WASHINGTON — Judges who hear Social Security disability cases are facing a growing number of violent threats from claimants angry over being denied benefits or frustrated at lengthy delays in processing claims.

There were at least 80 threats to kill or harm administrative law judges or staff over the past year – an 18 percent increase over the previous reporting period, according to data collected by the agency.

The data was released to the Association of Administrative Law Judges and made available to The Associated Press.

One claimant in Albuquerque, N.M., called his congressman's office to say he was going to "take his guns and shoot employees" in the Social Security hearing office. In Eugene, Ore., a man who was denied benefits said he is "ready to join the Taliban and hurt some people." Another claimant denied benefits told a judge in Greenville, S.C., that he was a sniper in the military and "would go take care of the problem."

"I'm not sure the number is as significant as the kind of threats being made," said Randall Frye, a judge based in Charlotte, N.C., and the president of the judges' union. "There seem to be more threats of serious bodily harm, not only to the judge but to the judge's family."

Fifty of the incidents came between March and August, including that of a Pittsburgh claimant who threatened to kill herself outside the hearing office or fly a plane into the building like a disgruntled tax protester did earlier this year at the Internal Revenue Service building in Austin, Texas.

A Senate subcommittee is expected to hear testimony on Monday at a field hearing in Akron, Ohio, about the rising number of threats, as well as the status of the massive backlog in applications for disability benefits, which are available to people who can't work because of medical problems.

Nearly 2 million people are waiting to find out if they qualify for benefits, with many having to wait more than two years to see their first payment.

Judges say some claimants become desperate after years of fighting for money to help make ends meet.

"To many of them, we're their last best hope for getting relief in the form of income and medical benefits," said Judge Mark Brown, a vice president of the judge's union and an administrative law judge hearing cases in St. Louis.

While no judges were harmed this year, there have been past incidents: A judge in Los Angeles was hit over the head with a chair during a hearing and a judge in Newburgh, N.Y., was punched by a claimant when he showed up for work.

In January, a gunman possibly upset about a reduction in his Social Security benefits killed a security guard during a furious gunbattle at a Nevada federal courthouse.

About 1,400 administrative law judges handle appeals of Social Security disability claims at about 150 offices across the country. Many are in leased office space rather than government buildings.

Brown said the agency provides a single private security guard for each office building that houses judges. Frye said he has sought more security and a review of the policy that keeps guards out of hearing rooms. He said Social Security Commissioner Michael J. Astrue has promised to look into it.

Social Security Administration spokeswoman Trish Nicasio said the agency continually evaluates the level and effectiveness of office security and makes changes as needed.

"We are taking appropriate steps to protect our employees and visitors while still providing the level of face-to-face service the public expects and deserves," Nicasio said.

Visitors and their belongings are screened before entering hearing offices and hearings room, she said, and reception desks are equipped with duress alarms to notify the guard immediately of any disturbance.

If you read the SSDI site, over 3 in 10 will collect benefits in their lifetime.

SSDI seems to be an area that does need better enforcement as many multi-millionaires, who no longer plan to work anymore collect SSDI as supplemental income. There was a Congressional Hearing about a Bush era appointed social security adm. judge for the Houston Texas Region who later testified (saw it on CSPAN) that due to his political beliefs would never approve disability for anyone. I believe he was removed. Some of these folks may have legitimate complaints.

Many of these cases should have never reached this level. SS has a set policy of denying nearly all claims, regardless of merit, at all levels of administrative appeals up to a hearing in front of a judge. The hope is that some claimants will die before collecting and many others will simply give up.

This has the effect of overloading the judges dockets. If the SS administration actually did their jobs this problem would be much smaller.

Absolute, utter nonsense. Where do you get these crazy ideas? Here is the data for my state for 2009:
In Maryland in 2009 63,103 applications were submitted and 37.3% were allowed at the initial level (which comes out to be 23,348 claims)…that means that 23,348 people last year were allowed benefits the first application/try. This was without the help of a lawyer because the lawyers are not involved at the initial level. So almost 40% were allowed!

Other states were similar. This is the last post I am going to make on the matter. If you readers want to keep thinking that "everybody is denied the first time" or "there are quotas" or "that all claims are denied regardless of merit," that is your problem. It just ain't so.

Oh yes it is. Just talk to anyone who works processing first time claims for Social Security benefits. I know people whose cases were pretty cut and dried but yet got denied.
I also know a worker whose job it was to deny every claim that came across their desk. They HATED their job and had to quit.
So whatever fantasy land you are living in, Bandob, you simply don't have any first hand evidence, only the numbers you got off of the internet.

