Nationwide Title Clearing, a Palm Harbor company at the center of the nation's robo-signing controversy, is going on the offensive against its critics.

On Wednesday, the company sued a St. Petersburg foreclosure defense lawyer, Matthew Weidner, for alleged libel and slander.

The best defense is a good offense, and I find this company very offensive. Now they will have to prove not only that the statement is untrue "which it is not" and that the defense attorney knew them to be untrue (which he doesn't). This is a scare tactic, I hope the mortgage company has poked the wrong shark.

The law says what the law says. There is no "libel and slander" defense possible if the person who is speaking words that you do not like to hear, believes or feels that he has cause to believe that what he is saying is true.

As a true conservative, I recognize that Republicans are responsible for foreclosures. They support bank scams because their allies profit. Thank God for Barack Obama and the Democrats. For the first time in my life, I'll vote straight Democrat in 2012. God wills it.

Ummm Karla?

You need to look carefully at the Bank Regulatory Bill and what it actually achieved, also take a peek at what the Health Care Bill will really do after 2014, not what the Repugnants say it does, but what it really does.

Then investigate the original Stimulus Bill and see how much was real tax breaks for the Middle Class and for small business and how much went to produce real investments in future clean energy (a sector now growing faster than any other because of that bill) and realize that most of the new tax deal "O" has agreed to entrenches those well though structures going forward.

Like you, I see too much ongoing Bush Policies especially as to wars and "security" and am disappointed in BOs lack of fight and leadership, but there ARE fundamental REAL differences and advances that have been made by DEMOCRATS, even in the face of the PIGS doing the just say NO thing.

If we are ever to be free of TRICKLE DOWN insanity our only current hope is the Democratic Party.

I want more choice and improved choice and other Parties as well.

But right now the Repugnants have not one good thing to offer America. Not one.
They will tear at, and rip at, and try their best to render even more of the Benefits of Our Union up to their Corporate Masters as they reach to rob us of SSI and Medicare.

Possibly NOT in Florida where there are indications that portions of the judiciary might have been bought and paid for by the foreclosure mills! Read some of the Florida AG's deposition transcripts in the mortgage foreclosure fraud investigation. It is readily apparent from the questions that the Florida AG is pursuing public dorruption aspects of the investigation.

I DO agree that Mr. WEIDNER will be just fine on appeal, although he may have to get the matter into U.S. Court to be assured of justice.

The Oklahoma Court of Appeals has handed MERS another major defeat in its decision in the case BAC Home Loans v. White. The case was filed on December 3, 2010, and has been released for publication, but at the date of this post hasn't yet been officially published. Neither is the text of this decision yet posted at the Oklahoma Courts web site, though the disposition IS noted on the Docket:

Though the Court expressly rejects the theory that MERS could be an owner of a bi-furcated mortgage, thereby presumably setting aside the possibility that a holder of the note might have an unsecured debt, the ruling would seem to indicate that any of the forged mortgage assignments commonly fabricated for use in evidence in Oklahoma are NULLITIES.

Thanks for the update. I have been following this case. When talking with the Texas AG and questioning the standing of MERS to foreclose, the AG is reluctant to opine. The mere separation from a DOT or mortgage from the note should concern everyone. Those who are able to pay their mortgages as well as those who cannot. If the security (DOT/mortgage) of the promise to repay the debt has been separated. every homeowner in America should be concerned.

Nothing within the posted video depositions is suggestive that either intellectual ability or even attempts at thought are prized at Nationwide Title Clearing. To the contrary, it would seem as though the ideal robo-forger is probably a person who will reliably show up for work and conscientiously follow instructions, but who is sufficiently dimwitted and dull as to afford a fairly credible defense that their stupidity ought to immunize them from criminal responsibility.

I'd bet good money that if this were a case before our right leaning Supreme Court justices, St. Petersburg foreclosure defense lawyer, Matthew Weidner, would lose and Nationwide would win.

Robo signers have the full support of the GOP, that is why no government action has been ,or will be, taken against them. after all, government IS the problem and interfering in free enterprise is socialism, unconstitutional, verboten. Profits, profits, profits my firends. They drive everything this country has come to stand for, defend, and impose on us. Pure, unfettered mercantilism. Great for predators, terrible for the prey. In america, just work hard to become a predator and the American Dream comes true.

The best defense is a well-funded offense: WHY have these robo-signing companies and their employees not been hauled into court for perjury, fraud and contempt?

In signing the papers, they assure the court that they have examined and approve the contents of the foreclosure suit. They didn't do anything other than sign it.

We homeowners have been wondering why after academia expose, after attorney exposes these criminals are still walking the streets. We have determined there is only one reason.....we have a criminal enterprise in our government and our judicial system that works for the big banking institutions. NO. OTHER. REASON.
