FBI Investigating Prominent Labor Leader Andy Stern In Corruption Probe At SEIU

WASHINGTON — The FBI and the Labor Department are investigating prominent labor leader Andy Stern in a probe of corruption at the Service Employees International Union, according to two people who have been interviewed by federal agents.

The two organized labor officials met with federal agents this summer to answer questions about a six-figure book contract that Stern landed in 2006 and his role in approving money to pay the salary of Alejandro Stephens, a former SEIU leader in California who allegedly performed no work. The title of the book is "A Country That Works."

Both officials spoke on condition of anonymity because of the sensitive nature of the investigation. The FBI and the Labor Department's office of inspector general declined to comment for the record.

The disclosure about the federal inquiry of Stern – who abruptly resigned as president of the 2.2-million member SEIU in April – comes just weeks ahead of contentious congressional elections in which the union is spending an estimated $44 million to support its favored Democratic candidates.

Stern issued a statement calling reports of an investigation "simply false."

"I have absolutely no reason to believe, and not the slightest indication, that I am being investigated by federal authorities with respect to Alejandro Stephens, or "A Country That Works," or for that matter anything else," Stern said.

The SEIU has been plagued with several financial scandals since 2008, when the Los Angeles Times reported that Tyrone Freeman, head of the union's largest California local, misappropriated hundreds of thousands of dollars from the union. The union ousted Freeman and demanded that he return the money. No federal charges have been filed against him, but SEIU spokeswoman Michelle Ringuette said the union has been cooperating with the FBI.

Stern left his post two years before the end of his term, saying he wanted to focus more on his personal life. He remains a member of President Barack Obama's deficit commission and a highly influential figure in the White House, where he was one of the most frequent visitors last year. He is also a research fellow at Georgetown University and a paid consultant for the SEIU.

Ringuette said she is unaware of any federal scrutiny of Stern. Ringuette rejected the notion that there was anything improper about the book deal or how the union paid Stephens. She said similar unsubstantiated accusations have been floated for years by disgruntled former SEIU leaders and conservative bloggers.

A White House spokesman declined comment.

One person who spoke to federal agents twice, in May and June, said they asked about a 2006 contract in which Stern received a $175,000 advance from Simon & Schuster to write the book. The SEIU and its locals bought thousands of copies of the book after it was published. The union also paid thousands to fact-check and promote the book, but Stern pocketed the advance.

Ringuette said the SEIU's executive board fully vetted and approved the project. The board told local unions that purchasing Stern's book "is a truly voluntary decision on the part of those who make it, and no adverse impact will result for anyone or any entity who refrains from purchasing or promoting the book," according to documents obtained by the AP. The board also instructed locals to make sure any book purchases were authorized by the local's constitution and bylaws.

Ringuette said the Simon & Schuster contract "did not require the purchase of a single book by SEIU." Stern also received no royalties from book sales to the union.

Federal officials are also asking questions about how Stern and union officials approved payments to Stephens, the former president of the SEIU local that represents Los Angeles County government workers, according to the people who were interviewed.

The FBI has been investigating Stephens for more than a year. Earlier this month, he was sentenced in federal court this month to four months in jail and three months' home confinement after pleading guilty to stealing $52,000 from a voter outreach program.

Stern has not been linked to any of the charges resulting in Stephens' guilty plea. But federal agents are seeking details about the time in 2007 when Stephens' local was merged into a larger SEIU local and he lost his post as president. The SEIU offered Stephens a generous severance package and a new job as a $75,000-a-year consultant to the SEIU California State Council.

Ringuette said the union arranged for Stephens to perform consulting work for the council and agreed to reimburse the council for his annual salary. But she said the union later discovered Stephens wasn't actually doing any work.

Federal law prohibits labor unions from creating what amounts to "no-show" jobs that pay someone for work they do not perform.

Stephens' attorney, Roger Rosen, said his client has not cooperated with federal officials and has no plans to in the future.

"Pravda"? It has also disappeared from the national press, because it is UNFOUNDED.

The only place it will continue to be found will be on Faux Fraudcasting, Newsbusters, and their ilk. When you look there, the headlines will all say something like "Obama's BFF Andy Stern..." etc.

It's no wonder that this country is among the least informed in the first world, you can beam the news into nearly every home in the nation, but you can't make 'em read.

"...Both officials spoke on condition of anonymity..." It's a rumor conjoined with reports of other, genuine investigations... Man, have you never been through a modern election cycle?

The founding fathers foresaw an educated, questioning, electorate capable of critical thought.
That whirring noise? Thomas Jefferson, spinning in his grave.

Here is how it works. Union money is thoroughly tracked and cannot be hidden. There are many, many laws, passed by big business that makes it nutty to try to skirt those laws. Big business is always there to float ideas as to how to start a fuss, true or not. I cannot see how writing a book is against the law. I think you will find no one was forced to buy the book. The $44 million is perfectly legal now, remember the Supreme Court ruling? a working individual usually has no power in negotiating for his pay or benefits or in talking to their representatives in Congress. If you have a Union you can send your own representative to speak for you. That is the great truth of Unions. You could ask the Union members to individually support a candidate, but most people would rather pool their money. The Spencer guy is a side issue from Andy Stern. I think this issue too will be proven to be a red herring like the other ones proffured by the Republicans this year.

