On Day Two, Kagan Deploys Humor And The Artful Dodge

WASHINGTON — She cracked wise. She waxed sentimental. And she employed the artful dodge liberally.

Supreme Court nominee Elena Kagan let some of her personality show through Tuesday as members of the Senate Judiciary Committee poked into every corner of her legal thinking. And she offered what amounted to a personal declaration of independence when questioned repeatedly about her admiration for her former boss, the late Justice Thurgood Marshall.

"I love Justice Marshall. He did an enormous amount for me," she told the senators. "But if you confirm me to this position, you will get Justice Kagan. You won't get Justice Marshall, and that's an important thing."

Through it all, Kagan didn't let her guard down.

She skirted questions aplenty on Day 2 of her confirmation hearings, and held her tongue when Republicans gave it to her good.

She was far more animated and at ease than during her slow, careful delivery of her opening statement on Monday.

Kagan bobbed her head. She waved her arms. She was funny.

"I'm enjoying our colloquy together," Sen. Orrin Hatch, R-Utah, told Kagan midway through a back-and-forth over campaign finance law.

"Me too," Kagan said.

And it seemed as if she meant it.

When Sen. Dianne Feinstein, D-Calif., suggested "a little heart to heart" talk with the nominee, Kagan went along with the joke.

"Just you and me," she agreed, as the video rolled and the cameras clicked.

Grilled about her actions as Harvard Law dean to restrict military recruitment on campus, Kagan got emotional when one senator read aloud from an opinion piece by a Marine captain and Harvard Law graduate who wrote of her support for the military.

"I've only cried once during this process," Kagan said, "and I cried when I woke up one morning and I read that op-ed from Captain Merrill. It meant just an enormous amount to me. "

At one point, Hatch and Committee Chairman Patrick Leahy got into a little back-and-forth over the fairness of Hatch's questions, the kind of exchange that Hatch said helps to keep the Congress from being "boring as hell."

Kagan chimed in: "And it gets the spotlight off me, you know, so I'm all for it."

Kagan even poked fun at the justices whom she hopes to soon join. Speaking about her support for allowing cameras in the Supreme Court, Kagan called it an incredible sight to watch the justices during oral arguments, but also allowed that some cases "will put you to sleep, you know."

She cracked up senators and the audience alike when she was asked about her whereabouts on Christmas Day, when there was an attempted airplane bombing, telling the committee: "You know, like all Jews, I was probably in a Chinese restaurant."

Kagan's humor got a thumbs-up from Sen. Arlen Specter, D-Pa., one of her most cantankerous questioners.

Talking about television coverage of the courts, Kagan told Specter: "It means I'd have to get my hair done more often."

That left him momentarily speechless.

Then he offered: "Let me commend you on that last comment, and I say that seriously. You have have shown a really admirable sense of humor, and I think that is really important."

Sen. Chuck Schumer, D-N.Y., later predicted Kagan would give Justice Antonin Scalia, who gets the most laughs on the high court, a run for his money.

Kagan held her own as a full day of questioning wore on into the evening.

Sen. Tom Coburn, R-Okla, said Kagan had proved herself tough enough that "maybe you should be on 'Dancing With the Stars.'"

At one point, Coburn pledged to ask Kagan a "softball" question.

"Promise?" she asked, cocking her head and drawing a laugh.

Kagan was relaxed, but it didn't keep her from backpedaling on her own words.

Kagan knew that questions about her 1995 article on Supreme Court confirmation hearings were coming, and she was ready.

In the article, Kagan had complained that Supreme Court hearings had "taken on an air of vacuity and farce" because senators didn't pin down nominees on their legal views. Senators, she said, should pursue more "substantive inquiry" and push nominees to be more open about views.

The article was inspired by Kagan's observations as a Judiciary Committee staffer during the confirmation hearings for Justice Ruth Bader Ginsburg.

On Tuesday, she allowed: "It just feels a lot different from here than it did from back there," referring to the row of staffers seated behind the senators.

Kagan said she stood by the basic thrust of her article, but allowed that she had "skewed it a little too much" in favor of openness.

Sen. Herb Kohl, D-Wis., reminded Kagan that she'd written that it was a "fair question" to ask nominees what direction they would move the court.

And then he asked her just that.

"It might be a fair question," she agreed.

But it wasn't one she was willing to answer.

You won't get straight humorless answers because no nominee will ever be confirmed that way. Pinning down a nominee these days is a game engaged in by the opposing side. Confirmations proceed along the lines of the rules established in the past 20 years. Keeping your own counsel is the only way you get on the Court.

I know what you mean. Both Arlen and Lindsey tried to butter her up with flattery and then turn against her hoping that they had her guard down. She handled them both adroitly!

Lindsay Graham is always assinine toward Dems but more especially toward women. Considering he has never been married, we know why. But there's no doubt that he and Kagan have attended some of the same cocktail parties in Washington, he likes to hang with the Dems, and she was comfortable with giving him a takedown.

Her funny and brilliant comeback at Graham over his question of "where was she on Christmas Day" will go down as the best of confirmation hearings. I love her.

Because Reagan turned "liberalism" into an obscenity when he called it "the L word." People bought it and they've been struggling every since. Republicans really know how to manipulate the language to get people to think their way even if it doesn't make any sense for individuals or the country.

Man, I would love to be a fly on the wall of the main SCOTUS conference room when the Justices meet to select which cases they will accept and the points of the cases they've already heard but not decided. Her brilliance, knowledge of the law and personal characteristics are evident and will add to Constitutional lore.

Agreed... She has been the most impressive candidate I have seen at these hearings in a Long Time... Extensive knowledge of the law coupled with logical processing, "sense of place" within the system and real "common sense"... So Far... Me Likes.

A while ago I read an article about how the justices work, and apparently they don't meet. They work separately to produce their briefs or opinions. Their decisions on what cases to accept are produced in the same way. They may meet for lunch at times (I'm pretty sure Scalia and Thomas do) but for the most part they don't socialize either.

She is very intelligent and ran circles around the dumbness of some of those senators who tried so hard to be ugly. Kagan is not afraid of humor and was very candid. At least she didn't have to lie to get out of a tight spot. Roberts and Alito had the lie down to a science. And I am glad that Kagan made her Christmas comment. That was a cloaked questions from Sessions...gosh..do they ever see replays of their presentations. Go Elena Kagan.

The Christmas question was from Graham and he didn't just let it go by asking her about Christmas. He kept bringing up how the bombing would have been "against the spirit of Christmas or Hanukkah"... as if Christmas and Hanukkah are somehow equal in both religions. As far as Southern Republican Senators go, I normally think Mr. Graham is one of the best of them, but he really needs to get out more.

Today I went to lunch at my favorite Jewish deli just to tweak Sessions. I know Sessions is afraid of Jews, but as you indicated, Graham should be more sophisticated than that.
