WASHINGTON (Reuters) - The Obama administration Tuesday appealed a U.S. judge's ruling in Florida that struck down its landmark healthcare overhaul law as unconstitutional because it required Americans to buy healthcare insurance or face a penalty.

President Barack Obama's Justice Department filed its notice of appeal and the case will go to the U.S. Court of Appeals for the 11th Circuit, based in Atlanta. The fight over the law is expected to reach the Supreme Court.

Healthcare reform is the signature of Obama's domestic policy and the administration has said it would continue to implement the law because halting it would cause irreparable harm.

The administration will likely seek an expedited hearing on the case but Charles Shanor, a law professor at Emory University in Atlanta, said it would still be with the 11th Circuit for months before a ruling was issued.

``I just don't see the court writing an overnight opinion in a matter that's of such concern to the public,'' Shanor said, adding that the 11th Circuit was viewed as ``moderate'' when compared to other appellate courts.

A three-judge panel would initially hear the case in oral arguments after a briefing period but once an opinion is issued the losing party could petition the court for 'en banc' consideration by the entire appeals court, he said.

U.S. District Judge Roger Vinson in January backed arguments by 26 states that the sweeping law's requirement that Americans buy health insurance starting in 2014 or pay a penalty was unconstitutional.

Last week he agreed to put his decision on hold pending appeal but he ordered the Obama administration to file its appeal by Thursday and to seek a fast-track review.

Vinson's is one of two rulings that have found the individual mandate unconstitutional, but his was the only one that invalidated the entire healthcare law. A handful of judges in other states have dismissed legal challenges to the law.

The overhaul enacted last year aims to expand health insurance to cover millions of uninsured Americans while also curbing costs. Administration officials insist it is needed to stem huge projected increases in healthcare costs.

Opponents of the law argue it is unconstitutional because it penalizes Americans for failing to engage in commerce, specifically buying health insurance coverage. (Reporting by Jeremy Pelofsky in Washington and Matthew Bigg in Atlanta; Editing by Eric Walsh)

Ultimate fighter and former Republican political candidate Matt "The Law" Lindland is being sued for allegedly stealing six mature marijuana plants.

In a suit filed March 3 in Multnomah County Circuit Court, plaintiff Gonzalo Aldana Gamboa claims Lindland offered last year to let Gamboa grow pot under the Oregon Medical Marijuana Program on Lindland's property in Eagle Creek.

The GOP Health Care Plan

The uninsured have been told by the GOP instead of ACA, they can use the ER for their medical needs.

The GOP cleverly moved the burden of the ER visits to the working class and those who have health insurance. The increased ER costs will result in higher premiums. Pocket change of course to the wealthy but a big increase for the rest of the insured.

The GOP is focused and by repealing or attempting to repeal ACA they know their campaign dollars from the insurance companies will flow more freely. After all they will be charging you, the insured, with enough left over for the politicians!

BBC is not legally bound to be impartial- that on itself is ludicrous. The amazing thing is that you are willing to look at this and take it at face value because it fits what you think. I wonder if you would feel the same after reading the reports on other media that does not bear this out. So please quote the statute,law, mandate or what ever that forces the BBC to be impartial. I am dying to see it.

The BBC charter requires both accuracy and impartiality or they lose their license. They are currently under review for some of their climate change reporting.

PEOPLE SEEM TO BE UNABLE TO THINK CLEARLY NOW DAYS. WHEN I WAS WORKING, EVERY WEEK THE GOVERNMENT WOULD TAKE OUT ON MY CHECK MONEY FOR SOMETHING CALLED: "MEDICARE." Medicare is a tax, while the individual mandate is set up as a penalty. They are two vastly different things and the latter has no constitutional substance.

Under Bush, a law was enacted that said all senior citizens MUST buy a prescription drug program and will be penalized if they don't. How is that different from the Health Care Law?

It boils down to this ; the only countries that have health care for all their citizens utilize collective bargaining to make it affordable.

France's healthcare expenditure for instance is 7-8% of GDP and ALL it's citizens are covered.
The U.S.'s is expected to exceed 20% of GDP in 2011 and only about 60% are covered.

Healthcare beneficiaries and their Republican cronies have successfully prevented consideration of a public option which would allow collective bargaining for now, thus preserving their $$$ windfall.

What a coincidence.........Judge Roger Vinson is a Republican....and was elected judge by a Republican President, Ronald Reagan in 1983....and surprise, surprise, he is the only judge to make a ruling that invalidates the complete healthcare overhaul.........

May I quote the U.S. Constitution:

"The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people."

If you want Govt health care for all, just pass an amendment as there is NO RIGHT to the efforts of physicians, nurses and other health care providers...

Otherwise, expect a SCOTUS 5-4 in favor of the states....

RIGHT NOW THEY ARE WORRIED ABOUT GETTING IMPEACHED. I DON'T THINK THEY WILL MAKE UP LAW AGAIN FOR AWHILE. MEDICARE PAYMENTS ARE FORCED PAYMENTS FOR HEALTH INSURANCE. IF THAT IS LEGAL, SO IS THIS.

Its somewhat surprising to hear that the cowering, wimpish Obama Administration is attempting to defend its own positions in court. No doubt this will be dropped soon by them, as they will give in on this as they do on everything else.

I'm sure a "compromise" is forthcoming, wherein they adopt the Republican position once the appearance of a fight has been set by this court action.

That's Obama for you. He'll pretend to fight for the side of the good as long as it is absolutely necessary that he put up the appearance.

So tell me again how the law is applied to ALL, tell me again how this mess of a law does not have unintended consequences. This law will be repealed and if not repealed by the time we are done with all the waivers not many people will be bound by it.
