SANTA ANA, Calif. — The man charged with murder in the drunken driving crash that killed a promising Los Angeles Angels pitcher and two others told investigators he must have "blanked out" while trying to find his way home and woke up only when the cars hit, according to a videotaped police interview played in court Thursday.

Andrew Thomas Gallo told investigators he and his stepbrother Raymond Rivera started the night of drinking at Johnny Carino's bar in Covina where his then-girlfriend was a waitress, City News Service reported.

Gallo, 23, is charged with three counts of second-degree murder for driving drunk and causing the April 2009 crash that killed pitcher Nick Adenhart, 22; Courtney Stewart, 20; and Henry Pearson, 25.

Gallo and Rivera left after about 90 minutes and made a quick trip to pick up an Xbox game console from a friend of Rivera's before going to The Well.

"I told him I have to go home," said Gallo, who was going to start a new job laying tile the next day, but the pair went to the bikini bar anyway.

"I told him we've got to stop" drinking, but before Gallo knew it someone had ordered them a round of shots, he said.

Gallo told the detectives he avoided shots of hard liquor, because he wasn't able to handle it. "The last time I did that at a family party things got out of hand and I blanked out," he said.

Gallo told investigators he couldn't remember how he and Rivera ended up in Fullerton and he was unfamiliar with the area.

"I don't remember getting in the car or leaving the place," he said. "The only thing that woke me up was the hit."

Later, he said, "I guess while I'm driving home I blanked out ... We were trying to get home and we got lost. I don't know anyone in Fullerton."

Gallo said he was surprised he was in the driver's seat because his license was suspended for not completing the terms of his conviction for driving under the influence in 2006.

"I don't know why I was driving. I'm not allowed to drive," he told the investigators.

Earlier Thursday, jurors watched a police interview with witness Esteban Quiroz, who was trying to make a left turn at the same intersection just seconds before the wreck.

Quiroz, 34, told police in the April 9, 2009 videotaped interview that he got a turn signal and was inching into the intersection when he saw a red minivan traveling about 70 or 80 mph approaching from his left.

Seconds later, as Quiroz watched, the minivan ran the red light and T-boned the car carrying the victims, he told officers.

"It was just flying. You don't expect a car to be going that fast toward a red light. Next thing I knew, it was on top of the gray car," he said. "What was really apparent ... is that the van was not going to stop."

Quiroz's car was swiped by the victims' car as it spun around after the impact and his airbag deployed, knocking his glasses off his face. He was not seriously injured.

Gallo has pleaded not guilty to the murder charges, as well as to felony hit-and-run and driving while intoxicated and causing injuries to two other people.

Gallo, whose blood-alcohol level was nearly three times the legal limit, according to police, could face a maximum sentence of more than 50 years to life in prison if convicted.

The remainder of Gallo's videotaped interview will be played for jurors when court resumes on Monday.

"...pleaded not guilty..."

Witnesses saw him driving, speeding, & running a red light, and he admits to getting behind the wheel drunk (which was proved by a blood alcohol test). Shoot, now that I've laid it all out, I can see that it's obvious he's a victim in this, especially since he's surprised to find out he was driving because he was "not allowed to drive" -- and we all know that people never drive on suspended licenses.

It's one thing to assure due process for all, but this seems to be a painfully stupid waste of money and the court's time. Not to mention a massive insult added to the emotional injuries inflicted on the victims' families.

Why? This was caused by the abuse of a LEGAL drug. I'll go so far as to say had the guy been stoned, that pitcher and the two other victims might actually be alive today.

What a guy -- even if he didn't kill anyone, he went out and got trashed to "celebrate" starting a new job the next day...I'd be nothing less than delighted to have a severely hung-over tile-setter show up on my job-site...

But what's worse is that he had a suspended license for prior DUI convictions, drove nevertheless, and killed someone. This is why we have prisons...

On Friday my brother was telling me a story about a potential new hire for his engineering business. During his successful interview, the applicant was informed he would be required to pass a drug and alcohol pre-employment test and that random and post-accident screenings would be conducted thereafter. The applicant was tested the next morning and FAILED his alcohol screening, twice. When asked why he appeared at the screening site intoxicated, the applicant stated he was "happy" to have gotten a job after having been unemployed for almost a full year and decided to celebrate with his family the night before the test. Can you belive that, a guy loses the opportunity to be hired in a $40K first year paycheck after months of suffering through unemployment simply because he wanted to drink alcohol the night prior to a drug/alcohol pre-employment screening. The applicant was 40+ year-old with an engineering technology degree. Some people seem doomed to grow old in spite of themselves.

He should be punished to the fullest extent of the law. Its always a shame that the drunks live and the people in the other car they hit always die. So sad these three young people lost their lives because this guy was irresponsble.

Back in 2004 I got a DUI, Stupid, Didnt know what i was thinking....Even if you come from a Restaurant, A house party, Just over a friends house drinking a glass of wine you could literally hurt/kill someone....Over time Drinking becomes a liability even if you do it in your leisure time. I remember going to those DUI classes and talking to so many people who had gotten a DUI coming out of Restauants with family. Just a glass of wine, or a beer........crazy.......You just don't realize that something can turn so tragic....all because of a stupid decision

One beer or one glass of wine is usually not enough alcohol to cause someone even weighing 100 pounds to be legally drunk specially if they are eating.

No, but it can create some impairment. To stay under the legal limit, you have to limit yourself to no more than one drink per hour.

My girlfriend and I were hit by a drunk driver on Aug 31, 2010. He was going 80 mph and accelerated throught the red light while in his 03 4runner w/ 3 passengers along. He hit my car in a head on collision in the intersection as I had been proceeding with the green light right by South Coast Plaza. We are lucky to be alive and in stable condition. The guy driving who hit us was 22 yrs old. I see a pattern in the age of these drunk drivers. If alcohol has to be legal, we must have some control over these young irreponsible kids leaving bars and happy hrs to get in their cars and attempt to kill people. I cannot help but read the similarities in this article to with my accident. God was looking over us; may all victims of such crimes be blessed eternally..

he is avoiding admitting guilt while facing his second DUI conviction. therefore he deserves no leniency or mercy.
