Foreclosure Protesters Descend On Washington

WASHINGTON -- Hundreds of protesters from around the country descended on a meeting of all 50 state attorneys general in the nation's capital on Monday, demanding criminal prosecutions for bankers and mortgage servicers accused of foreclosure fraud and other abuses.

"Handcuffs for the CEOs! Corporate criminals got to go!" demonstrators chanted during an hourlong event outside the Fairmont Hotel, waving signs with slogans like, "Make Wall Street Pay!" and "Send Wall Street The Bill." [SEE VIDEO BELOW]

State AGs and several federal regulatory agencies are currently hammering out the terms of a settlement on allegedly wrongful foreclosures, with reports suggesting a potential maximum fine of $20 billion. Calling that amount "chump change," protesters said any fair settlement would include criminal prosecutions against bankers, restitution for homeowners banks have already mistreated, and a national loan modification program to limit future foreclosures.

The government's current primary foreclosure-prevention effort, the Home Affordable Modification Program, has been riddled with bank errors and alleged abuses that the Treasury Department has failed to rein in.

Monday's Fairmont protest was one of several orchestrated by National People's Action, a coalition of neighborhood and community activists. Demonstrators also chanted outside the Offices of the Comptroller of the Currency, a federal bank regulator reportedly pursuing a small-dollar settlement. Earlier in the day, NPA members briefly shut down a Washington, D.C. Bank of America branch when hundreds showed up to protest the bank's foreclosure practices. On Sunday, hundreds of protesters picketed the Georgetown home of BofA board member Charles Rossotti.

NPA organized the protests to highlight a new report analyzing tax breaks that allowed the six largest banks to pay an average tax rate of just 11 percent in 2009 and 2010. Bank of America and Wells Fargo have both secured multibillion-dollar tax refunds in recent years.

At the AG event, demonstrators accused banks of committing widespread fraud, citing a broad array of abuses: evicting people who had already paid off their mortgage, charging illegal fees and illegally inflating home appraisals, among others. Some protesters said banks had failed to follow through on commitments to modify improper loans, while another said her bank denied a short sale and foreclosed on her because, the bank said, it had lost her paperwork.

Such complaints have become commonplace at homeowner assistance organizations. The National Consumer Law Center has reported that in half of the foreclosure cases they work on, the foreclosures were caused by bank errors, not homeowner shortcomings.

In recent interviews with HuffPost, several lawmakers and top policymakers also bemoaned a mortgage system which they said has become lawless.

"I've talked to a few people on the investor side of the mortgage-backed securities business, and they said doing business with Wall Street now is like doing business with oligarchs in Russia," Rep. Brad Miller (D-N.C.) said. "You have to factor in the fact that contracts are not enforceable when you're dealing with these banks."

"I am incensed that the FBI has not filed one criminal case," Rep. Marcy Kaptur (D-Ohio) said, referring to the lack of prosecutions against major banking executives. "And I'm very worried that the game that's being played here is to run out the statute of limitations."

Several banks have been sanctioned by the Federal Trade Commission over illegal fees charged to borrowers, but advocates note that these settlements were tiny relative to the scope of the problem, and appear to have failed to curb such behavior. The FTC settled with Bear Stearns for $28 million in September 2008, and hit Countrywide for $108 million in June of last year. By that point, however, both companies had already been absorbed by other Wall Street financial institutions.

Several other regulators have jurisdiction over bank activities, though, and a broad investigation into mortgage servicers -- the bank divisions that collect payments and process foreclosures -- has revealed "widespread" problems and "broken" systems, according to Federal Reserve Governor Sarah Raskin.

In December, NPA members met with Iowa Attorney General Tom Miller, who vowed to "put people in jail" following a 50-state investigation into foreclosure abuses. Current reports on settlement negotiations, however, have given no indication that criminal charges will be part of any deal.

To those asking when/where the next protest or action will be.... The answer is, the next action will be whenever and wherever YOU plan it. Is there a bank, mortgage broker or stock broker nearby? How about a court house? When is the next "Sheriff's Sale" of houses for delinquent taxes in your town? Is someone in your neighborhood being foreclosed or doing a short-sale? Anywhere there's a patch of dirt is an ideal spot for a protest -- because someone is paying for that dirt and someone else is probably trying to rip them off in the process.

This is all-out war between the banks and government(s) supporting them, and We the People. If you've ever had or have a mortgage, this is important to you. Ever received a note saying, "Stop sending payments to Bank A and start sending them to Bank B?" There's about a 50/50 shot that Bank B REALLY "owns" your loan ... giving you a 50% chance that Bank C could show up in five years and say, "Hey, you owe five years of back payments, Chump." And right now, the courts and governments support the banks.

This is OUR country. It's time we educate ourselves and start behaving like responsible adults in charge of our own destiny ... instead of spoiled children waiting for someone else to make a move -- like forcing you out of your house.

I love you more each time I read one of your wonderful ideas that come out of your head.

We had a lovely couple of Huffington Posts Meet-ups in the last two days. That, and the wonderful email you sent me confirm that I need to continue to push forward. We cannot, will not give in to the fraud, greed and lawlessness. If we do, then we are through as a nation. You are so right....it IS you and I that the founding fathers counted on when they built this country. They spilt their blood in an attempt for us to live free. And I will not dessicrate their memory due to some A$$HOL3 that just wants unlimited power. Not gonna do it.

when applying for a HAMP modification there is now a" dodd-frank certification" form the applicant is to sign that says they have not commited fraud or forgery in the past 10 years. are the banks to sign this same form when offering a modification?

Actually, they are regularly signing "lost note affidavits" as REGULAR COURSE OF BUSINESS prior to Deed of Reconveyance, here in Washington.

I challenge you to find out what is happening in your state. We not only need to report this CHIT, apparently, we need to continue to press the AGs office to see if any prosectutions have been made. Yep, really amazing stuff these days. Forgery, fraud, perjury go un-prosecuted.....REGULARLY!!!!

thank you-actually i know what they are NOT doing. an AG that if you look at his campaign donors they are heavy on banks and developers. and the OCC also does nothing. has anyone gotten a responce from the OCC if they report fraud from the banks?

Hi, It is about time this happened and if I had known about it I would have gone with the protesters to D.C. My condo in Atlanta, GA was foreclosed on November 1, 2005 and I have never recovered from the loss of my home. I was a victim of mortgage fraud and predatory lending. I am in favor, very much so, of having the people who did this pay with money and jail time. I wrote letters to the attorney general of GA, the Governor of GA and the FBI. Eugenia Renskoff

well, we do not live in Medieval Times any longer (well in America we might), thus guillotine­ would be a bit wishful thinking. However, it would be completely rational to have them go through it and be handcuffed and taken away immediately.

what about the role of the judicial system in this mess ?. i went through the entire process with judges ignoring the fact that the bank (wells fargo ) could not produce papers and other series of errors and blatant disregard of the existing laws . the judges did nt care . until finally i did get one who was put on the spot and had to dismiss-with prejudice. if you dont have a lawyer who really cares forget about it .. your chances are close to zero. one of well fargos lawyers actually swore in court totally fabricated meetings... that never happened. thank god i was able to prove that it was a lie .. the banks dont care but the courts are not far back

Hundreds of protestors? I'd like to see hundreds of thousands. These people have crippled business, certainly investment, in the US. I have moved all investments offshore, because of the dollar and my perception, borne out in the last quote, that in the US it's a rigged game.
The thugs obviously have control of the government also. It is time to bail.
