BP's Top Two Officials On Rig Are No-Shows At Crucial Hearing

Some of the most-anticipated witnesses at key oil spill hearings -- including BP's top official on the Deepwater Horizon who was involved in an argument with other rig workers over a crucial procedure just hours before the explosion -- have been no-shows.

Donald Vidrine, BP's "company man," overruled the rig's chief mechanic and driller and pushed to speed up the process by remove the drilling mud faster to save BP money on the day of the tragic explosion, according to testimony from rig owner Transocean's Doug Brown on Wednesday.

"Well, this is how it's gonna be," Vidrine allegedly said when confronted by the other workers, according to Brown's testimony, reports the Houston Chronicle.

Vidrine did not testify as scheduled on Wednesday, citing an unspecified medical condition. The other top BP official on the rig, Robert Kaluza, also declined to testify, invoking his 5th Amendment right not to incriminate himself. And a third witness, James Mansfield, Transocean's assistant marine engineer on the Deepwater Horizon, also called in sick, the Coast Guard said.

The decision by Kaluza "for the first time raises the specter of criminal liability in the April 20 explosion that killed 11 and continues even five weeks later to spew hundreds of thousands of gallons of oil into the Gulf of Mexico each day," reports McClatchy Newspapers.

At a hearing in Kenner, Lousiana today, Transocean's Jimmy Harrell testified that the day before the explosion, at a morning meeting, he expressed his concern to Kaluza that a new drilling plan did not include a negative test to measure pressure.

When that test was eventually performed, it was supervised by Kaluza, who later told Coast Guard investigators that his experience was largely in land drilling and that he was on the rig to "learn about deep water" drilling, the Wall Street Journal reported in a comprehensive account of that fateful day.

Kaluza's lawyers told the WSJ: "Bob did no wrong on the Deepwater Horizon, and we will make ... sure that this comes out at the appropriate time."

At the hearing, more details emerged about that fateful day, including the claim that driller started having trouble with pressure from the well about 20 minutes before the fatal explosion -- but no one attempted to shut off the well. And the rig's master testified that visiting BP officials were playing a video simulation game minutes before the gas burst out of well and exploded, reports the New Orleans Times-Picayune:

When he got to the bridge, he said found visiting executives from BP there. The rig's master, Curt Kuchta, testified the V.I.P.s were "basically playing a video game," a simulator of rig controls, and Kuchta said he was giving the visitors a tour. The other top officer on the rig, Offshore Installation Manager Jimmy Harrell, testified that he was in the shower.

Vidrine and Kaluza could not be reached for comment.

It seems to me now that the “11 killed†should read “11 MURDEREDâ€.
And if BP does not fire you, LORD Kaluza they should not be fined as we will only have to pay the tab in fuel. So, I say to you as Chavez would say. Get out of the USA. Leave all your equipment and leases because this is what you owe the people for all the crimes you have committed here as well as in Alaska. You have no idea how hard I would be on you who think you can tread on us.

were these witnesses subpoenaed to testify? Could this legally be considered contempt?
Between Rove's outright refusal to testify in the past and Alberto "I have no recollection" Gonzales' amnesia, these Congressional fact finding committees have become a joke.

Every worker who survived the explosion was immediately given a drug test; What about BP's Executives and the MMS representatives? In light of their previous "parties" I think it is a relevant question.

Taking the 5th means that you are afraid you might incriminate yoursellf. That means Robert Kaluza of BP thinks he committed a crime. Human error caused what should have been a routine kick to kill 11 people and cause the worst environmental disaster in our history. Bring on the prosecuter, even Kaluza knows he is guilty.

What ever the true of the matter, I wouldn't be a bit surprised if the very same people who orchestrated the financial crisis, would not hesitate to create a scenario, in which they stood to make enormous profits out of an environmental disaster.

A group of BP executives were on board the Deepwater Horizon rig celebrating the project's safety record, according to the transcripts. Meanwhile, far below, the rig was being converted from an exploration well to a production well." I am no scientist but could it be that the problem was a decision made by the powers that be on the rig to rush the conversion before the concrete had finished setting in order to fit the big wheels schedule to pop champagne and congratulate each other? I bet when the truth comes out this was a meeting to celebrate the conversion to production-not for safety. Could the work of the conversion have been delegated to underlings while the foreman's were attending the party. Could lack of oversight by the most experienced have contributed to mistakes being made? Careers and bonus's are made by mingling and a**kissing the boss's -- not down below doing your job.

codycap, good call, and an assertion I've been making from day one-- that the BP bigwigs were not celebrating safety, but the conversion, and wanted it rushed up. Why else would a "company man"-- the said, Donald Vidrine from the article-- be on the rig floor? And why would he order the replacement of heavy drilling mud for the much lighter seawater? Indeed they were in a hurry.

"Underlings" didn't cause this, BP people did.
Check out this link to a 60 minutes special, wherein the Transocean Electronics Tech tells not only of many equipment problems in the weeks leading up to the blow out, but also recounts the story of the BP man ordering the replacement of the heavy mud w/ seawater. VERY interesting story.

Just a reminder to some of you that a number of the witnesses to this horrible event were injured during the explosions on the rig an are still recovering from those injuries so please do not lump them in with the BP executives.

The thing to remember is that BP has a very long list of criminal activity
& expects the courts to take thirty years to finally decide a lessor fine.
Look at what has happened with Exxon's Valdez Alaskan abuse of law.

BP is basically British only in name. At this point, it's a large multi-national conglomeration, as much American as British. It's American headquarters just happen to be in Texas, BTW. So please don't get into a freedom fries mentality mode.

The assistant engineer James Mansfield is still recovering from a skull fracture and other severe injuries he received during the explosions on the rig. That is why he did not testify.

Agreed. Team Obama bows to lobbyists and will have no part of any harsh penalities towards BP. Just waiting for the leak to stop so they can try to switch the subject.
