Newly Released Wisconsin Emails Show GOP Considered Ways To Punish Democrats

MADISON, Wis. -- Everything from taking away computers to denying a year of service in the state retirement system was considered to punish the 14 Wisconsin Democrats who fled to Illinois for three weeks to block passage of a bill taking away union bargaining rights, newly released emails show.

Members of Republican Senate Majority Leader Scott Fitzgerald's staff bounced ideas off one another and the Legislature's attorneys for days about how to penalize the Senate Democrats for leaving and pressure them to return, according to records released Wednesday by Citizens for Responsibility and Ethics in Washington.

The watchdog group obtained the emails from Fitzgerald's office under Wisconsin's open records law.

The emails show Fitzgerald's staff members were as worried about the public relations campaign as they were actually figuring out a way to get the Democrats to come back.

"I would just be somewhat cautious in whatever we do so that it doesn't end up creating sympathy for the Dems," Tad Ottman, a Fitzgerald aide, wrote to his chief of staff John Hogan on Feb. 20. "The more directly we can tie whatever action we take to what they are doing the better it will be."

Democrats left the state on Feb. 17 to deny quorum in the Senate and block passage of Gov. Scott Walker's bill that took away all collective bargaining rights, except over salary, for Wisconsin's public employees.

Their departure helped fuel protests in opposition to the bill that grew to more than 75,000 people. Senate Republicans finally used a maneuver to pass the bill without the Democrats present on March 9, a move now being challenged in court. Democrats returned after the bill passed.

Senate Republicans approved a number of sanctions during their absence, most notably voting to find the missing Democrats in contempt and ordering police to compel them to return. The emails show that Fitzgerald's staff knew the state constitution barred them from actually arresting the senators other than for committing a crime or acts of treason.

"It now seems that monetary penalties and removal of privileges may be our only recourse," Fitzgerald legislative aide Rob Richard wrote on Feb. 20, citing the constitutional prohibition on arrest.

The Senate voted on March 3 to find the Democrats in contempt and ordered the sergeant at arms to use police force to compel the senators to return. Fitzgerald said at the time that while the action was technically not an arrest, under Senate rules police could force absent members to return.

Citizens for Responsibility and Ethics has filed a complaint with the state Government Accountability Board, arguing Fitzgerald should be sanctioned for earlier sending state patrol officers out to look for the missing senators. The group said the emails show he knew the senators could not be arrested when he sent the troopers out.

Fitzgerald said Wednesday that troopers were only sent to assist the Senate sergeant at arms, who was looking for the Democrats, and never were expected to be asked to make an arrest.

"I knew they couldn't be arrested," Fitzgerald said. "That would have been a public relations nightmare."

Fitzgerald said after the bill passed that the Senate would no longer seek to impose any of the penalties it approved, including $100 a day fines, taking away parking spaces and restricting access to Capitol copying machines.

The emails show there was a lot of discussion with legislative attorneys about how to legally impose fines on the missing senators and other steps that could be taken against them and their staff.

"I say we not only make it hurt for them, we have to make it hurt for their staff as well," Richard wrote on Feb. 20.

One idea Ottman suggested in a Feb. 20 email was cutting the size of each Democratic senator's staff by one person "since one person from each of their office is failing to show up for work (the Senator)."

That idea and several others, like reducing or taking away per diem payments and denying a year's service in the retirement system, were not pursued. Richard pointed out in the same Feb. 20 email that taking away a year of retirement service likely would engender a court fight.

The emails also show there were discussions about what would happen if the Democrats returned unexpectedly. Fitzgerald's chief of staff Hogan asked the Senate chief clerk in a Feb. 21 email what would happen if a Democrats showed up in the Capitol but not on the floor of the Senate.

"Then I assume we compel them back to the chamber via Ted/Trooper/TV cameras," Hogan wrote, referring to sergeant at arms Ted Blazell. "We should just be ready with a procedure in case it happens."

Well, well, well, it was bound to come out how the Democrats have been taking orders from the national bosses. Just not around here.

The same day Senate Democrats left the state to boycott a vote on Gov. Scott Walker’s collective bargaining bill, a union official from Washington, D.C., provided the Democrats' leader with talking points.

Payback for this crappy healthcare bill which the liberals passed. You know the one Nancy said they must read before the know what's in it. And the same healthcare bill Congressman weimer is trying to get his state exempt from. The same bill Obama gave the unions a free pass. Please no try and defend the bill. You know nothing about it.

The healthcare bill is not crappy. What is crappy is what the repugs have done in Wisconsin. I do know about the bill. Anyone who is interested in actually knowing what they are talking about can read the bill theirself. Too many have listened to the lies that the repugs have told and don't try to find out the truth.

Huh? No discussion of cutting the pay of state employees who are Republicans, and opposed to unionizing but not to organized ganging up on the minority?

Oh -- right: this is about punishing only SOME of the people -- all of whom are, or are perceived as being, Democrats -- based upon unequal protection of the laws.

Which "ganging up on" was that? The Republicans stayed in Madison and kept government running. The Democrats - At the bidding of their union masters - fled to Illinois and were willing to sacrifice "the people" in the name of keeping the unon money train running. They are only bent on one thing: Obstructing all Republican legislation. The Democrats have been in charge for so long they are trying every trick in the book to stall and delay any legislation proposed by the majority party.

The GOP of the 21st Century continues to show itself to be an enemy of the people and their candidates treated as the enemies they are in every election in every county, town, city and state. If Progressives and Moderates simply remember that enemy at the polling place -- and know, to their core that the Far Wrong Fringe is in the race solely to advance an anti-American agenda, we *can* correct the hard-right turn and get the country back to working for everyone...

As we've seen in the past week, the soggy teabag suckers only want dispute, not solutions; they urge the President to take steps in Libya, the president takes those recommended steps, and the soggy teabag suckers flip-flop faster and more frenetically than a dying carp caught in the shallows...

These so called "legislators" should be brought up on charges and removed from office...The " I don't like the rules so I will take my ball and go home" gambit doesn't work here...It is time the Democrat party learned that there are consequences for their actions....or in this case inaction.

This Intent to make them pay is I believe not a given part of their job Description, why is this not a Law enforcement matter, we have many crimes where intent to do harm or to plot is enought, this should at least be grand jury material. Take some action to stop this erosion of our Legislative system.

What are you talking about?

Shouldn't you be foremost concerned with the rule of law? Therefore, shouldn't you know what the actual law is before poppining off about "enforcing" that about which you know nothing?

Hardly a surprise. The Democrats showed that they could not be bullied, and stood up for their people, and the Republicans want to make sure it will never happen again with more bullying. I would like to think that such strong senators would shrug this off like the rest, and focus on what matters, like keeping more unbalanced laws from gaining a foothold in Wisconsin while Walker is in charge.

We are such an impulsive people. Walker and the Republicans are only thinking about what they're gaining now; money, power, and the laws they want. Big business has been planning this for a long time, backing the candidates that will do their dirty work, and undermining the laws and regulations we had until our structure to stop them is too broken to work. Our laws are an empty shell, and once big business fully owns America it will be too late.

When word got out two weeks ago that Wisconsin Gov. Scott Walker had ordered the windows of the state Capitol building bolted shut during the ongoing protests against his attacks on public employees, it was a chilling reminder of a similar action by the employers of the Triangle Shirtwaist factory.

Nearly 100 years ago to the day of Walker’s order—which he rescinded after public outrage—146 workers, mostly young immigrant girls, jumped to their deaths from the 10-story building, unable to escape a fire because factory foremen had locked all the doors. The owners, Isaac Harris and Max Blanck, worried the workers would steal from the company.

Hyman Meshel worked on the eighth floor. When the rescue crew found Meshel, who was still alive,

the flesh of the palms of his hands had been torn from the bones by his sliding down the steel cable in the elevator, and his knuckles and forearms were full of glass splinters from beating his way through the glass door of the elevator shaft...

Following is the first set of responses from Steven Greenhouse, the labor and workplace correspondent for The Times, who is responding to your questions about the evolution of the nation’s labor laws and labor unions since the Triangle fire 100 years ago.

Is Wisconsin (or other similar laws or movements) proposing to erode rules related to worker safety?

The law limiting union bargaining in Wisconsin, like laws proposed in other states, does not include explicit references to limiting worker safety. But Republicans and union officials are on opposite sides of the question of whether limiting collective bargaining will have such an effect on worker safety: the Republicans say no, the unions and their members say yes.

The newly passed budget bill in Wisconsin limits collective bargaining to just one subject, wages (and it sets a maximum wage increase at the Consumer Price Index, although if a government unit agrees to a raise higher than the C.P.I., that raise will need to be approved through a public referendum — which would seem unlikely)...

there is a limit on conditions...my brother-in-law runs INTO burning buildings in Boston weekly...HIS conditions can be negotiated, but the GOP would kill that...they don't CARE...check out public nurses conditions & patient accidents too

"Collective bargaining" is essentially "the right to discuss and negotiate," and that without question includes issues of safety.

I suggest that the Walker bill can be defeated on First Amendment grounds.
