PHOENIX — Gov. Jan Brewer sued the federal government Thursday for failing to control Arizona's border with Mexico and enforce immigration laws, and for sticking the state with huge costs associated with jailing illegal immigrants who commit crimes.

The lawsuit claims the federal government has failed to protect Arizona from an "invasion" of illegal immigrants. It seeks increased reimbursements and extra safeguards, such as additional border fences.

Brewer's court filing serves as a countersuit in the federal government's legal challenge to Arizona's new enforcement immigration law. The U.S. Justice Department is seeking to invalidate the law.

"Because the federal government has failed to protect the citizens of Arizona, I am left with no other choice," Brewer said as sign-carrying protesters yelled chants at her and at other champions of the immigration law.

Justice Department spokeswoman Tracy Schmaler declined to comment on the filing. But a spokesman for the U.S. Department of Homeland Security, which is in charge of policing the country's borders, called Brewer's lawsuit a meritless action and said Border Patrol staffing is higher than ever.

"Not only do actions like this ignore all of the statistical evidence, they also belittle the significant progress that our men and women in uniform have made to protect this border and the people who live alongside it," spokesman Matthew Chandler said. "We welcome any state and local government or law enforcement agency to join with us to address the remaining challenges."

Brewer's lawsuit seeks a court order that would require the federal government to take extra steps to protect Arizona – such as more border fences – until the border is controlled. Brewer also asks for additional border agents and technology along the state's border with Mexico.

The governor isn't seeking a lump-sum award, but rather asks for policy changes in the way the federal government reimburses states for the costs of jailing illegal immigrants who are convicted of state crimes. Such changes would give the state more reimbursement.

Arizona's enforcement law was passed amid years of complaints that the federal government hasn't done enough to lessen the state's role as the nation's busiest illegal entry point. Its passage ignited protests over whether the law would lead to racial profiling, and prompted lawsuits by the Justice Department, civil rights groups and other opponents seeking to have it thrown out.

The law would have required police, while enforcing other laws, to question a person's immigration status if officers had reasonable suspicion the person was in the country illegally. That requirement was put on hold by U.S. District Judge Susan Bolton, along with a mandate that immigrants obtain or carry immigration registration papers.

The judge, however, let other parts of the law take effect, such as a provision that bans people from blocking traffic while seeking or offering day-labor services on streets.

Brewer challenged Bolton's decision in an appeals court in San Francisco. She argued the judge erred by accepting speculation by the federal government that the law might burden legal immigrants, and by concluding the federal government likely would prevail. Brewer's appeal is still pending.

Arizona Attorney General Tom Horne, one of the lawyers defending the law on behalf of the state, said Arizona bears staggering costs from illegal immigration, yet the federal government maintains the state is prevented from assisting in the enforcement of federal immigration law.

Horne said Washington has failed to protect the state against an invasion by illegal immigrants.

"The word 'invasion' does not necessarily mean invasion of one country by another country," Horne said. "It can mean large numbers of illegal immigrants from various countries."

The governor's filing hammers on the issue of the state's unreimbursed costs for jailed illegal immigrants. Brewer's predecessor, Janet Napolitano, who is now the Homeland Security secretary, regularly sent the Justice Department invoices seeking such reimbursement when she was governor.

The lawsuit doesn't say exactly how much reimbursement money the state is seeking. Instead, it asks the court to interpret the criteria on which the reimbursements are based, which the state believes will ensure it gets more funding.

Brewer's filing noted Arizona's latest annual reimbursement from the federal government totaled nearly $10 million and the state had to eat an additional $125 million.

Democratic Sen. Kyrsten Sinema of Phoenix, an opponent of the law, said Brewer's filing was intended to draw attention from the state's budget woes. Sinema noted the federal government has hired 8,000 new Border Patrol agents and added hundreds of miles of fencing along the U.S.-Mexico border in recent years.

"The state will be hard-pressed to show that we have been denied any promised benefit," Sinema said.

