Issa Starts Probing Obama Administration, Homeland Security Handling Of FOIA Requests

WASHINGTON — A House committee has asked the Homeland Security Department to provide documents about an agency policy that required political appointees to review many Freedom of Information Act requests, according to a letter obtained Sunday by The Associated Press.

The letter to Homeland Security was sent late Friday by Rep. Darrell Issa, R-Calif., chairman of the House Oversight and Government Reform Committee. It represents an early move by House Republicans who have vowed to launch numerous probes of President Barack Obama's administration, ranging from its implementation of the new health care law to rules curbing air pollution to spending in Iraq and Afghanistan.

The Associated Press reported in July that for at least a year, Homeland Security had sidetracked hundreds of requests for federal records to top political advisers to the department's secretary, Janet Napolitano. The political appointees wanted information about those requesting the materials, and in some cases the release of documents considered politically sensitive was delayed, according to numerous e-mails that were obtained by the AP.

The Freedom of Information Act is supposed to ensure the quick public release of requested government documents without political consideration. Obama has said his administration would emphasize openness in providing requested federal records.

According to Issa's letter, Homeland Security's chief privacy officer and FOIA official told committee staff in September that political appointees were simply made aware of "significant and potentially controversial requests."

Mary Ellen Callahan told them that political appointees reviewed the agency's FOIA response letters for grammatical and other errors and did not edit or delay their release, the letter states. She also told the committee that Homeland Security abandoned the practice in response to the AP's article, according to Issa's letter.

On Sunday, Oversight panel spokesman Frederick Hill said Issa sent the letter "because the committee has received documents that raise questions about the veracity of DHS officials" on the matter. He did not elaborate.

Issa asked the agency to provide the documents by Jan. 29.

Homeland Security spokesman Matt Chandler said Sunday that his agency reduced its backlog of Freedom of Information requests last year by 40 percent, and has handled more requests for records than any other agency. He said the department follows Obama administration policy and has not withheld or edited any records that agency lawyers considered appropriate to release.

Chandler also said Callahan did not tell Issa's committee that the policy had been changed because of the AP's story.

Last summer, officials said fewer than 500 requests were vetted by political officials. The department received about 103,000 requests for information in a recent 12-month period.

The agency's directive said political appointees wanted to see FOIA requests for "awareness purposes," regardless of who had filed them. The AP reported that the agency's career employees were told to provide political appointees with information about who requested documents, where they lived, whether they were reporters and where they worked.

According to the directive, political aides were to review requests related to Obama policy priorities, or anything related to controversial or sensitive subjects. Requests from journalists, lawmakers and activist groups were to also to be examined.

Under a new policy last summer, documents are given to agency political advisers three days before they are released, but they can be distributed without those officials' approval.

So Rep. Issa, from the New Yorker article, seems like a guy with a pretty shady/questionable past who is fond of saying "I didn't do it, that other guy (i.e., brother, former business partner, etc.) is responsible." Outstanding. Just the kind of guy who should be in charge of the Oversight committee. And his witchhunt will be another expensive waste of time like we experienced during the Clinton Administration. And that's what is disheartening...the committee and these congresspeople will be wasting our time and money on mythical corruption instead of doing what they were elected to do...lead and govern.

I don't think a lot of people understand that, at this point, as far as the outcome of this investigation is concerned, it doesnt' matter about Issa's background.

He's going to investigate Obama on anything he can in the hopes it will open up his reasons for investigating other areas of his life, including his personal life.

The goal is to get something impeachable that they can use before the 2012 elections. If they can disempower Obama by impeachment and whatever bad stuff they may find, we will have a GOP House, Senate and President in 2013.

They have to do this in less than 2 years, so it isn't going to be refined or pretty.

When Clinton was being investigated, I worked my tail off researching and defending him. I spent weeks in Arkansas visiting old depositories of records, and found some very interesting information. One item alone proved one thing the right was accusing Clinton of could not possibly have been true.

But I won't lift a finger for Obama. He alienated his 2008 voters and may Democrats did not show up to vote in 2010, so the GOP gained the House. That's all they needed to start a taxpayer-funded hunt on Obama, like they did with Clinton.

This was predictable and didn't need to happen. It's a waste of resources to defend a politician who so arrogant/irresponsible that he didn't think what happened to Clinton would happen to him if the GOP gained the House.

But just like with Clinton's presidency, Obama is deserving of your help. Obama may have alienated a lot of us Democrats, but that doesn't mean he should sink. I don't know that Obama was really playing the arrogant/irresponsible card by assuming he couldn't end up in the same position as Clinton. I think that the forces arrayed against Obama, such as the formation of the Tea Party, were actions no one would have or even could have predicted. Who knew that the virulence of the Right's hate of the new African American president would be so harsh that it could convince a sizable electorate to literally believe the lies about his birth, the HCR (killing jobs and death panels), etc.

The Right-wing media machine was sent into overdrive and we really need to do all we can to counter-act its lies.

It never fails, the people that scream the loudest about crime and ethical behavior are usually the ones that have demonstrated unethical behavior and criminal activity. For instance, when former President Clinton was caught screwing around, Newt Gingrich, Vitter and a representative where loudly denouncing Clinton and demanding his resignation and indictment.

We later learned that Newt demanded a divorce from his wife who was in the hospital dying of cancer, Vitter was later caught up in a huge sex scandal based upon his involvement with a prostitute, and a Representative from Indiana had an 18 year old child out of wedlock that even his wife of many years was not aware of.

Perhaps someone should remind Darrell Issa that people who live in glass houses should not throw stones.

It appears that but for his millions Issa would be serving time in prison instead of Congress.

If you remember, the Clinton investigation started with Whitewater.

What the GOP wants is an excuse to open up investigations in other areas, especially Obama's personal life.

It was when Starr came on the Clinton investigation and couldn't find anything legit to hang an impeachment on that he was forced to start digging into the Clinton's personal lives.

That led to the Vince Foster allegations against Hillary.

I often wonder if Bill and Hillary decided to simply choose the N00kie gate accusations as a way to stop the investigations. Much better than them trying to hang mur.der on Hillary, which is waht they were trying to do at one point.

In 2008, the political establishment was demanding "retroactive immunity" for telecom execs who broke the law by complying with some of Bush/Cheney's more outrageous demands. Now, the Republicans are applauding Issa's intended Javert-like pursuit of Obama, trying to give him 20 years if they can pin anything as little as stealing a loaf of bread on him.

And to think this is the party that always whines about the media being biased against them--do you see them telling Issa to stop giving this enemy so much ammunition?

Let Bill Clinton's impeachment be a lesson to you. The country and the congress were immersed in that for MONTHS and MONTHS. Coming into office with a country in shambles from years of republicans in control then going into investigative would have taken time an energy away from getting this country back on track. Get a clue...the republics will surely reap what they sow so just sit back and watch them self destruct just like Newtie did...

Obama didn't open investigations because he knew he was going to end up doing the same things he would be investigating Bush/Cheney for.

I hate to say this, but I also think Obama is afraid of Bush/Cheney. That's a smart thing to do, but it leaves the nation he is supposed to be taking care of twisting in the wind.
