Justice Alito Will Not Attend Obama's State Of The Union

WASHINGTON — When Supreme Court justices enter the House of Representatives in their black robes for the president's next State of the Union address, Samuel Alito does not plan to be among them.

The justice said the annual speech to Congress has become very political and awkward for the justices, who he says are expected to sit "like the proverbial potted plant."

Of course, Alito did not remain impassive at the most recent State of the Union speech by President Barack Obama. He reacted to Obama's unusual rebuke of the court for its decision in a campaign finance case by shaking his head and mouthing the words "not true."

The 60-year-old justice, an appointee of President George W. Bush, acknowledged with a smile that his colleagues "who are more disciplined refrain from manifesting any emotion or opinion whatsoever."

Alito, answering questions following a speech Wednesday at the conservative Manhattan Institute in New York, also said, "Presidents will fake you out." The institute provided an online video link to Alito's talk and question-and-answer session.

The president will begin a sentence with an invocation of the country's greatness, Alito said. If justices don't jump up and applaud, "you look very unpatriotic," he said.

But, Alito continued, then the president may finish the thought by adding "because we're conducting a surge in Iraq or because we're enacting health care reform." Justices aren't supposed to react to statements about policy or politics.

The better course, Alito said, is to follow the example of more experienced justices like Antonin Scalia, Clarence Thomas and the recently retired John Paul Stevens. None has attended in several years.

"So I doubt that I will be there in January," Alito said.

At least one justice, Stephen Breyer, has said he was not bothered by Obama's criticism and believes justices should attend so that viewers can see the three branches of government represented in the same room.

Even in retirement, Stevens is still taking aim at Scalia, his favorite foil on the Supreme Court.

The two judges traded barbs for years in opinions and footnotes to opinions and footnotes written in response to the other's footnotes.

In a recent speech in Washington, Stevens reached back to 1991 to take Scalia to task for his opinion in Harmelin v. Michigan, a case that upheld a life prison term for cocaine possession against a challenge that the sentence was cruel and unusual.

Scalia, Stevens said, concluded in his opinion that the Eighth Amendment prohibited specific kinds of punishments, including drawing and quartering and disembowelment, "but contained no requirement that the punishment fit the crime."

Even a life sentence for a parking ticket would not have violated the Constitution under that reasoning, Stevens said.

The real issue, the 90-year-old retired justice said (and not for the first time), is Scalia's faulty reliance on originalism to interpret the Constitution. In Scalia's view, judges should give a fair reading to the words of the Constitution as they were meant when they were written.

But Stevens said that "reliance on history, even when the interpretation of past events is completely accurate and undisputed, provides an insufficient guide to the meaning of our Constitution."

Instead, he said, the Eighth Amendment "responds to evolving standards of decency in a maturing society."

A long-awaited biography of Justice William Brennan, who served nearly as long as Stevens before he retired in 1990, is finally out.

In "Justice Brennan, Liberal Champion," authors Seth Stern and Stephen Wermiel assert that Brennan was disappointed in fellow liberal and frequent ally Thurgood Marshall after the latter joined the court. "What the hell happened when he came on the court, I'm not sure, but he doesn't seem to have had the same interest," they quote Brennan as saying about Marshall. The first African-American justice, Marshall had impressed the justices as a civil rights lawyer who argued many key cases at the high court.

The book also makes clear that Brennan, a defender of women's rights on the court, was uncomfortable with women as professional peers, once saying he would retire if a woman joined the Supreme Court. (In fact, however, he stayed on the court for nine years after Sandra Day O'Connor became the first female justice.) He also was slow to hire women as law clerks.

The authors also point out that Brennan's support for abortion rights coexisted with his unease about abortion on a personal level and that his strong backing of press freedoms did not lessen his antipathy toward members of the press.

The story behind the book also is interesting. In an arrangement that was not revealed while Brennan sat on the court, the justice gave unusual access to Wermiel, then a reporter for The Wall Street Journal, beginning in 1986. Wermiel, who now teaches law at American University, was to produce a book about Brennan in an unspecified but reasonable amount of time.