Just a couple of articles that display the tyranny in Arizona. Incarceration for income sounds pretty fascist to me. Consider that Private Prison Lobbies in other states are actually getting the legislation past. Take Utah for example:

The Brewer administration has also been investigated by KPHO for hiring Chuck Coughlin and Paul Senseman, both lobbyists for Corrections Corporation of America, as a policy advisor and communications director. Although Coughlin continues work as both a lobbyist and policy advisor, Senseman no longer does work for CCA. CCA operates six private, for-profit prisons in Arizona. After KPHO published its investigative report, Brewer's re-election campaign retaliated by pulling all campaign ads from KPHO.

Every state in the union, if a true patriotic state, must immediately follow AZ's lead NO matter the backlash. It's time states take a stand a/g our Federal Gov't in its decade's long permissiveness to allow the southern border to flow with hundreds of thousands onto our soil, including a strong percentage of dangerous individuals. AZ's actions are effective.
Big Biz must accept that its' bottom line will be effected by replacing illegals with legal resident aliens+ citizens. Those at the top might consider taking a million less of their grandiose salaries. The use of illegal labor in America has created a fiscal disaster, placed a huge burden on the system, abused taxpayer's hard-earned dollars, and sets up extreme hostilities over the use of social services. It's commonplace to hear undocumented laugh, and say "Everything is free in America!" Well, it ain't funny to the citizens of the country.
Social services should be reserved for emegencies, not commonplace. They most certainly should be reserved for citizens in a time of real need; not drained each year by expanding pools of non-citizens.
A fundamental difference in Ellis Island immigrants, who were brought at a time the country NEEDED this labor pool, is they were met by officials, processed+checked for illnesses, and once settled desired to assimilate. Taking handouts was considered shameful.
It is a sham "these are jobs Americans+LEGAL Resident Aliens won't do." Quite simply citizens were forced 2 watch jobs go 2 undocumented.

So... I think I see what you're trying to say here: Now that the (failing) infrastructure of our country has been built, we don't need any more non-whites coming into this country, correct? I mean, that's what your "Ellis Island" statement said to me! The funny thing is, people like you don't actually take the time to do the RESEARCH. The fact is, crime has gone DOWN with this recent increase in illegal immigration.

"According to FBI statistics, violent crimes reported in Arizona dropped by nearly 1,500 reported incidents between 2005 and 2008. Reported property crimes also fell, from about 287,000 reported incidents to 279,000 in the same period. These decreases are accentuated by the fact that Arizona's population grew by 600,000 between 2005 and 2008."

Now, with the information above freshly in mind, take a moment to think about how stupid you'd have to be to be as an illegal immigrant, trying to make money to supply food and a roof over the heads of you and your family, to commit a crime and risk being deported. Pretty dumb, huh?

Follow Up:

None of this even takes into account the fact that some property "belonging" to the US has a questionable nature (considering the previous owners), and the fact that "borders" are just imaginary lines drawn on a map, by people in positions of power, to keep people at odds with each other... I love my country, but I'm not so blinded by that love that I don't know it has a terrible past riddled with mistakes and horrible acts.

Perhaps, if you feel so strongly about this issue, you could follow in William Ripley's steps (former Harvard Economics Professor) and take out a full page ad in The New York Times (June 1913) to warn us of the "hordes of new immigrants" that are "a menace to our Anglo Saxon civilization."

Personally, to me, asking someone to wait two years or more, in a hostile environment where people are killed every day for drugs and/or political reasons, and requiring them to take a test that most CITIZENS wouldn't pass, seems like a lot to ask...

Remember that big statue that stands right near the Ellis Island you mentioned earlier? Do you remember what part of the inscription says? I'll help you out: "Give me your tired, your poor, Your huddled masses yearning to breathe free, The wretched refuse of your teeming shore. Send these, the homeless, tempest-tossed to me, I lift my lamp beside the golden door!" - What happened to THAT America?

