EAST HAVEN, Conn. — Santiago Malave has worked law enforcement jobs in Connecticut for more than four decades, but as a Puerto Rican, he says he cannot drive through his own town without worrying about police harassing him.

Malave, a probation officer who works in New Haven, says the racial abuse is so bad that he only crosses the town line into East Haven to go home. He and his wife are now preparing to sell their house and move, joining an exodus of Hispanics who say police have hassled them with traffic stops, false arrests and even jailhouse beatings.

The Justice Department has started a civil rights investigation, and the FBI recently opened a criminal probe. But that has not changed things on Main Street, where restaurants and stores that cater to Hispanics are going out of business.

If the goal of police was to ruin East Haven's Hispanic community, some grudgingly say they have succeeded.

"We can't tolerate the town anymore," said Malave, 64. "For us to leave our beautiful home is something that hurts, but we can't deal with these people."

Racial profiling allegations began swirling about two years ago in East Haven, a predominantly Italian-American seaside suburb of about 28,000 people 70 miles northeast of New York City. Hispanics make up only about 7 percent of the population, but their numbers had been growing as the peaceful, small-town setting and thriving businesses attracted newcomers from Mexico and Ecuador.

Police Chief Leonard Gallo, who is on administrative leave, has denied the allegations. The office of acting Police Chief Gaetano Nappi referred calls to Town Attorney Patricia Cofrancesco, who did not respond to phone messages seeking comment.

Hispanic business owners say police made a practice of parking outside their shops and stopping any Latinos. Some who complained say they faced retaliation.

Luis Rodriguez, an immigrant from Ecuador who owns the Los Amigos Grocery, said he was arrested two months ago and jailed for five days after a woman pointed out to police that his 3-year-old son was unsupervised on the sidewalk outside the store. He said police were out for revenge because his wife had been videotaping them. He was charged with child neglect; the case is still pending.

Meanwhile, his store is up for sale. Ecuadoreans used to travel from as far as Massachusetts for jalapenos, Ecuadorean sodas and other specialty products. But Rodriguez said police have scared customers away by threatening to alert immigration authorities if they ever saw them in town again.

"If I had known the police in East Haven are so much trouble I never would have invested so much money here," said Rodriguez, 41, who has put more than $120,000 into the store.

The Justice Department's civil rights branch began investigating the police force in September 2009. It is still looking into alleged discriminatory policing, but it identified preliminary concerns in April over issues including outdated policies and a lack of clear guidance on the use of force.

The town's mayor, April Capone, revealed this month that the FBI was gathering evidence for potential criminal prosecutions of some of the officers. Her office declined to comment.

Dermot Lynch, a student intern with Yale Law School's Worker and Immigrant Rights Advocacy Clinic, said the problem goes beyond a few rogue officers.

"This is a systemwide leadership failure. It's going to need widespread reform," said Lynch, whose group filed a lawsuit in October on behalf of nine immigrants who say East Haven police abused them with beatings and unwarranted use of a stun gun. It also quotes officers using ethnic slurs.

Until recently, East Haven was considered a refuge by Hispanics, a suburb with ample parking and less crime than New Haven.

Malave, who has lived here since 1977, said he never had problems before late 2008 when police responded to a report by his wife that some money was missing. The couple had begun to argue. Malave, who was asked his nationality, said police arrested him for disorderly conduct the minute he said he was born in Puerto Rico.

"I tried to talk to the sergeant, but he said, `You spics don't have rights here,'" said Malave, a former New Haven police officer.

Hispanics in East Haven say more than half their population – estimated at 1,900 by the Census Bureau – has moved away.

Mario Marin, who was at work one recent afternoon in his family's empty restaurant, La Bamba, said two of his siblings moved to nearby Waterbury and another brother returned to Ecuador. He said one brother, like other Hispanic property owners, lost a house to foreclosure after his tenants moved away.

"They destroyed our future here," Marin said of police. He said even out-of-town diners have stopped coming since officers launched raids on the restaurant's parking lot, towing away any cars with out-of-state license plates.

Marin and others said run-ins with police have been less common since police came under federal scrutiny. But activist John Lugo of Latinos United in Action, who helped organize a march against racial profiling last year, said his group still advises Hispanics to steer clear of East Haven.

