Jared Loughner Pleads Not Guilty In Arizona Shooting

PHOENIX — The suspect in the shooting of Rep. Gabrielle Giffords smiled and nodded but didn't speak as he appeared in court Monday and his lawyer provided the 22-year-old's first response to the charges: a plea of not guilty.

In the two weeks since the deadly attack that killed six outside a Tucson grocery store, Jared Loughner's hair – shaved in the mug shot that's become an enduring image of the tragedy – has grown out slightly. The Tucson resident wore an orange prison jumpsuit and glasses, and his wrists were cuffed to a chain around his waist as eight U.S. marshals kept watch in the packed Phoenix courtroom and gallery above.

Loughner faces federal charges of trying to assassinate Giffords and kill two of her aides. More charges are expected.

Investigators have said Loughner was mentally disturbed and acting increasingly erratic in the weeks leading up to the attack on Jan. 8 that wounded 13. If Loughner's attorney uses mental competency questions as a defense and is successful, Loughner could be sent to a mental health facility instead of being sentenced to prison or death.

But his attorney, Judy Clarke, said she wasn't raising issues of competency "at this time" after U.S. District Judge Larry Burns of San Diego asked whether there was any question about her client's ability to understand the case against him.

Giffords was shot in the forehead and spent two weeks in a Tucson hospital before she was flown to Memorial Hermann Texas Medical Center Hospital on Friday. Shortly after her arrival, doctors said she had been given a tube to drain a buildup of brain fluid that has kept her in intensive care.

Hospital spokesman James Campbell said Monday the next update on the Democratic congresswoman's condition would come when they are ready to move Giffords to the rehab hospital.

Loughner will likely face state charges in the attack, and also federal murder charges listed in an earlier criminal complaint for the deaths of Giffords aide Gabe Zimmerman and U.S. District Judge John Roll.

Those are potential death penalty charges, which require a more painstaking process under Justice Department rules.

Prosecutor Wallace Kleindienst estimated that he would know within the next 30 days whether additional federal charges would be filed against Loughner. Kleindienst said prosecutors provided defense lawyers with records taken from Loughner's computer and documents of about 250 interviews made in the case.

The judge did not rule on prosecutors' request to move the federal case back to Tucson so that victims and witnesses do not have to make the four-hour round trip drive to Phoenix to attend court hearings. The case was moved because one of those killed, Roll, was a federal judge.

Clarke said she didn't oppose the request at this time, but questioned where Loughner would be jailed in Tucson if the case were moved.

Clarke has not responded to requests seeking comment. She is one of the top lawyers in the country for defendants facing prominent death penalty cases, having represented clients such "Unabomber" Ted Kaczynski and Olympic bomber Eric Rudolph. She has a reputation for working out plea deals that spare defendants the death penalty, as was the case for Rudolph and Kaczynski.

The judge set a March 9 hearing to consider motions in Loughner's case.

Exactly. The only one to blame is Mr. Loughner. He is the one who shot and killed people. He is at fault. Period.

There's no sense in everyone else pointing fingers and blaming each other.

some people think that understanding the charges constitutes sufficient sanity to presume guilt in the act ----

of course the answer is---- i understand the charge ---it presumes what i did was wrong ---my mental state told me it was right --so the charge is false --based on your reality not mine

A lot of people blame the government but really, the government defunding mental health has nothing to do with this. As someone with bipolar disorder, I developed it at 15 so really it was up to my PARENTS, not the government, to get me the help I needed. Now it is my responsibility no matter how manic I could get (luckily, it's not all that bad anymore). His family SHOULD HAVE gotten him help and they didn't and this is all on them especially after they knew he was causing a mess at his school. I'm 100% sure if his family struggled financially, they could have found a prescription discount program to help pay for the medication too. so to all parents out there, if your child is struggling in school or being plain reckless, don't think a grounding will make the underlying problem go away. Left untreated, any mental disorder whether it is a behavioral/personality (schizophrenia) or mood (depression, bipolar disorder), it will gradually worsen over time. Once people who have disorders are properly treated, they certainly can prove to be truly amazing. At least that's what I tell myself :)

He's going to be tried (for different crimes) in both Federal and State trials. The Federal trial is mainly about whether he intentionally killed the judge and whether he intended to assassinate a sitting member of Congress. The State trial will be a slam dunk death penalty for the other murders.

Are you even allowed to plead guilty to a capital offense?
Among the charges are that he assassinated a judge with intent to stop that judge's official duties. There actually is some question there -- I'm not defending him -- but if the prosecution cannot show that knowledge and intent, they cannot seek a federal death penalty. So with that in mind, it really isn't surprising for him to plead not guilty. As guilty as he obviously is, there might be at least one charge against him that isn't right.

Funny the same lefties saying this guy is guilty and deserves the max penalty are the same folks a few stories up the page are saying, innocent until proven guilty, Private Manning deserves every protection the constitution can provide. Left wing hypocrisy never grows old.

Wrong. By law, Loughner is presumed innocent. That does not mean that he is innocent. The question of guilt or innocence is decided by jury.

Conservatives who went along with Reagan to defund mental health now expected mental health professionals to intervene and handle this guy before he did anything BUT THEY SURE DON'T WANT TO PAY FOR IT.   Hypocrites times infinity.

I thought we all agreed that this was a random, a-political act of violence by a mentally disturbed person. Wasn't that the common ground our president found with the proponents of freely available guns and high capacity clips?

So, following that line of reasoning, this man is actually not guilty.

And this is where some pro-death-penalty brains will explode. Because those are usually the people who find nothing wrong with easily accessible guns. What a dilemma! Maybe we should just form one huge national circular firing squad, shoot each other and be done with it.

I'm confused, how he is not guilty? Pleading it and proving it are two separate matters. I think you are assuming that he will successfully argue an insanity plea.

I'm further confused as to why a circular firing squad would be necessary if he is found to be not guilty.
