Margaret Witt, Air Force Major Discharged Under 'Don't Ask, Don't Tell,' Testifies In Federal Court: 'It Kills Me'

TACOMA, Wash. — A decorated Air Force Reserve flight nurse discharged for being gay took the witness stand at her federal trial Monday and told the judge it "kills me" not to be able to care for wounded soldiers while the country is at war.

Former Maj. Margaret Witt has sued the Air Force in hopes of being reinstated.

No one in her unit or any of her patients ever expressed concern about her sexual orientation, she told the judge.

"It's what I've spent over half my life training to do," Witt testified, her voice breaking. "I miss being able to be the one that that soldier looks at and I can do something for him. I'm not complete, and it kills me to not be there."

The case has been closely watched by those on both sides of the gay rights debate.

Proponents believe another big legal victory would build momentum for a congressional repeal of "don't ask, don't tell," the 1993 law that prohibits the military from asking about the sexual orientation of service members but requires discharge of those who acknowledge being gay or are found to engage in homosexual activity.

Earlier this month, a federal judge in California ruled that "don't ask, don't tell" violates the due process and free speech rights of service members. That opinion has no direct bearing on Witt's case.

Witt joined the Air Force in 1987 and later became a flight nurse, helping to care for and evacuate soldiers wounded in Afghanistan. She was suspended in 2004 when the Air Force investigated her for violating "don't ask, don't tell." She was discharged three years later, while just short of becoming eligible for a full pension.

Her lawsuit challenged the constitutionality of "don't ask, don't tell." In 2008, a three-judge panel of the 9th U.S. Circuit Court of Appeals considering the case held that the military couldn't discharge someone for being gay unless it demonstrated the firing was necessary to further military goals.

The case returned to U.S. District Court in Tacoma, where Judge Ronald B. Leighton must determine whether Witt's firing met that standard. Leighton heard testimony last week from several of Witt's former colleagues, who said they didn't care about her orientation and that her firing actually hurt morale in their squadron, based at what is now Joint Base Lewis-McChord near Tacoma.

The Air Force maintains that Witt's firing was justified, and the appeals court ruling was out of line with 9th Circuit and Supreme Court precedent.

In pointed cross-examination, Justice Department lawyer Peter Phipps noted Monday that Witt had engaged in an adulterous relationship with a married civilian woman in 2003. The woman, now divorced, is still Witt's partner, but the Air Force argues that Witt's disregard for policy in committing adultery set a bad example for others in the unit and justifies her dismissal.

"You agree that adultery is not consistent with high standards of integrity, correct?" Phipps asked.

"Yes," Witt responded.

The government also argues that Witt acknowledged being homosexual to some of her close friends in the unit, forcing them to choose between loyalty to her and to Air Force policy. Her firing eliminated a risk to unit cohesion, a legitimate military goal, DOJ lawyers say.

Witt's attorneys insist that the government has no evidence proving Witt's firing was necessary to further any military goal. In fact, they argue, there's no evidence that allowing gays to serve openly would hurt unit cohesion, or even any evidence that troops perform better if they get along socially.

Elizabeth Kier, a University of Washington associate professor of political science who has studied the issue, followed Witt on the stand Monday. She summarized research in the field thusly: "There is no significant positive relationship between social cohesion and performance, and high levels of social cohesion can undermine military effectiveness."

Closing arguments are expected by Wednesday. It is not clear when Leighton will rule.

Here's some subplot - If you are a "super troop", or Squared away" in the military, your superiors will over look stuff like this. But if you are on someones S-tlist, they will run you into the ground.
When someone has it out for you, there's no escape.

While it will take longer, I hope that the constitutionality of DADT continues through the courts system to it's final resolution. Repealing the law just means that a different Congress in the future could pass another law worded slightly different. Once the Supreme Court hands down a decision the issue is settled. Also, if DADT is ruled unconstitutional the people discharged under DADT could request reinstatement and possibly receive damages. A simple repeal of the law cuts off that possibility.

Sadly, with the current court, there is a strong possibility SCOTUS would rule in favor of DADT. Then the nation faces the prospect of having to wait possibly decades for a "new" court to re-rule on the issue. Unless Obama gets to appoint two or three more justices, the right-wing ideologues comprising the majority of the court will skew decisions for years.

Now that the Senate has struck down the entire Defense Auth bill, it's in Obama's hands and he lacks the testicular fortitude to issue an executive order ending DADT. A better solution would be for all branches of the military to equitably enforce the standards of "conduct reflecting high integrity" under which Witt was discharged (along with violating DADT, obviously). Should EVERY member of the military engaged in an adulterous, pre-marital or other so-called illicit sex be discharged, there wouldn't be more than 100 warriors left in our nation's military. If the "high integrity conduct" net was broadened to include rescinding moral and criminal waivers, and all dishonorable activities, e.g., cheating, lying, stealing, prejudice, etc., we wouldn't have a military, period. Let the one without sin cast the first stone, eh? This whole thing is a travesty that dishonors every patriotic, freedom-loving American.