Your comments are quite narrow, shortsighted so I'll be brief:
1. Statue of Liberty was gifted to US by People of France honouring the two nations + attesting to their friendship, which is clearly written on the brass plaque, which you've probably never seen, nor read. The tablet she holds is to evoke the law. The poem you are citing, and I'll ignore your snotty comment, was written by Emmas Lazarus, after she was asked to submit a poem as a donation to Arts Fundraiser and was read at opening but played no role in opening of statue in 1886. Years later, a friend wanted to memoralize her had it added to the statue. You are conflating the two points; why it was made and what it later came to stand for.
2. "Belonging to US": Recall the TheTreatyofGuadelupe Hidalgo where we paid the Mexican gov't equivalent of millns in today's terms& forgave their citizens' debts. We later paid additional monies for the GasdenPurchase, current day southern AZ NM.
3.We all realize crime stats are manipulated to suit the user. I'd like 2 see U sell ur argument 2 thousands of Americans who have been raped/murdered/killed in DUI's/ by illegal immigrants.
4. Our family is 1/2 Latino1/2 Euro&multi language. We don't support anyone coming here illegally. Yes, we are sympathetic to people's plight but this does not justify decades of invasion. We do not support breaking laws+support a tightly secured border for obvious reasons.

Thank u for posting. We've watched this first hand for decades. The threats, rapes, murders on Amer citizens is treasonous. And, its not border states; the cartels are holed up in National Parks across the country; remote areas. They have rooted in to key states nationwide to move their operations.
America will soon have No Go Zones where no police, no citizen, no one can go.
Bob Krenz flew to DC w/ his wife and another ranch couple for many years begging for help; now he's dead. They sent a message. But they will use the same tactic on any American living anywhere that tries to clean this scurge up and get it out of our country.

They advised her the law could override Federal Law.
AZ taxpayers should make sure she is not using their funds for her continued legal advice.

To all those who have posted here that Arizona isn't cracking down on businesses employing illegal aliens, be sure to read the article.

You are right that scofflaw businesses want to keep the status quo. You are wrong to think that many Republicans are in favor of it. This is a very definite split in the party and it's a battle that businesses are clearly losing.

If you are in favor of making sure employers only employ legal workers, the Republicans are the only ones trying to make it happen.

Bring back 10,000 American soldiers from the 60,000 that have been stationed in Germany for the last 65 years, all at USA expense. It won't cost a dime more to the USA if they patrol out borders for a change, and will end the nonsense drug smuggling and the continuing additiction of USA children. Sen. Sinema is spot on regarding Brewer's attempt to draw attention away from the failed policies of the Republican Party in charge of Arizona. It has hit the fan in Arizona and getting worse and the narrative is already being formed. Its not our fault. Its the Feds!!

If ya can't handle it, get out of office!!

No findings of fact, no statistics, no evidence what so ever for the charge, just political grandstanding.

I'm glad we have a state like Arizona. We can all see what Republican policies on steroids can achieve. Nothing.

I just heard that Jan Brewer plans to finance this suit with contributions from around the country. I think she'll be successful doing this. People all over this country are livid that our government can't, or just won't, enforce our immigration laws. You'll be surprised to see how wallets open up to support this effort.

Nobody grades on effort. We grade on results. The results are nowhere close to being adequate! I give Obama credit for ramping up the effort. That's the extent of it.

And really, how much sense was it not to take care of the southern border after 9-11? This would not be the same issue now.

There is absolutely nothing "racist" about expecting, in fact demanding, that everyone follow our laws. There is nothing "racist" about expecting, in fact demanding, that our laws be enforced. This goes for Hispanics, Asians, Europeans. We have an immigrations system. It establishes processes for legal entry and stay. We expect the system to be observed. No exceptions.

Get off the "race" card.

The unfortunate reality is that Maricopa county (Phx) has such a huge population that that county alone controls the state. I can't say it enough...Arizona is NOT a homogeneous waste land of conservative ideology. The Governor is an embarrassment to anyone in Arizona paying attention.