When Reagan came in with all of his fake facts (welfare spas and other canards), he instructed his folks to deny all social security claims for disability. My father had bone breaking cancer and had never taken a day of unemployment or welfare, but he was denied disability payments, making his last years more painful than they should have been.
The idea that Republicans love to push is that people are lying. They see themselves, apparently, in such issues as abortion on demand and use clever quote fingers when they say, "Life of the mother," "incest," or "rape." Clearly, if they wanted one, they'd argue the unwanted baby was the product of such lies.
The energies these judges bring to the vetting of disability claims is breathtaking. If we only had the same sort of energy applied to white collar crime, corporate malfeasance, and all the other persistent frauds Matt Taibbi calls our Grifter Society.

when you have medical doctors who say a person is disabled, but then a judge can get the final call? I can understand it. There was just a Rethug senator on Faux a few minutes ago who said that there are a whole lot of people on disability that should not be, and they need to be removed. Problem I have with his statement is
1: what does he base his claims on?
2: what gives him the right to decide what is considered disabled?

I personally know more than a few people who are disabled, and I dont know one who is faking it. I do know everyone I am friends with would give anything not to need disability. Its humiliating, it makes it hard to get off of without totally quiting, and they you have nothing to even pay for the medication you need to survive. I can not imagine many people who want to try to survive on 750 a month and the ridicule and humiliation. But between employers who wont hire disabled , and yes there are laws but just like with taxes there are many ways around that too]

Social Security judges today, banking officials tomorrow. People will look to violence as the only response left. Government takes no action until a situation is out of control. When bank officials are being killed, and governments representatives are being attacked, only then will congress take action to quell the multitudes of people being taken advantage of by big business. Government in this country is controlled by big business! Our elected officials live off big business. How rich exactly do these folks have to become?

In the song, Hey Brett--you know what time it is, Cracker speaks of the new feudalism where the people who dug the ditches, built the cities, and picked the fruit from the vine are discarded in favor of a new feudalism.
Brett, a friend had asked if they'd let us know if it was time to drag the rich from their limos and beat them or worse. African Americans received a lot more notice and relief when they took their ills without lying down, rioting in the streets. They knew what time it was.

I could almost, almost,almost go along with the argument that everyone just has to try and take care of themselves. That's what the republicans want, no safety nets whatsoever. Everybody on their own. I could almost go for that because I live in TX and you're not getting anything here. I could almost, almost go for it except that the governement HELPS EVERYBODY ELSE. Why everybody else and not our own people?!! Big oil companies and businesses - pay no taxes, they have exemptions and waivers. Exxon Mobil pays NO taxes. GE, pays NO taxes. Banks- bailed out. More tax cuts for the rich - sure! perpetual aid to afghanistan - no problem. piddly benefits for an unemployed, disabled american? - GO TAKE A HIKE! And they wonder why people are driven to desperation?!

considering the tea baggers and neo cons want to go back to the good old days, I find it hypocritical they completely ignore the fact that the United States was build on people helping each other. Be it through the gov or community services, or neighbors helping neighbors, this country wouldn't even exist if people had not helped each other, and those less fortunate. But tea baggin rethugs want an all for themselves and winner takes all policy, where the sick, disabled, elderly and poor are pushed out of sight, out of mind. Just so they can have more. Strictly amazing , especially most of these anti anyhelp for fellow human beings people claim to be Christians, the religion that preaches social welfare and helping each other.

you know if they do cut entitlements they wont cut collecting the SSI tax. They only want to cut outgoing cash so they can use it for their own personal projects. Like welfare for the rich and corporations.

This is truly shameful. Giving people who are hurting a hard time over such meager compensations - like making them wait for years and by default denying first application etc - while at the same time generously squandering away our nation's wealth on bailing out banks, giving tax breaks to millionaires, waging fraudulent and unnecessary wars and over-compensating Congress members. Shame on this country and shame on all those who support such policies. The last election where people voted for tax breaks and ultimately the benefit of the rich, wealthy and powerful has shown me that no nation is immune to gross manipulation or sheer stupidity. Dont ever forget that Hitler was ELECTED into office, given more power than an absolute monarch, BY THE PEOPLE. Hitler didnt seize power in '33. The best way to control people is make them believe that they are in charge, that they have a say. This is exactly what is happening in this country only that we dont get it, because people are not being directly sent to concentration camps, just indirectly killed by enacting horrendous polices and officials who implement them.

Does anyone ever check on all those handicapped kids tha were adopted overseas and brought to the USA ?

Did they adpot those kids just to get the $ 900.00 a month check drom SSI to make big house payments ? Are the kids in a basement somewhere locked away ???????

not really defective but it is scammed a lot and those who are caught really get the book throw at them .
Rules though prevent anyone from reporting just the name of someone who is scamming the system without a SS # they won't even move on a report.

I have checked out a lot of the rules and someone it seems has changed laws to make finding the fraud harder .

So this is just for SS Disability claims. Wait till they mess with folks who have worked there whole lives and submit for receiving SS and are told they have failed the "Means Test" or you have to work more years after being given notices every year on what you have currently paid into SS and what you will receive at 62, 66, and 70. If folks are fighting for Disabilty this way hopefully folk will fight more violently if they try to distroy SS.
