Schwarzenegger Smoking Ban Veto

SACRAMENTO, Calif. — Advocates of a bill that would have banned smoking at all California state parks and beaches say they're disappointed in Gov. Arnold Schwarzenegger's decision to veto the measure.

"We're very dismayed to see the governor has not prioritized clean and healthy beaches, especially since our coast lines are a driving force to our California economy," said Angela Howe, an attorney for the nonprofit Surfrider Foundation, a San Clemente-based environmental organization.

The foundation had hoped Schwarzenegger would follow a 2008 recommendation by the California Ocean Protection Council to ban smoking at all state beaches to help reduce polluting marine debris.

But the cigar-smoking Schwarzenegger vetoed legislation that would have done that Monday, saying the bill crossed the line of government intrusion.

In a letter to California senators, the governor said state parks and local governments were already permitted to ban smoking on a case-by-case basis.

"There is something inherently uncomfortable about the idea of the state encroaching in such a broad manner on the people of California," Schwarzenegger wrote.

Many of those legislators previously have been invited into the governor's smoking tent at the Capitol.

The bill's author, Sen. Jenny Oropeza, D-Long Beach, had argued that the measure would help reduce litter, along with the threat of wildfires and second-hand smoke. She crafted the legislation so smokers would be allowed to light up in parking lots and at campsites in parks.

"I'm sorry the governor did not agree with this widely supported effort to increase public awareness about the environmental threats carelessly tossed cigarettes are doing to our marine life and to the great outdoors," Oropeza said in a statement.

Hundreds of communities nationwide have enacted smoking bans at municipal parks and beaches. Maine is the only state to ban smoking at its state beaches. But anti-smoking groups say no state has banned smoking throughout its entire park system.

The bill was supported by environmental groups that organize beach cleanup days throughout the U.S., where cigarettes are the No. 1 item collected by volunteers.

At least one tobacco company, Commonwealth Brands, had publicly opposed the ban, arguing it would infringe on smokers' rights.

Schwarzenegger told lawmakers the best way to discourage people from leaving cigarette butts at beaches and parks is to increase fines and penalties.

vaporisation at beaches and parks is utterly ridiculous. There is no way any person is harmed by that indorse assistance aerosol. The USA is questionable to be some freedoms. Fill should be extricated to do what they necessity as want as it doesn't modification others. Respiration at the beach may be bothersome, get over it.

You all need to stop complaining. There are ways around a smoking ban. have you thought about trying an (http://www.wordupecig.com/)e-cig. They are just as good as smoking but don't give off any second hand smoke.

1. Littering is already illegal. 2. Given the wind on most beaches or state parks, any smoke is almost immediately dispersed beyond detection by any sane human being. That leaves exactly what rational, factual basis for the proposed ban? Oh, I'm sorry, it's the right thing to do and I'll burn in hell for not getting with the party line...er...program.

No one is harmed by the second hand smoke of someone at the beach or in a campground. What a crock. Second hand smoke is harmful with prolonged, repeated exposure. The freedom deniers are disgusting and UnAmerican. And no, I don't smoke. I detest it. I find the shrill overreaction of my fellow progressives far more dangerous than second hand smoke.

BS, what a waste of time! So what. Jerry Brown will sign it. Thousands of people, children are harmed through second hand smoke. They also never throw away cigarette butts. Two strong reasons in favor of a ban. What are your reasons for it? "It is fun"?

If you're going to ban smoking at campsites, you'd better ban campfires. They'll do far more harm to your whining neighbors than a cigarette.

And I'm tired of smelling nasty and strong perfume that overwhelms me in restaurants and often at work. Soem people from other coutries also do not bathe enough. Should we ban everyone and everything? We can't allow whackos to control every aspect of our lives...period. Go Arnie.

Really, the only point that made sense is the fires. And it is more likey for someone smoking in their car throwing their butt out (something in all my years of smoking I NEVER did) starting a fire than someone on a sandy beach. And really, it is like a 900 dollar fine to throw trash including cigarette butts out of your car and yet, see people doing it all the time. Thank goodness I quit smoking so I don't really care.

How do we veto older men in unnaturally died darker hair-they're all doing it; it's a woman's prerogative to change her age but when accomplished men (who aren't trying to attract babes?) get these bad dye jobs that look so unnatural on their older faces, what do they care most about but their image??You look better real guys, much.

out of office. Now is his time to do exactly what he wants without fear of voter retribution.

I wouldn't care if I didn't have to look at cigarette butts all over the place.... honestly, smokers think that we are abusing them while they leave their butts strewn all over and, if they could, they would smoke everywhere like they used to without any respect for those who choose not too...
I am all for people being able to kill themselves with tobacco (a third who use it die from it, unlike cannabis) but they shouldn't make us watch them, smell them and clean up after them.

I don't smoke, never have. I hate smoking. Banning smoking at beaches and parks is utterly ridiculous. There is no way any person is harmed by that second hand smoke. The USA is supposed to be about freedoms. People should be free to do what they want as long as it doesn't harm others. Smoking at the beach may be annoying, get over it.

Second hand smoke is harmful. And why should those who don't smoke have to "get over it"? If' you're in a campsite playing your boombox all night keeping everyone awake, are they supposed to just "get over it" because it's annoying but you're exercising your "freedom?" A lot of people go to the beach and the parks to get away from exactly that type of annoyance.

Second hand smoke in a campsite or beach is not harmful, it's annoying. Do you understand the concept of freedom? If it doesn't harm you, yes, get over it. A boombox going all night does harm you, you can't sleep. Second hand smoke from a cigarette will do less harm to you than your neighbors campfire. Shoulod we ban campfires in campsites? Get a reality check.

Amazing. You can't smoke in restaurants, bars, or within 30 feet of a public building, but he's worried that banning smoking in a protected natural space is encroaching on the rights of California's citizens too much? I had assumed that since there were already big fines for littering in state parks that it would be a natural leap of logic to assume that we cannot pollute them either. Mr. Governor, please feel free to pollute your own lungs, home and car as you please. But forgive me if I ask you not to pollute our parks or the lungs of the animals and people who enjoy them.

I like that the article cited second hand smoke... outside at a windy beach.

And if you can still smoke at camp sites how was this a ban to begin with? What about second hand smoke for the camp site next to you?
