Now this ruling will be appealed until and so on until it goes to the US Supreme Court.
It ain't over till the fat lady (or in this case the nine old folks in kimonos) sing.

I am THRILLED. Natch those insensitive jerks will appeal it...but this is a wonderful decision. I just hope it holds up!!! Praise the Lord!!! Such an EXCELLENT DECISION. Everyone on here keep supporting those who support the gay community. ACLU, Human Rights Campaign Fund, Freedom to Marry, http://www.equalrightsfoundation.org/, the latter was responsible for this GREAT GREAT day. Thank you Mr. Olsen and Mr. Boies!! These men are the essence of this country and why I love it so much. THANK YOU, THANK YOU, THANK YOU!! It's not over yet though keep on supporting these groups that support us!

I sure wish there were MORE, not less, separation of church and state. This would settle the whole thing: have 2 ceremonies like many countries do, one religious--for recognition by the religious institution(s), and one civil for state recognition--in order to receive state provided benefits. Get the church out of the state business, and vice versa.

Finally some welcome news for the gay community. There have been too many defeats lately. Unfortunately I fear if it goes to the Supreme Court that it will be voted down by the by the majority right on the court.

the key passage of the ruling deserves a post here:

"Proposition 8 fails to advance any rational basis in singling out gay men and lesbians for denial of a marriage license. Indeed, the evidence shows Proposition 8 does nothing more than enshrine in the California Constitution the notion that opposite sex couples are superior to same-sex couples. Because California has no interest in discriminating against gay men and lesbians, and because Proposition 8 prevents California from fulfilling its constitutional obligation to provide marriages on an equal basis, the court concludes that Proposition 8 is unconstitutional. "

The rightwing Christian need to acknowledge that the “endangering†of the family does not come from a leftist conspiracy, but rather from their very own undoing.

Commitment to family has nothing to do with ideology…..secular and homosexual parents take their family responsibilities as seriously as Christians and rightwingers do.

Likewise, our support for the rights of the Gay and Lesbian community comes from our good sense of what “family values†really should be…..

How can these, lying hypocrites preach fidelity and commitment........ while denying marriage and rights to those whose sexual orientation is different from their‘s?

Rights for gays and lesbians doesn’t destroy Christian or heterosexual families, Christians and heterosexuals are doing a great job of wrecking their own……thank you very much…...

Fantastic news for equal rights. Neither the voters nor the legislature may enact a law that is in violation of the Constitution. The whole "will of the voters" talk is non-sense. Sometimes the voters do something unconstitutional... in these cases the law must be struck down.

The beauty of being a libertarian and constitutionalist is I am glad to exercise my right to keep and bear arms, while also embracing all members of society as my equal. Dems and repubs may tell you being pro-gay-rights and pro-gun-rights are mutually exclusive, but I'm evidence otherwise.

Now it's time for the circuit court to strike down the unconstitutional and utterly corrupt limitations keeping law abiding citizens from obtaining a concealed weapons permit in California. Let's apply a fair and equal standard while judging *all* unconstitutional practices!

But for now, let's just celebrate this just and fair decision.