So many of my friends are always trying to tell me that the racism is decreasing in America but stories like this never surprise me. Just because we have a black president doesn't mean jack sn ot. Most racists are in the cl0set due to their job or position in society. It appears to me that Hispanics are becoming the new Black these days and as usual, only a part of the group is responsibl­­­e for problems but the entire race takes the blame. As a Black/Pana­­­­manian women, racism nor sex!sm has never really b0thered or surprised me. I choose not to indulge myself in the !gnorance of others. I guess I was desensitiz­­­­ed growing up in a small, predominan­­­­tly white country town in Tennessee. I just say ehh, f unk em.

Here in Western NY we have Italian-Americans & Arab-Americans who could pass for Hispanics. Lucky we don't profile in WNY.

I must say, a class action civil rights suit seems to be warranted......there should be some savvy lucky lawyers out there who can make a boatload off this..and hopefully get some monetary restitution for these business owners. If the FBI and Justice Dept is investigating, then there seems to be cause somewhere in there. Jailed for 5 days for child neglect? What is that, I don't' understand how the law applies here, but it seems like a good starting point for a lawsuit.

I've been reeeeeally trying not to respond to this article but...

These are Blue Collar folks. They are Italian/Irish/WASP mix. They are bigots who will tell you straight to your face what they think and want. The last mayor was ousted in no small part for not running Hispanics who settled in right back out of town. I have never seen a black face anywhere in East Haven.

This culture of bigotry starts in the New Haven Annex (Eastern Shore) and runs up the coast into Boston. Like most of Southern New England, it is a very segregated society. Socio-economic discrimination - facilitated by Zoning Laws - is another tool used by folks to keep "The Others" out.

Guess they learned from the European settlers. Since you seem to be living in the past, it shouldn't be that hard to grasp. Also, it's kind of hard to know you're 'vocally implored to leave' before you actually move there, but I wouldn't expect that kind of logic to be comprehended by you.

I had thought we were witnessing the end of the age of sundown towns in this country. But a new wave of immigrants has called forth a new wave of ethnic hatred. Bigotry lies just below the surface of the American character, waiting to be stirred by the Brewers and the Tancredos and all of their ignorant brethren who view fear as the best stimulus for attracting political support. We will cross this divide, but not until many people have been hurt and the demagogues have either died or been shamed into grudging silence.

Even as we write there is an African American family in the White House, and the diversity of the US population is increasing rapidly in all corners of the country. There are fewer and fewer places for racists to practice their beliefs openly and with full support of a large majority of the local citizenry. Racism is a belief that is dying out, but its last adherents are putting up a fight in the vain hope of preserving the dark and narrow world they know and, unfortunately, love.

Please don't mistake the increase in diversity for an increase in tolerance. Unfortunately, many of our brown immigrant brethren are just as racist as their white predecessors.

I remember hearing a past president of the NAACP say that it was impossible for a black man to be a racist and I just burst out laughing

Do you believe LaRaza ~The Race~ is not a racist organization I mean the irony is just amazing They demand special treatment for Latinos and anyone who disagrees is a racist

Do they advocate for the illegal Irish to get in on the amnesty as well or is this Latino only

Do you honestly think racism isn't prevelent in all cultures somewhere

Illegal is not a race and to try and frame this as a race issue is complete hypocricy and shows who the true racists are in this argument

But as far as the article goes I've seen this type of behaviour plenty in all cultures

I have worked on 3 continents 7 countries and 15 states in all types of enviroments and you can always find the racists easy and they come in all sizes shapes and gender regardless of skin color

And personally I can't stand to be around them

i tell you my friends...i was born in parlemo in southern italy....and the racism in italy is beyond words...italy and spain are very very very racist countries....so to see italian americans act this way towards latinos wont surprise me....i was the only black kid in my neighborhood but i saw a lot as a kid...i aint going back

one of my professors (back in the day) also is Italian--the way she tells it, I would have to agree with you. Having experienced it, I'd love to know how the two countries differ in these respects. In many spanish countries the racism is really radically different than what I've experienced here. but it is hard to explain.

Your statement smacked of hyperbole, so I ran a quick check by googling "civil rights investigations under Bush". The first hit is a NYT article covering that very point. From what I could glean from that article, civil rights enforcement activity by the Justice Department did decline under Bush compared to the Clinton administration. Looks like they pursued perhaps half of the number of cases. And enforcement has increased under Obama. Read the article here:
