BEVERLY HILLS, Calif. — A judge issued an arrest warrant Monday for Lindsay Lohan after the actress acknowledged failing a drug test less than a month after she was released from inpatient rehab.

Superior Court Judge Elden Fox also revoked Lohan's probation in her three-year-old drug case while issuing the bench warrant in Beverly Hills.

However, the warrant was stayed, and Lohan was allowed to remain free pending a hearing Friday to determine if she violated her probation.

Fox previously threatened the actress with 30 days in jail for each violation. He must now decide whether to send her back to jail or into treatment.

Lohan must attend the hearing. A message left with her attorney Shawn Chapman Holley was not immediately returned.

The warrant was issued after Fox took over the case last month and laid out a path paved with therapy sessions and 12-step meetings that could have finally brought Lohan's drug case to an end.

Lohan confirmed on her Twitter page last week that she failed the court-ordered drug and alcohol screening.

"Regrettably, I did in fact fail my most recent drug test," she tweeted.

She also said, "substance abuse is a disease, which unfortunately doesn't go away over night. I am working hard to overcome it."

Lohan often posts updates with the account that's verified by Twitter as belonging to the actress.

It could not immediately be determined why Lohan was not arrested Monday. A call to Superior Court spokesman Allan Parachini seeking additional details about the warrant was not immediately returned.

Lohan was released from jail on Aug. 2 after serving 14 days of a 90-day sentence for violating her probation in the 2007 case involving drug use and driving under the influence.

Another judge had required her to begin a three-month stint in rehab at Ronald Reagan UCLA Medical Center. Fox, however, agreed on Aug. 25 to release her from inpatient rehab after reviewing reports by her doctors and medical records from a three-year period.

Despite ordering an intense regimen of counseling and therapy, Fox gave Lohan some incentives to succeed. He dismissed two drug counts to which the actress pleaded guilty in 2007.

Lohan also dropped her $100 million lawsuit over a Super Bowl ad for E-Trade that featured a "milkaholic" baby named Lindsay, according to documents filed Monday in a Manhattan court.

The actress withdrew her case against the brokerage, which she had claimed made her the implied target of the joke.

E-Trade Financial Corp. spokeswoman Susan Hickey said the case's end reflected a "simple business decision" for the New York-based firm, but she wouldn't discuss details.

As I recall, the rehab center said that she was done with drug treatment. There must have been a mix up in the poor girl's test results. So there.

What's really annoying about this whole saga to me is that it's bad enough she's making a mockery of the justice system and keeps repeating the same behavior, but she gets out of her two week treatment and goes on the vma awards & makes fun of the whole thing, as if being sober is old hat to her! That really took the cake!

She goes to the VMA awards and Paris goes to Japan whereas I'd still be sitting in jail awaiting a court appearance.

I don't think jail is the answer for Lindsay. This is a substance abuse issue, she should be in treatment. The threat of jail is not going to get her off drugs, she has to want that for herself, otherwise she'll continue to fail. It's probably not very good for her sobriety to have to stay in LA for court matters either - she needs to get out of that town if she wants any real shot at success.

I think both will work. Put her in jail for the full 90 days straight she should have served away from GenPop, then send her to rehab. Also, I agree, get her out of LA.

Unless Robert Downy Jr., is hiding a continuing addiction, one has to admit that the final step of putting him in jail was effective, however, was it the only answer or simply the one that worked?? At this point, I'm not going to point the finger at Lindsay because you'd have to live in a basement without media to not know this young woman is in trouble and needs help. Yes her celebrity was used to get her off but in doing so these so-called professionals need to get out of the damned rehab business. Did it occur to anyone responsible for her early release from both jail and rehab had the potential to harm an innocent if she were to get in an accident while drunk and/or high? Yes, she flaunts the law because the law gives her no damned reason not to.

It's a shame that the people who say they love her the most are the one's who didn't try to stop her.I guess if you pay the bills for the family and toxic friends she hangs around with, it's all good to see her fall apart! On to the next one. I hope she can work out her problems. She does have talent & a pretty girl.

Drugs an alcohol are a disease for the purposes of a "get out of jail free" card and permanent government funding for rehab centers. Other than that drugs and alcohol are a choice to indulge in the pursuit of the pleasure gained from their use with the associated repercussions. If she really wants to give up she needs a serious dose of the 'Rational Recovery' approach to recognizing her addiction and pure pleasure seeking and stop listening to people calling her a victim of a made up disease.

Lindsey Lohan needs intensive therapy for her drug addictions and not jail time.The Judges must understand that they cannot criminalize disease entitites and become witch-doctors and lock up sick people.

This is exactly what Hitler did, though cruelly and on a much larger scale by exterminating mentally challenged people.

I agree, but with the caveat that ALL people need understanding, not just celebrities. We all know that if this was any ordinary Joe or Jane, they wouldn't have even been out of jail from the first time to have even violated parole like Lindsey has done time and again. Sad thing is, the coddling that the courts are doing with Lindsey will probably end with her death from overdose.

Partly true. The cops ignore drug addicts on the streets; people routinely walk over their dying bodies; families too often scream for help to deaf ears; do gooders have now made it impossible to enter treatment centers if one smokes cigarettes (!!!); treatment centers are closing, left right and center; jailed addicts have easy access to drugs in jail. The 12 steps are the best bet, but are not a replacement for medical help.

Lindsay Lohan is lucky. She's getting the attention she needs to bring the bottom up on her disease. She continues to ignore it to her own detriment. Her disease wants one thing only: Her dead body.

They're staying it until her court appearance on Friday. If the judge decides to invoke the jail time, I think she'll be taken into custody then.