(And, PS....now Scalia goes on a rant that Americans have no Constitutional right to privacy? WTF????)

She knew the policy and rules when she joined. There have been thousands of gays who have had long careers in the military with no problems if they kept their private sex life PRIVATE. She chose otherwise, and chose to violate the rules. In the military you do NOT get to pick and chose what rules and orders you will obey.

She not only violated DADT, but she also violated the UCMJ in the matter of adultery. I worked with a mechanic who had just re-enlisted in the Air Force. He and a civilian guard on base got into a shouting match about something stupid the guard did. My co-worker did nothing violent or even wrong under the UCMJ, but the next day, he was discharged from the USAF. It was the end of his career. So I find it rather hard to have a whole lot of sympathy for her.

But gays and lesbians have to serve under a DIFFERENT set of rules. Having two sets of rules for two classes of people is discrimination. Perhaps you've heard of it?

I served 20 years in the military and never ONCE saw someone kicked out for adultery or for engaging in oral sex. Both acts prohibited by the UCMJ. Saw plenty of gays kicked out though for THEIR private, consenting adult behavior.

It's ludicrous to think your friend was kicked out of the USAF for a shouting match. I don’t know of anyone who was ever kicked out of the military for arguing with a civilian, nor have I ever heard of anyone being kicked out the day after doing anything. There have to be investigations, statements to be taken, paperwork to process.

Your friend was most likely booted from the USAF for something he doesn’t want to admit to anyone so he made up a nice little story to tell gullible people. Now THAT I have seen time and time again.

She was kicked out not for telling anyone, she was kicked out because the civilian leaked the info. The USAF then turned around and created a secondary argument that she “told”. How despicable! The USAF should’ve disciplined her the same (equally) as they would have a straight person and not gone on a fishing expedition to find people she may have “told”

During my 20 years I told plenty of my close friends and never had an issue. Her friends evidently never said anything until the USAF went on their witch hunt.

If you’re straight and married, how would you like to go around denying that you have a wife/husband or children? How do you think your wife/husband would feel about you having to deny their existence? That absolutely repulsive!

Straight service members never get kicked out of the service for committing adultery! They barely even get noticed. When they are found out the generally go to Captains Mast (in the Navy) and are disciplined through that process. I've seen servicemembers go to Captains Mast and be seperated by being sent to new commands after serving out their punishment. But I never seen any booted for it!

I'm so freaking glad I retired at the end of my 20 years!

Major - I wish you all the best! They should at least give you your retirement! You deserve it!!! Keep up the fight!!!!

STUTTGART, Germany — A military policeman on Tuesday was sentenced to three months in jail for committing adultery and indecent acts and threatening his sex partner, a woman of a lower rank.
Army Sgt. Corbin R. Timberman, 25, of the 554th Military Police Company also received a bad-conduct discharge and was reduced in rank to private. The married father of three was not punished financially.

Secondly - the article lists 1. adultery AND 2. indecent acts AND 3. threatening his sex partner, a woman of a lower rank.

It appears he may have been using his position of authority.....

The new generation will not tolerate those that want to keep DADT, and it will be reflected in future elections. Those that use the banner of religion to justify their cause to change the Constitution of equality will gasp at their demise in their political holdings. Those that cling to the banner of religion against gays, can't explain why G-d is sending them gay children in their family. Maybe Dick Cheney can explain this? In their [logic], maybe they think this is a 'curse' or just maybe, just maybe it is to give them understanding of the word equality.

None that I have heard of but in Wichita right now an Air Force Sergeant is being tried for going to multiple swinger parties and exposing people to HIV. I cannot tell if it is a male or female sergeant from the write up, though.

When I was in I did have a friend that got in trouble for it, but he was just reduced in rank. Of course in his case, it was the wife of someone he served with, which made it really a bad situation. For the most part though, it happens, and no one gets in any trouble.

I know they did not like that she is gay... ok fine, but didn't she also have an affair with a subordinate officers spouse? I think that alone qualifies for dismissal as conduct unbecoming an officer... but then, there's always a lot of conduct unbecoming by officers... The Tilman affair for example.

I would much rather have served with hard working and competent gays and lesbians than some of my fellow "straights" that I had to be around 24/7 for months on end. The fact that we are still discriminating against brave, talented people who only want to serve sickens me.

I wish I understood the Obama Administration. If I did, perhaps I could support it wholeheartedly.

But, on the one hand, while calling for repeal of DADT and promising it would be gone "this year" in his State-Of-The-Union Address, the President sends out his legal lackey, Holder, to fercely fight any attempt to find the same contemptible law illegal.

They did the same with DOMA.
