Obama Names Elizabeth Warren To New Post Setting Up Consumer Protection Agency

WASHINGTON — In a poke in the eye to the financial community, President Barack Obama on Friday named Elizabeth Warren, an aggressive consumer advocate and Wall Street adversary, to oversee creation of a new agency to regulate banks, lenders and credit card companies.

Sidestepping a Senate confirmation fight – for now – Obama stopped short of nominating Warren to actually head the new Bureau of Consumer Financial Protection. Instead, his action will let the Harvard Law School professor and expert on bankruptcy move quickly to shape the bureau.

Senate Republicans view her as too critical of Wall Street and big banks. The business and banking community opposed Warren as director of the new bureau, contending she would make the agency too aggressive. Obama praised her highly.

"Never again will folks be confused or misled by pages of barely understandable fine print that you find in agreements for credit cards or mortgages or student loans," Obama said, standing alongside Warren and Treasury Secretary Timothy Geithner in the White House Rose Garden.

"Elizabeth understands what I strongly believe: that a strong, growing economy begins with a strong and thriving middle class," the president said. "And that means every American has to get a fair shake in their financial dealings."

Billed as a big help to abused consumers, the new bureau is charged with writing and enforcing new rules covering the largest banks to the smallest storefront payday lender. Lenders will face new restrictions on the type of mortgages they write and won't be rewarded for steering borrowers to higher-cost loans. The bureau also is to protect borrowers from hidden fees and abusive terms.

Obama named Warren a special assistant to the president, giving her an influential province from which to direct the new bureau, a central element of the sweeping financial overhaul Obama signed into law this summer. The consumer bureau was one of Obama's key demands, easy for the public to grasp in an otherwise dense rewrite of complex financial rules.

Liberal groups and many consumer advocates want Warren to be named director of the new bureau. With the advisory appointment in place, White House spokesman Robert Gibbs said she would be instrumental in selecting a full-time director but hedged when asked if she would be a candidate.

Obama has had a difficult time winning Senate approval for even non-controversial nominees, and the White House believed that anyone nominated to the director's job – especially Warren – would linger without Senate action for months.

An Oklahoma native who was a state high school debate champion, the 61-year-old Warren was the architect of the consumer bureau, calling three years ago for the creation of an agency that would consolidate the consumer protection powers now spread across numerous financial regulatory agencies.

"Elizabeth is the best person to stand this agency up," Obama said.

The job has the official status of a Cabinet undersecretary, but the title of special adviser to the president elevates her stature considerably and gives her direct access to the Oval Office. The designation appeared designed to quell worries among some Warren supporters that she would be subservient to Geithner.

Congressional Republicans promptly objected to the arrangement. Reps. Darrell Issa, R-Calif., and Spencer Bachus, R-Ala., in a letter to White House counsel Bob Bauer, said that by giving Warren responsibilities at the White House and Treasury, Obama was undermining congressional oversight because she could avoid testifying before House or Senate committees. "This is unprecedented," they wrote.

The law gives the Treasury Department the authority to run the consumer protection bureau while the nomination of its director is pending. For now, Warren will be responsible for assembling the bureau and shifting consumer functions from regulators to the bureau. On Friday, Geithner set July 21, 2011, as the deadline for that transfer.

That means the bureau won't be able to enforce rules restricting mortgages or credit cards until at least then.

Warren would not have an immediate effect on other bureau activities. The consumer bureau, for instance, has as long as 30 months for regulations on predatory lending to take effect.

Warren has spent the past two years running the Congressional Oversight Panel, charged with monitoring the Treasury Department's handling of the $700 billion bank rescue fund known as the Troubled Asset Relief Program. She stepped down from the panel just after Friday's announcement.

House Financial Services Committee Chairman Barney Frank, a fan of Warren's, said she told him a few months ago that she thought it was more important that she help set up the agency than be its first director. Frank, D-Mass., said he made that point to Obama adviser David Axelrod.

"That doesn't mean she doesn't want the job, only that the setup is important and that sacrificing the ability to have her there to set it up so as to preserve her ability to be the full-time director would be a bad trade," Frank said in an interview.

Frank disagreed with House Banking Committee chairman Christopher Dodd, D-Conn., who has said that even with Warren in her new role, the White House needs to move quickly to nominate a new director.

Frank said Warren now has until the end of the president's first term – in January of 2013 – to set up the agency. Asked whether Obama should nominate a director soon, Frank replied: "Why?...The administration has found a way to put the best possible person in charge of it. I'm satisfied with that for now."

The consumer bureau was the most contentious feature of the financial regulation bill. The financial industry and the U.S. Chamber of Commerce mounted a fierce campaign to kill it while Congress assembled the legislation.

David Hirschmann, a senior vice president at the Chamber, said Warren's arrangement prolongs the uncertainty that has some lenders skittish about extending credit.

"If you're a credit provider, you're sitting there wondering what types of products you're offering will be second-guessed later as unfair, deceptive or not approved," Hirschmann said. "If you don't know what the speed limit is on the road and you knew there were cops out there trying to catch you, that would make you reluctant to drive."

Travis Plunket, legislative director for the Consumer Federation of America, said Warren will be crucial in setting the bureau's priorities, its culture and its regulatory tone. But, he added: "I don't see it as substituting for the need to get a director nominated and confirmed."

Looks like you have been successfully hoodwinked.

