Chicken Costume Ban In Nevada Sparks Squawks Over Free Speech Rights

CARSON CITY, Nev. — A ban on chicken costumes outside polling sites in Nevada, where they have become akin to politicking against a GOP Senate candidate, doesn't infringe on free speech, the state's top election official said Wednesday.

But Nevada Secretary of State Ross Miller also noted this loophole: Since someone can't be prevented from voting based solely on how they're dressed, there's nothing to stop a beak-and-feather-clad voter from heading inside to cast a ballot.

Chickens became political scratch in Nevada after Sue Lowden, one of 12 Republicans seeking the party's U.S. Senate nomination, suggested in April that people barter with doctors for medical care, like when "our grandparents would bring a chicken to the doctor."

Since then, Democrats set up a website, "Chickens for Checkups," and have sent volunteers in chicken outfits to her campaign events.

The Republican nominee will take on Democrat Harry Reid, the Senate majority leader, in November. Early voting for Nevada's June 8 primary began Saturday.

A day before polls opened, state election officials added chicken suits to the list of banned items at polling sites. Lowden campaign manager Robert Uithoven hailed the ban while blaming Reid for perpetuating what's become known as "bartergate."

"I think voters will be spared the Harry Reid carnival and that's a good thing," Uithoven said.

But on Tuesday, ProgressNow Nevada, a Democratic-aligned group, sent a letter to Miller complaining of the costume prohibition.

"There is no statute prohibiting dress that includes costumes," wrote Erin Neff, the group's executive director.

ProgressNow volunteers protested Wednesday outside a Las Vegas library polling site. Afterward, one chicken-dressed man went in to vote, and came out with an "I voted" sticker stuck on his feathers.

"It seems to me it's an unenforceable regulation," Neff said. "They gave him no problem and he made no disruption."

Miller, a Democrat, said such customes amount to electioneering.

"Dressing up in a chicken costume within 100 feet is illegal because every voter in Nevada now knows that carries a message directed at one particular candidate," he said.

State law prohibits signs, distribution of literature, or wearing campaign buttons, clothing or insignia in support of or against a political party, candidate or ballot question at or near polling cites. Violations are a gross misdemeanor, punishable by up to a year in jail and $2,000 fine.

But another provision says the law is not intended to prevent a person from voting "solely" for wearing political insigne that cannot be reasonably removed or covered. In such cases, the statute says election workers should take "such action as is necessary" to allow them to vote "as expediently as possible" before showing them to the exit.

Allowing free access to polling places is a necessary law. Intimidation in many locations is a real problem.
Of course, Reid and other Democratic proponents should hail and obey the rules. However, there should also be creative ways to point out that Chicken Lowden will be a feckless Senator.

LOL Now I see why the Dem Sec'y of State is trying to ban the chicken costumes. He wants Lowden to WIN the primary, because she would be the preferred candidate for Harry Reid. Although I think the chickens help people to think about paying their doctors.

Y'know, I enjoy a good laugh as much as anyone -- and this whole chickens-for-checkups fiasco has been a hoot from day one! -- but let's not lose sight of the very, very scary prospect that Ms. Chicken-Lowden just might be the next junior senator from Nevada. If that happens, the "joke" will be on us.

All of our constitutional rights are subject to reasonably necessary restrictions. It is customary to ban campaigning within a certain number of feet of the voting place. That seems like the right thing to do, so voters are not assaulted or intimidated on their way to vote. God knows few enough citizens vote in the first place, we don't want to drive any of them away.

But I wonder what the ruling would be if the moron class wanted to bring their guns to the polling place. Since the NRA owns all the politicians, and wants all Americans armed with assault weapons at all times, I'll bet you'd get a different result. Of course, bring your nuclear weapons down to the polling place, why not. If you don't like the way your neighbor votes, just shoot them: it's your constitutional right. But don't wear a yellow T-shirt and orange socks.

In this election, wearing a chicken suit has a specific political message and is significant to the campaign. As, a acativist, I really think the Dems ought to swallow this one and take on the issues prior to election day. The League of Women voters were strong supporters of moving campaign workers away from polling places, not being able to distribute literature near the entrance ways etc... It is fair to expect that each voter have free access to the polls and will have made up their minds before they get there.