Unnamed sources, sketchy on what the actual violations may be... Typical rumor mongering.

An organization representing 2.2 million workers, spending a measly $44M to present their views? Oh please, organization representing a thousandth of that are spending as much or more.

How about the genuine, verified FBI investigation of anti-war protesters for alleged "material support of terrorism"?

Union dues shouldn't go to political campaigns, they should be going to better protect their own workers within their job sites.

Lauren, I have been a dues paying member of the IBEW, local 134, for more than 25 years. The notion that you would have any say as to how our organization proceeds is the height of presumption.

The notion that spending money on political campaigns, especially considering the political climate of the past 30+ years, is not "...going to better protect their own workers..." is so uninformed as to be absurd.
Your qualifier "within their job sites" is worse. Truly, things like workplace safety, pensions, health and welfare, overtime protections, the right to organize, etc. all extend well past the street address where I happen to be working.
I find it difficult to believe that anybody would think that participating in the political process is something that unions or any other labor organization shouldn't be doing. Where do you stand on healthcare reform? What do you imagine organized labor's role in getting it to happen was? What do you think groups like the US chamber of Commerce are doing, and how much they spend to do it?

Workers have far more in common than not. It is in the interest of every working person that we realize our common goals. It is also in the interest of our communities, where we pay our property taxes, buy our goods, in general, participate, if working people get a fair shake

Really? Which organizations are paying more than $44MM. Even so, is that the company you want to keep? This website complains about 'special interests' manipulating elections but no one notices private and public unions are some of the biggest special interests ever. Current private union membership is about 7-8%, yet they are trying to get bills that favor them that the other 93% have to pay. I find it dispicable.

"... yet they are trying to get bills that favor them that the other 93% have to pay..."

Cite one such bill, just one. You have bought into your own propaganda. Bills sponsored or promoted by organized labor generally exert upward pressure on the affairs of all wage earners.

Contrast this to the millions spent by the wallahs and poobahs of "capital" and their multitude of lobbies and fronts. Contrast this with the essentially self-regulating nature of "capital" afforded by the revolving door policy between the financier and regulator. This is the true cause of the "devaluation" of labor.

What is despicable are the blowhards and profiteers who step into a rigged game onto 3rd base and crow to whoever that they hit a homerun.

No economist supports the notion that the current record disparity in the distribution of wealth is caused by "Labor is, and will continue, getting a smaller and smaller part of the pie as time goes on. This is the way it should be...Labor has dropped in value relative to capital (intellectual and financial) and, as such, should get less of the pie.."

Few will agree that this even is an accurate description. Such "masters of the universe" would scarcely survive in the world they postulate.

So called "free market" capitalists seem to forget that outside illegal markets like drugs, there is no such thing, nor has there ever been, as a "free" market. Such "free' markets have always been bought and paid for through the judicious use of capital to elect the legislature and enact the laws needed to build the environment and extract the "ROI" that defines the reason finance exists at all. Rather than set the stage for the creation of real goods, "finance" has devolved into a pirate's game of instruments and risk peddling. If it is the "zero sum" game you believe it is, where does the money come from? Certainly not the people who add nothing, build nothing, but create and trade derivatives.

Despicable describes the beating 401(K) holders took, the beating small investors took, the beating householders took while the geniuses of capital came hat in hand to Washington to replenish their wealth, while at the same time, never even came close to having to tighten their belts.

You have no ethical or moral high ground here.

This administration investigate their bud? Dont hold your breath. Given that the justice department is told NOT to prosecute voters rights cases where the victem is white, it wont happen to BHO's friend and close advisor. How many crooks do you need to have in the administration to understand they will only enforce the laws beneficial to them and ignore ones not in their interest.

But they won't investigate Goldman Sachs for destroying the world's economy, or investigate Bush and Cheney for lying us into two illegal and immoral wars, or investigate Blackwater for murder (rather than giving them more multi-million dollar contracts), or investigate Haliburton for shoddy workmanship, war profiteering and lying.

Is America a great country, or what?

Just a few good examples. The far right don't give a hoot how corrupt their "side" might be as long as they win. Some of us on the left say to root out corruption wherever it lies and to keep all institutions accountable.

It's laughable that you should claim to care about real democracy.

United v. FEC anyone? Check out how much money the Chamber of Commerce are paying pols?

Corporations are not democratic. Our election system is not democratic. Both parties are corrupt. Unions are only as democratic as their members demand them to be.

Keep on playing your pathetic us vs. them games, but don't expect anything to truly change as long as you think your side is holier-than-thou.

What an ignorant, blanket statement. Apply that to corporations, political parties and other institutions, why don't you. One bad apple makes the whole crop bad. Throw out the baby with the bathwater.

Union members fought and died to provide us ALL with workplace safety, an end to child labor, minimum wage, benefits (you know, like a lunch break or potty break?), the 40 hour work week and the weekend...etc. What did you do last weekend? Sit around and watch Fox?

Yeah and people like KennyBoy Lay and Abramoff are reasons why corporations should not exist. And Dick Armey, Larry Craig and Dick Cheney are reasons why the Republican Party should not exist. And Rupert Murdoch is the reason tv news should not exist.

Get an education on all aspects of our history and get out of your black and white universe.
