On Tuesday, Google was slapped with a breach of contract class action lawsuit alleging that its Nexus One smartphone failed to maintain 3G connectivity and that the Mountain View company not only made misleading claims about the product's capabilities but also failed to adequately support customers in search of answers.

This guy is only going after Google, the software maker not HTC or T-Mobile the hardware maker and provider. Strange considerin­g that receptions issues are rarely about software.

Guess he figured on going after the biggest name in hope that they would settle out of court.
I hope they fight him all the way.

I own an N1 with AT&T bands, and have no issues, but then the lawsuit seems to be more directed at spotty T-Mo 3G service and the fact that owners of T-Mo N1s were sent to Google for (nonexista­nt) support.

Reading the article, I was amused to find this on the same site. Apparently­, the N1 is selling better now that it's been killed off by google. You can still pick up an unlocked "developme­nt" unit from a publisher'­s page in the App Market, if you're a registered developer.