Let me clear this up for you: Elizabeth Warren is not the head of the agency now, nor will she ever be the head of it as long as Obama/Geithner are in power. The only reason she got the purely made-up on the spot titular no-authority job she did get is because Obama's poll numbers are rapidly heading for Bush levels and there's an election in 2 months. You can bet your bottom dollar that Obama is going to appoint either Lloyd Blankfein or a crony of Lloyd Blankfein to the post just after the November 4th elections. And then you'll see just what kind of authority Obama intended for Warren to have.

On the Poll Numbers for Obama they are rising according to the Gallup polls to 47% while Bush left office with 34%. Protecting the middle Class of which the majority of Americans are is Paramount. Dealing with the financial industry will be hard yes but look at their obscene profits after we bailed them out. This President is trying to do the right thing and people like you just want to tear him down

The Presidents of every country including US are voted to the Office to look after the welfare of those who all voted him to power and who did not as both become his concern to look after.

In addition, all will have to agree that never ever any President has taken so much interest to appoint particular a widely known highly efficient intellect to look after the interest of particularly the Middle Class. That too in all matters of financial deals, so that no financial establishment can swindle them in any deal as these financial establishments previously did with their clients.

How very lucky and happy the majority US Citizens should feel to have a President and a Party that thinks of the Citizens unlike others who all thinks how to usurp public money and fill their pockets whenever they are in power and get a chance to do so.
Even now, they are trying to.

They even tried tooth and nail to obstruct the appointment of Warren. Now the public have seen with their eyes wide open as to what they have done to go against the MIDDLE CLASS and what they said against the interest of the MIDDLE CLASS.

Sorry folks by Warren was NOT appointed, she was HIRED as government consultant to take heat off Obama as people wanted her to run agency. She is ONLY setting it up, has zero authority and this means for 18 months we will have NO agency in force, and few will want to go to work for agency that has NO Director. Many got duped by this "Obamaizum", Nothing will change in next 18 months but window dressing. Obama had Opportunity to appoint her as "Director" while congress out and it is all WH spin about R would fight it etc. Bush and all have done hundreds of "our of secession appointments", Obama has done very few .

Warren like "Health-mortgage-credit card-insurance-financial, all the "Reforms" simply are 95% for no change and 5% for minor change. Warren reports to Timmy in Treas and WH. Summers, TIm, Obama and bankers effectively neutralized her impact. She is a toy to be brought our for 2012 elections, will be sent to Congress for "confirmation" and if still popular will be used as ICON for 2012 "vote D". Seems in WH/Ds' all is "symbolic" wrapped in spin, rather then real actions.

Sorry for dose of reality, but I was supporting O at one time and he has sold out the common folks, eloquently so, but it is still a sell out. Commoners lost or gained little, every time did "Reform", Tim and WS/Banks/upper end has done very well

If she had gone through the nomination process at this time she would be blocked for a year, would not have been able to speak about the agency or abuses she wanted to stop. This was her idea so she could set up the agency and does NOT preclude her nomination. Once the agency is set up she can take the time for the nomination process. Those failing to realize the political reality and obstruction in DC need only to watch CSPAN on any attempt to get a nominee passed. It is ridiculous and a waste of our taxpayer dollars.

News flash, SHE COULD HAVE BEEN APPOINTED TO THE DIRECTOR JOB AND NO Congress involved, what part of that do you not understand, Rather obvious Obama betting on folks like you that do not know much about how a pres can appoint when congress our of secession. No wonder nation is all screwed up, as seems education systems fail to teach Gov 101 at any level. But they bet you buy into such stuff, and it seems most do. This is such a thinly-veiled attempt to gin up the support of the base without the downside of having to institute any real meaningful reform whatsoever. Typical Obama-style. He leaves Geithner in charge of the Consumer "Protection" Agency and only gives Warren the power to organize its structure. The best part is that the first opportunity to nominate Warren will only come AFTER the November elections when Obama can blame the Republicans for her failed nomination instead of his own failure leadership. Save your excitement, boys and girls...it's a lose/lose for Progressives (and the American people).

Wrong, wrong, wrong. The agency won't be fully operating until June 2011 but all the mechanisms have to be set up to protect people. Until the agency is set up Geithner is NOT in charge. This is an independent agency accountable to no one. I guess some either don't understand how it is set up under law? Warren wants to be able to begin to target abuses and talk about them publically while getting this started. I suspect once that is done she will be nominated.

Let me get this straight: Instead of punching Elizabeth Warren through now, Obama has given her a "special advisory post" while leaving Wall Street's favorite son, Timothy Geithner, and his Treasury Department in charge of the Consumer Protection Agency until Warren can be confirmed by a full Senate hearing which will no doubt be full of Republicans after November? Good luck with that. President Gut|ess Compromise out-thinks himself once again.

This is not a new agency. It is taking staff strewn out among several agencies and incorporating it into one. Sepearately they have been ineffective in protecting us from abuse tactics by Wall Street and empowering someone to speak for US. Elizabeth Warren is an avid advocate of consumer protections such as an easily readable credit card application with no hidden costs. She will be on our side and an agency with teeth which is not subject to override by special business interests. We all should remember when states regulated credit card rates. In the 80's that was changed and all companies went to the weakest state for consumer protections-Delaware so they could raise all our rates. The maximum rate in MO was 18% and no one sees that expect in credit unions where we should all have our money in. Consumer protection is the main reason we have lost trust in govt but that has been due to deregulation done to protect Big Multi-Natl Corporations. Just a lable does nothing to further your opinion-where are the facts behind them?
