Why would Kagan give an Opinion on a hypothetical?

She is way too smart for that - perhaps the Repubs think they can fool her !!

Why not?

It's a key issue when a Republican vies for a parking space.

Of course abortion will be an issue, because the GOP refuses to let it die. This has been the law of the land for decades, but without it or gay rights or immigration, they have no wedge issues to trot out in an attemp to get the sheep to the polls.

Our side is not the one trying to redo things they lost on in the past. Abortion, Medicaid , social security, are not going anywhere. You all were on the losing side and do not like to lose, not to help Americans but out of bullish pride. Even with majorities and a pres you would not abolish abortion because then you lose your "magic bullet" and would fire up the rest of the country, the overwhelming majority that support right to choose.
