Lisa Murkowski Rejects Joe Miller's Vote Fraud Claims

JUNEAU, Alaska — Sen. Lisa Murkowski maintained a healthy 90 percent of the write-in vote in the Alaska Senate race Friday, even as election officials threw out a number of oddball entries like "Donald Duck," "Elmo" and "Revolt."

Murkowski said she feels "pretty good about the direction" the vote count is headed and expressed confidence that she'll pull off an improbable write-in victory over Republican nominee Joe Miller.

As of late Friday, the state had recorded 98,565 write-in votes and 87,517 votes for Miller, with thousands of absentee ballots still outstanding. Murkowski has been getting about 90 percent of write-in votes. Another 7.6 percent have been apparent votes for Murkowski that have been challenged, generally by observers for Miller for things like minor misspellings or penmanship issues.

The hand count is scheduled to go through the weekend and run well into next week to determine if Murkowski got enough write-in votes to win.

Murkowski's seeking to make history and become the first U.S. Senate candidate since 1954 to win a write-in campaign. She mounted her outsider bid after losing the GOP primary to Miller in August.

In a Friday interview with The Associated Press, on the third day of the write-in ballot hand count, Murkowski said she's offended and angered by some of the challenges that observers for Miller are making to ballots for her.

While Miller's campaign maintains it's only challenging ballots that don't meet the strict letter of the law, including those with misspellings, Murkowski believes it was the intent of Alaskans in those cases to vote for her, and accused Miller of desperately grasping at straws.

Miller is suing to ensure the state is held to the law, which calls for write-in ballots to have a write-in oval filled in and either the candidate's last name or the name as it appears on their declaration of candidacy scrawled in – in this case, either "Murkowski" or "Lisa Murkowski."

The state has been using discretion to discern voter intent, pointing to prior case law as their basis in doing so. Murkowski supports this, saying she wants the voices of all Alaskan voters heard.

Chip Gerhardt, a Miller observer and attorney sent to the state by the National Republican Senatorial Committee, noted that Murkowski focused much of her campaign on telling Alaskans how to properly cast ballots for her, urging them to fill in the oval and write "Lisa Murkowski." She even had wristbands made to that effect.

He said Miller observers are being told to challenge ballots with misspellings, extra words, improperly filled in ovals and her name written below the write-in line.

The campaign is ceding nothing, believing it has a shot at making this a tight race if Miller gains ground once absentee votes are tallied and if their write-in objections are upheld.

"We're just going to see it through to the end," Miller spokesman Randy DeSoto said.

The Miller campaign sued in state court Friday, seeking access to lists of registered voters from certain precincts around the state. The campaign wants to count and inspect the signatures of those who signed up to vote "to ensure there was no possible fraud, mistake, irregularity or inconsistency."

It also has set up a voter fraud hot line. And Floyd Brown, the strategist behind the infamous Willie Horton ads in the 1988 presidential campaign who also is described as a Miller adviser, raised the specter of voter fraud or voting problems but offered little in the way of proof to support those claims.

Murkowski wasn't sure whether the election's results would end up decided by a court. She said that decision will depend on the advice Miller gets from his advisers and rest with "whether or not Miller recognizes that, mathematically, this doesn't add up."

This is the LAW:

A vote for a write-in candidate shall be counted if the oval is filled in for that candidate and if the name, as it appears on the write-in declaration of candidacy, of the candidate or the last name of the candidate is written in the space provided. (b) The rules set out in this section are mandatory and there are NO ...exceptions to them.

We saw with the dirty tricks campaigns of Karl Rove that he doesn't just use them against Democrats; he, and those like Rove, are more than willing to use dirty tricks against people in their own party who dare oppose them. It would appear that Mr. Miller studied Rove's play book, and is slinging mud and dirty tricks any which way he can if he thinks it will help him to get elected.

Only when one thinks of the Tea Party as GOP. Obviously, the voters of Alaska saw a big difference between a GOP intimidated by the Tea Party to choose an ethically challenged bully and the Republican candidate they wanted.

Clearly Miller's strategy is to challenge that margin of write-in ballots that would give Murkowski victory. When the election board finishes up and refuses to reject ballots that are challenged, but clearly indicate Murkowski as the candidate, Miller will appeal the election outcome in court and drag the whole thing out, hoping she'll give up.

We already knew Miller was a creep. Now we know he's got big money backers willing to spend on this sleazy, election-stealing tactic.
The only hope is that the courts abandon their usual "we're so important we'll get around to this later" attitude and ram one denial after another up his writ so the whole thing gets telescoped down to a short time period.
And Lisa? Announce now you'll file suit against Miller for fomenting frivolous litigation and will demand he pay your expenses if you win. Use every tool out there to crush this humbug.

Miller is a lingering cancer out to make more spoils in the recent Alaska Senate rep elections. What I would like to say is were there numerous Murkowski candidates that makes things so complicated to direct a voter's choice of a Lisa without Miller actually reeling from a whimpy pandering loser?

As a lawyer, Mr. Miller knows, or should know, that the first rule for determining intent is to look to the words chosen by the writer. The words "Lisa M." or "Liza Mercowsky" or "Murcowski" all have the same meaning to a rational person, and reflect the voter's intention to cast a ballot for Sen. Murcowski. All of the rest of his arguments, particularly the "protest vote" theory, are simply nonsense.

The writing is on the wall (or on the ballots)....Joe (Handcuff 'em) Miller is DONE. Mrs. M can be called the come-back kid for sure. Will Miler ask for a recount? Republicans ALWAYS ask for a recount hoping for an earthly "miracle". But ol' fighting mad Joe may not qualify for any miracles at this time. Sarah's "juice" did not work for him. I'm a Democratic leaning Independent and I, if I were an Alaskan would have voted for Mrs. M.

I was a Democrat leaning Independent for many years, simply because I often vote Republican. I'm from Maine and always vote for Collins and Snow. This year the foolishness from the right has pushed me farther to the left, and I have decided I'm a Social Democrat like Bernie Sanders.

learnsomething: For some reason I like wearing the Independent Hat. Gives me the feeling that I'm holding the deciding vote. Know what I mean? For instance, Given the choice between a very bad Republican candidate and a mediocre Democrat...the Democrat gets my vote. Given the choice between a Very Good Republican and a Very Good Democrat...the Democrat, gets my vote. AND given the choice between a Doofus Democrat and a wise, non-partisan Republican I will definately go for the REPUBLICAN. If the Democrats had a Sara Palin running for President, guess who I will be voting for? There it is, kemo-sabe. ;)
