Birthright Citizenship Under Fire From Lawmakers In 14 States

PHOENIX — The state senator in Arizona who wrote the nation's toughest law against illegal immigrants said Tuesday he's collecting support across the country from legislators to challenge automatic U.S. citizenship to the children of illegal immigrants.

Arizona state Sen. Russell Pearce's target is the 14th Amendment, but it is unclear how the state lawmaker can or will influence a federal statue.

"This is a battle of epic proportions," Pearce said Tuesday during a news conference at the Arizona Capitol. "We've allowed the hijacking of the 14th Amendment."

Pearce declined to say how the legislation will differ from similar measures that have been introduced in each two-year congressional session since 2005. None of them made it out of committee.

He and another Arizona lawmaker did argue that wording in the amendment that guarantees citizenship to people born in the U.S. who are "subject to the jurisdiction" of this country does not apply to the children of illegal immigrants because such families don't owe sole allegiance to the U.S.

The efforts by Pearce and the other lawmakers come amid calls to change the U.S. Constitution's 14th Amendment. Supporters cite costs to taxpayers for services provided to illegal immigrants and their children.

Changing the Constitution is difficult.

It requires approval by two-thirds majorities in both chambers of Congress, an impossibility now because Democrats have the majority in both houses and most oppose such a measure. Even if Republicans gain power in November and legislation is passed, an amendment would still need to be ratified by three-fourths of the states.

Paul Bender, a constitutional law professor at Arizona State University, said if the lawmakers focus their argument on the "subject to jurisdiction" wording, they won't get very far because the founders only meant it to apply to the children of foreign diplomats born in the U.S.

"If the British ambassador and his wife have a child in the U.S., that child is not a citizen because he is not subject to the jurisdiction of the U.S. We cannot put him in jail, we cannot even give him a parking ticket," Bender said.

The 14th Amendment "could have easily have said you're a citizen if you owe your allegiance, but our Constitution doesn't say that," he said. "It says if you're born here, and you're not a diplomat's child, then you become a citizen, and that's the way its been for 100 years."

Carlos Galindo-Elvira, vice president of Valle del Sol, a Phoenix group that provides social services to community members and advocates for immigrants, said Pearce's interpretation of the amendment is an effort to "legitimize bullying babies."

He also questioned why lawmakers would focus on this issue rather than the country's economic woes and high unemployment rate. "All it does is split the country," he said.

Pennsylvania state Rep. Daryl Metcalfe, the founder of a national group of legislators critical of illegal immigration, said the 14th Amendment "greatly incentives foreign invaders to violate our border and our laws." He had a news conference Tuesday in Harrisburg, Pa., on the multistate endeavor.

The effort could run afoul of the language in the 14th Amendment and lead to a court battle over the constitutionality of the law. But Metcalfe said providing birthright citizenship to children of illegal immigrants is an "ongoing distortion and twisting" of the amendment.

Metcalfe's office said lawmakers in at least 12 other states besides Arizona and Pennsylvania said they were making their own announcements about working on the citizenship legislation. Those other states: Alabama, Delaware, Idaho, Indiana, Michigan, Mississippi, Montana, Nebraska, New Hampshire, Oklahoma, Texas and Utah.

Pearce was the main sponsor of a tough new Arizona law that would require police enforcing other laws to question people about their immigration status if there's reason to suspect they're in the U.S. illegally. It was to go into effect this summer, but a judge put on hold key provisions pending the resolution of a legal challenge.

Pearce also was the chief sponsor of a 2007 state law targeting employers who knowingly hire illegal immigrants.

Arizona Gov. Jan Brewer, who signed the 2010 law and who is championing the state's legal defense of it against a court challenge mounted by the U.S. Justice Department, was noncommittal when asked whether lawmakers should approve legislation on citizenship.

However, Brewer said she was "always concerned" by the possibility of involving the state in a court fight. "No one wants to be in court. No one wants to be fighting the federal government," she said.

Men who make statements like Rep. Curry Todd made,"immigrants can go out there like rats and multiply"-is nothing but a, racist statement, These men are W.O.R.M.S. "White Old Republican Men of the South" Sen. Russell Pearce and 99% of Republicans, Tea Baggers and their friends the KKK have to attack the 14th Amendment to save their majority vote. Even the term "anchor baby" is racist . These W.O.R.M.S are saying things right out of the times of slavery. When words of power only came from the slave owners,and overseers. Next these W.O.R.M.S. will tell single mothers that their newborns are not U.S. citizens. America is slowly turning back the hands of time-to a post reconstruction, and trying to "re-birth" the nation again. Maybe, just maybe right before our eyes, America's returning to this new age of, Jim, Jabbar and Juan Crow. I do believe when Mr Ryder wrote his story- "White America will be the Minority in the year 2050, the election of President Obama, made these W.O.R.M.S. begin this war of hate. W.O.R.M.S. have to maintain the power of the vote-to pass laws for themselves. They should stop all the illegal out sourcing, of our family saving jobs! Yep, guess I have to cut out the my Irish past, but then they were attacked so badly in 1800's they gave up Catholic Church and moved west, seems some haters never change much more then those they targeted, Irish, Chinese, Muslims, Black, Latino's, any handy target to stir up the lower end, usually to get votes as souls not as important as ballots?