Wermiel had completed only a few draft chapters when Brennan died at age 91 in 1997. Wermiel basically put the project aside for several years until he enlisted Stern, a reporter for Congressional Quarterly and a graduate of Harvard Law School, to take over the bulk of the writing.

Mr. Alito,,,will you be attending the VATICAN BANK board of Directors meeting the day of The State of The Union Address ? Seems we have another SCANDAL coming down the pike from the BANKERS OF GOD ($30,000,000.00 in money laundering).....One little question Mr. Alito,,,Do you believe the Supreme Court has too many Catholics in residence ? A nice even number of "6",, how about that ! Do you still believe the Citazens United case is good for America to permit secretive and un-limited amounts of "CASH" to buy our elections......Not only should you stay away from the State of the Union address,,,You might consider staying away from the Supreme Court !.....I am a Catholic and of Italian heritage ,,,you and Mr. Scalia do not warrant any respect from any-one except your Corporate buddies....You should consider how NASCAR puts all these "LOGOS" on their cars and uniforms to let the public know their "Sponser-Ship"..........A lot of space on those long black robes...............Charles Belenchia

Last time I looked, the State of the Union Address was about the condition of the Nation. It is not all about the notably immature and publicity seeking Justice Alito, though he clearly wishes otherwise.

The State of the Union address should be a command attendance for all members of the Supreme Court not a choice. In addition, since they are not sitting on the bench consideration should be given to what the uniform of the day is for them. It should not necessarily be black robes but suits and ties.
It would be more appropriate if they dressed like the corporate executives they seem to identify with so well.

i don't understand the disrespect that was shown by alito and joe wilson the last time our president appeared before congress. i am almost 60 years old and i've never seen that before. i will nver understand that kind of disrepect to the president.

The justices are part of the system of government and should be required to be there, I don't give a rat's a$s if they do not like it! There are a lot of things about THEM that I have not appreciated recently, but have had to deal with it (case in point is the [in my opinion] impeachable offense called "Citizen's United", that Roberts and his hyperconservative cronies pushed through).

Grow up, Justice Alito and do your duty, you are NOT above anyone else. If you don't like your responsibilities, quit, and let someone that would take the job seriously take your place!

I would never have voted for W. even though there are some things I really dig about him on a personal level e.g. he is a distance runner and as one I find that really cool.

I just wonder how he would respond to an Alito's move? I do know that he did not dig having his authority or the power of the Presidency undermined.

He would have found a way to sort it out. W. you may never be forgiven however as long as the sun shines, you will never be forgotten.

THE SO CALLED...." JUSTICES OF AMERICA'S HIGH COURT"...

My question is....

Just who do these people think they are, that they can implement detrimental laws against us, (the people of America), have their spouses running around denouncing our political process and our sitting President , while they continue to sit on the bench, claiming they are not influenced by their spouses' thoughts and political stands. Not to mention this Justice, Alito's improper behavior while attending the last State of the Union Address against the President, who openly expressed his disagreement with the President as he sat there, and now, says he will not be attending in the future !

Even the President of the United States can be removed from office for unethical and improper conduct, when found to be acting against the American people. I certainly hope that congress will follow-up on Chief Justice, Roberts last move when he opened the door to allow corporations, ie even foreign countries to fund our electoral candidates. And we should implement more regulatory laws or restrictions concerning those serving on our nation's high court, because, they are definitely not working on the American public's behalf with this nonsense, thinking they are sitting too high, and solidly in place, and cannot be removed ! .......... IMPEACHMENT ACTION MAY BE IN ORDER FOR A FEW OF THEM HERE !

The Supreme Court does not answer to the President, they are an equal yet separte branch of the government who's job it is to check and balance the other two branches. Just as the Congress is to check and balance the executive and the judiciary, the Presidency to check and balance the legislative and the judiciary so must the Supreme Court check and balance the executive and the legislative. I'd like to see more justices stand up to the president (no matter what party the president is from). The president is not the supreme leader of our country, WE are the supreme leaders of the country.

He do not want to attend because Mr. Obama was and is correct about the dicision to allow money to flow freely into election. Alito is the one that's wrong and do not want to show his mug in the joint.
