view the mass migration from Mexico as refugees seeking shelter instead of seeing it as home invasion, we could deal more effectively with the current problem. What Arizona does not realize is that there are other groups also seeking safety within our borders, and they are not "tan."

Twas Ronnie who granted amnesty. The error of amnesty now being displayed is that it creates an environment where the problem is not solved, merely encouraged to continue.

Want American for Americans? Imprison all those greedy crooks who hire illegals to make more money. Eliminate jobs & the illegals will leave. We will not needed border patrols, border fences, a police state, Un-Constitutional racial profiling & best of all the problem will actually be solved.

To implement this bill, Arizona needs to define what is "reasonably suspicious" individuals. Or simply they need to define what an illegal aliens look like.

Good luck on that one. Maybe ask the tea baggers to define what an illegal alien looks like.

One cannot legally define an illegal standard. The standard is Probable Cause. That is a REQUIREMENT pursuant to the US Constitution & states are not free to ignore it.

If the state of Arizona tried to in force this law with out the help of the Fed they would be in a quagmire; The State has no authority to deport anyone; only the Feds have that authority.
Arizona could not release them because they would be releasing them in the same status as
when they were arrested undocumented residences. We would end up with another Guantanamo.

Will the state allow law enforcement officials to become "witnesses for the prosecution"? This law was passed over the objections of most. Finger-pointing doesn't solve who's to blame for Arizona being the main portal for illegals; passing a law that only compounds problems is counter-productive. Traffic won't be slowed because the GOP disowned "amnesty" along with the part of their god Reagan that produced it.

We are not going to be deporting. These individuals will be turned over to ICE. We already have ICE detention centers here....they've been here for years...previously INS detention centers.

Who introduced the bill that became this law? Sen. Pearce, the fellow that hangs around with neo-nazi's and thinks the Jewish Holocaust was a fairy tale. Who wrote it? Kris Bobach, a self admitted "birther" that is a lawyer for the Immigration Reform Law Institute...THEY are the legal "arm" of FAIR, the Federation for American Immigration Reform...Who funded FAIR it's first 9 years of existance? The "Pioneer Fund" which for 70 years funded studies and programs designed to prove the intellectual superiority of whites. More recently, how does FAIR fund itself? It SUES government agencies that do not enforce immigration laws...who sues them on behalf of FAIR? The IRLI, for which Koback who wrote the bill, is a lawyer for...and neatly tucked in Sec. 8 of the bill is a provision that allows ANYONE to sue local governments for NOT enforcing the new law, and collect the cost of bringing the suit as attorney fees as part of it.