Any change to birth right citizenship will happen like this. Anyone born in the US must have at least one US parent to be born a US citizen. This will become effective 31 Dec 2010 being the cutoff date. Anyone born born in the US as of 1 Jan 2011 who does not have at least one US parent is a citizen of the country of which their parents are.

the corrections are rather easy......something like this:

All persons born of at least one person legally within the borders of the United States or naturalized in the United States, and subject to the jurisdiction thereof (except those born of parents representing a foreign government), are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.

Your suggestion for the "one parent" is a good idea, the problem is it will never pass, the issue with citizenship, work visas, visitor visas, documented and undocumented immigrants, they all have too much influence in the political arena of America. Politicians pander to these people for votes and that is not going to change, and Heads of State where those people come from have influence over the American Government.

The free benefits offered and given away are magnets that attract and keep people coming to this country and they are not about to leave. America has become a geographical location for anyone to come - this country is no longer a Sovereign Nation. All of us might as well get use to that. Immigration laws will not be amended to address the problem, and 10's of millions of people are not going to leave nor will they be deported. American politician will provide amnesty to people living in this country illegally. It time to become bi-lingual.

The 2011 congress can pass a law that forbids the legalization of any immediate family members of any anchor baby along with a requirement for immediate and unconditional deportation upon the illegal being found.

This leaves illegals with a choice – come to America have a family and forever relinquish any option of ever becoming US citizens or follow the legal procedures from their own country. The anchor baby issue is then made moot, because the family of the anchor baby will be forced into a decision of either leaving the anchor baby or taking the anchor baby back to their home country. Of course, when the anchor baby is grown, he can return to the U.S., but the multiplier effect will have been broken.

So what happens when the benefits run out? When there is no more social security, welfare, unemployment, medicare, medicaid? When the population reaches 600 million and there are a more little jobs then there are now. Do you think something will be done then?

How about 900 million? What will the country look like then? The movie road warrior? There will be armed towns that will have food, water and services for the people who live there and won't be letting any new people in.

The 'anchor baby' bill would require a constitutional amendment, and frankly it'll never pass. But that's what the GOP prefers as a "wedge" issue: something that will never be resolved, so they can keep using it.

The R's do tend to hit hot button issues that appeal to the less educated, lower end, as they are more easily fooled, and as Hitler and others found out, more easily talked into targeting "others" and consider themselves the saviors of the nation, the "Ubers" among us, and it sure seems to working.. Perhaps R/Tea Klan should hold all "town hall meetings" in beer halls to reflect the 1930 Hitler's stuff more accurately, you know, "Uber chose race, only we are patriots, "THEY" (even used by KKK) are not like us and as such should be removed, cleansed, targeted, etc? Worked before and now USA is even to point where those that live not to far from where KKK started up in TN are back at it, demanding "Mosque not be built here as they are terrorist centers", kind of echoes "Jewish Temples must be removed-Germany 1930's? Same now for innocent kids born here, "Remove them as they are not "Ubers, only we are"?

I think most are smart enough to come to their own conclusion but I just wanted to get some opinions on this. Since we are talking about the 14th amendment, I think that we really need to revisit this once and for all It seems like two sides are interpreting what the meaning was behind the 14th amendment. One thing I do see is that nothing is written in stone as we do have a living constitution that is constantly being amended to meet our time and our situation today.

Well we can sit here and argue till we are blue in the face but one has to admit that we do have a problem that needs to be addressed. We have amended the constitution so people saying that it is written in stone is not correct.

what's the problem with revisiting this for clarity?

Fortunately, there is one simple solution that circumvents the time and difficulty surrounding amendment of the Constitution.

A new congress can merely pass a law that disallows legalization FOREVER of any and all members of the families of any anchor baby along with a requirement for immediate and unconditional deportation upon discovery. Add to this a requirement that no illegal can EVER become an American citizen.

This leaves illegals with a choice – come to America and forever renounce any option of becoming citizens or follow the legal procedures.

It also renders the anchor baby issue moot, because the family of the anchor baby will be forced into a Hobson’s choice of either leaving the baby or taking it with them back to their home country. Of course, when the anchor baby is grown, he can return to the U.S., but the multiplier effect will have been broken along with the invasion itself.

Or for the racists among us that are suddenly more upset with "illegals taking jobs and getting welfare" then they are "well of getting huge tax breaks and companies getting same for shipping jobs offshore", well for that crowd, perhaps the solution might be as suggested in a book a very long time back, simply cut the child in half and divide it between USA and other nation? That would probably satisfy the needs of those using "illegals" as hot button issue while shall we say USA like Rome, burns while the government fiddles?
