Dwyane Wade Wins Custody Battle For Two Sons

Dwyane Wade Custody Battle

TIM REYNOLDS   03/13/11 03:18 PM ET   AP

MIAMI — When the Miami Heat ended practice Sunday, Dwyane Wade went home to his sons.

That will be a regular event going forward.

Ending a long and often-vengeful fight, a Chicago court has awarded Wade sole "care, custody and control" of his two sons. The boys arrived in Miami on Friday, shortly after the ruling was filed, and Wade told The Associated Press that "a huge weight is off my back."

"My life changed in a huge way," Wade told the AP. "Mentally, I've been preparing for it for over a year now. To me, it's bigger than that. For me, it shows a lot of people that you need to fight to be in your kids' lives sometimes. You fight until you can't fight any more. That's all I was trying to be, a father in his kids' lives."

Wade did not immediately announce the decision after receiving word Friday, trying to make sure that his sons fully understood what it meant first. Teammates, informed of the ruling in a locker room meeting on Saturday after Miami's victory over the Memphis Grizzlies, gave him a rousing ovation.

Wade had one of his finest all-around efforts of the season Saturday: 28 points, nine assists, five rebounds and five blocked shots.

It may not have been a coincidence.

"I heard the best news I could possibly hear," Wade said. "So I was like, 'I'm going to go out there and play free and enjoy it.'"

Wade's divorce was granted last June, after a lengthy separation. The financial portion of the divorce remains unsettled.

The boys' mother, Siohvaughn Wade, will have what the court described as "regular parenting time" on alternating weekends in Miami, as well as several other times during the year, including Mother's Day. Dwyane Wade has also repeatedly said that he wants his sons to have healthy relationships with their mother.

Still, the 102-page ruling had some sharp words for Wade's ex-wife.

"This court finds that (Siohvaughn Wade) has embarked on an unstoppable and relentless pattern of conduct for over two years to alienate the children from their father, and lacks either the ability or the willingness to facilitate, let alone encourage, a close and continuing relationship between them," read a portion of the ruling entered by Judge Renee G. Goldfarb.

Wade's attorney, James Pritikin, said the custody trial "was one of the longest ever in Cook County history."

Wade filed the motion asking for sole custody nearly a year ago, though the legal tussle has gone on considerably longer.

He and his ex-wife separated in August 2007 and it took Wade years to get the divorce, a process that was slowed by his ex-wife often changing attorneys. He also sued Siohvaughn Wade for defamation after she made unfounded allegations against him in 2009 – claims she eventually withdrew.

More claims against Dwyane Wade followed during the custody case, including that he was abusive to his children. The court found them all to be baseless.

"The court agreed the best home is with Mr. Wade and that he is also willing to foster a relationship with the children's mother," Pritikin said. "I know he will continue to be a phenomenal parent."

The court acknowledged that Wade's schedule as a professional athlete is "demanding," given the rigors of training camp, preseason, an 82-game regular season and then the playoffs.

"Is every day the same? No. Is it consistent? No," Goldfarb's ruling read. "But, to posit that (Dwyane Wade) does not have the time to be a primary parent is incorrect. He has the time if he makes the time."

Wade said all the measures are in place for as smooth a transition for his sons as possible. A school for the boys has been selected, and a plan for child-care was presented to the court, which found it acceptable.

"We had to have that, nanny care, everything already booked and planned out," Wade said. "That's the easy part."

The court ruling also had some other interesting items, including Siohvaughn Wade's contention that Dwyane Wade could have found employment in Chicago, where she has lived with the boys.

Wade met with the Chicago Bulls twice last summer when he was a free agent, but according to the ruling, Bulls owner Jerry Reinsdorf never met with Wade, nor did the team ever present the 2006 NBA finals MVP with a contract offer.

The ruling also states that Wade is on the U.S. roster for the 2012 London Olympics. Wade played with the U.S. team at the Athens Games in 2004 and the Beijing Games in 2008, but has not yet said publicly if he definitively plans to play at the London Games.

Wade told the AP that the waiting for the ruling has been difficult, and expressed again Sunday a desire for his ex-wife to "play a healthy role" in the boys' lives.

"I'm not going to say, 'OK, I won,'" Wade said. "I think them living here, being here, it's a great opportunity for them and I'm looking forward to it for them, to grow up with me and us learning together, how to be father-son. So I'm excited."

I'm glad Dwade won custody of his kids since their mother is a certified whack job having fired four attorneys, found in contempt of court and did not up for the custody hearings. I'm also glad the suit by the Cleveland nightclub against LeBron was dropped. Now, give Bosh the dang ball.

I'm not a Heats fan.

Give it a break some of you.. Will yah!? I mean, there are countless women who has custody of our children who don't deserve them but are awarded because they are "women". I know quite a few women who are getting paid royally through child support and spend most of the money on things "they" desire verses what's in the best interest of the kids. So now Wade wins custody and some women and a few misguided men feel that either the courts didn't rule properly or Wade is not worthy. WOW!? You people have a lot to learn about why it is that:

1) Boys today require a father figure more than ever. Due to mis-direction, some entertaining homosexuality, prison, amongst numerous other matters.

A lot of women are making this about "The Ex" and placing themselves in her position and reacting in kind. No matter how they trump this up it's about the boys and they are the victims here. So they don't need no more of their mother's (Verified) negative spewing but rather their father's strength and his blessing of hopefully re-establishing a fruitful relationship with his boys.

Isn't that completely normal? I'm surprised he didn't give her a medal for extra effort?

This guy is going to be thrown off the bench soon.

Sadly, most fathers don't have the means to fight in this manner, however the behavior that his ex-wife exhibited was beyond extraordinary to say the least. I'm not going to go into some diatribe about who cheated. They were together since high school, and they were both immature and shouldn't have gotten married let alone have children. But life happens, so this is what we are left to deal with. The reality is that she defied court orders on several occasions (including those in which she was supposed to ensure that the children had communication with the father), and the judge even issued a warrant for her arrest last year http://www.chicagobreakingsports.com/2010/05/judge-orders-dwyane-wades-wife-to-court.html after she failed to appear for divorce proceedings. She has issued several claims, many of which she retracted, and the rest were found to be absolutely bogus. The judge's ruling statements were quite clear.

Had she not conducted herself in such a fashion, she would have been getting that child support check. Now, she has to get a job and work and make arrangements with the father to see her own children that she birthed. There is no other reason for that other than bitterness, and it is a shame that folks on here will use the real life experiences of abused women to some how side with this woman who conveniently brought up that issue during the divorce proceedings. All found to be baseless.

Ah - so she defied the judges order - that's what got him custody. Contempt of the judge - that will do it every time. Kids and dads don't matter in court.

Best of luck to you and your family, Mr. Wade. Hope that all of you will settle into a great life.

This is why - as someone posted:

She defied the judge - that's why he won. Kids and dads don't normally count for anything in court.

Good for him. I think he always wanted to be there forbid sons. His ex-wife, on the other hand, saw his sons as her money train. Glad the court ruled for him.

I haven't followed this story, so I am curious, how old are the kids?
01:40 PM on 03/14/2011
I believe they are 5 and 9.

If I hadn't experienced it personally and done extensive research on the subject of high conflict custody cases I would take this story at face value. Something needs to be considered, however, and that is the possibility that things are not as they seem, that the judge got it wrong and/or was biased. It's a fact that men who are abusive or otherwise mistreat their wives (Wade's wife alleged infidelity which resulted in her contracting an STD) often try to obtain custody as a means of 'punishing' the wife for speaking out and exposing their true natures and/or acts of abuse. Often these men attack the mother's credibility and make false allegations under the guise of being 'good fathers' who are being wrongly victimized and discriminated against. To divert attention from their misdeeds and gain sympathy (and because the best defense is a good offense,) a claim of PAS (Parental Alienation Syndrome) is made. A cursory investigation into this postulate reveals it for the preposterous junk science it is http://www.leadershipcouncil.org/1/pas/dv.html The author of this theory, the late Richard A. Gardner was assailed by critics/peers for both his baseless claims of the legitimacy of PAS and his outlandish stance on sex crimes against children. The fact that PAS was alleged and the mother of Wade's children was disparaged in a typical way raises a significant red flag. Simply, justice may not have been done and this case may warrant closer investigation.
01:12 PM on 03/14/2011
I think this is a pretty clear cut case. After the split Wade's ex made a number of allegations against him - all of which turned out to be without merit. She was uncooperative when it came to visitation, sometimes in violation of court orders. I'm not sure how anyone could characterize Wade's attorney defending him against the mean-spirited and baseless attacks made by his ex wife as Wade disparaging her.
07:35 PM on 03/19/2011
My only point was to say that nothing can be taken at face value in these types of cases. Perhaps her allegations were without merit but perhaps they were not. Truth is often obscured and no one knows what the truth in this situation is but Wade and his ex wife. Frankly, I would be uncooperative with visitation too, in violation of court orders if necessary also, if my ex were abusive. This is the most common reason women defy court orders -- for the sake of their children. I don't know if Wade is abusive so I can't speak to that but often men who allege PAS are. They turn the tables and accuse the wife (this would be the disparaging I mentioned) of the exact things they've actually done. They look like the victim that needs 'defending' when they are the offender. Just pointing out a red flag, saying that things aren't always as they seem, that's all. Fair often doesn't extend to the courtroom and injustice is done every day. Regardless, I would agree with jstowe, the real losers in this case are the kids.
01:27 PM on 03/14/2011
I agree. There are enough red flags here, there's certainly no reason to stand up and cheer this court decision from the outside.

Just about every aspect of these kids' daily lives, from school pick-up, afterschool activities, playdates, meals, etc., is going to be handled by hired help. Dad does not have a 9 to 5 job. This is in no way a victory for the kids.
04:40 PM on 03/14/2011
Do you honestly believe it would be any different with the mother? The mother has most likely already employed full-time nannies the children's whole lives.

I think I am in love with this man. Seriously, it would seem the court truly made the right ruling. He does not see his children as a prize, or himself as a victor. His children have won though.
