PERUGIA, Italy — A key prosecution witness testifying in Amanda Knox's appeals trial gave conflicting reports Saturday about whether he saw the American near the crime scene the night her British roommate was murdered.

The contradicting testimony and confused dates offered by Antonio Curatolo, a self-described drug addict and homeless man now in prison for an unrelated conviction, cast doubts on his credibility. The defense called him flat-out unreliable, while the prosecution maintained that, despite some lack of precision, the witness was lucid and clear in what he remembered.

Knox, 23, has been convicted of the sexual assault and murder of Meredith Kercher in the house they shared as exchange students in Perugia and is serving a 26-year-prison sentence.

In the first trial, Curatolo placed Knox and her co-defendant and ex-boyfriend, Raffaele Sollecito, in a square near the house on the night of the murder. He said the two were chatting and added that he remembered seeing buses in the square. The testimony was important because it directly contradicted Knox and Sollecito's claim that they were at Sollecito's house the night of the murder.

On Saturday he repeated that he saw the two "talking excitedly" in the square and said he thought it was Halloween night – which would be the night before the Nov. 1, 2007 murder. He was unclear when Halloween night actually is, saying he thought it was Nov. 1 or 2. Despite the date confusion, he repeatedly said that he saw young people dressed up in costumes.

But, at another point, he also said he clearly remembers seeing police at the house the morning after he saw Knox and Sollecito in the square. Police went to the crime scene on Nov. 2, when Kercher's body was found, stabbed to death and lying in a pool of blood.

"Police and Carabinieri were coming and going, and I also saw the 'extraterrestrials' – that would be the men in white overalls," Curatolo told the court with a smile, referring to forensic experts gathering evidence.

Twice he was asked by Prosecutor Giuliano Mignini whether he was certain that police were at the house the morning after he saw Knox and Sollecito in the square. Curatolo answered: "I'm as certain as I am that I'm sitting here."

He said that in 2007 he was living outdoors in the square in question.

The 54-year-old also admitted to a long-lasting drug habit, including in 2007, saying: "I have always done drugs, ... heroin, which is not a hallucinogen." He also appeared to either lie or be confused when he initially told the court that he was currently living in a home. Pressed, he acknowledged he was in prison.

Curatolo has been convicted on a drug-dealing charge, said his lawyer, Fernanda Cherubini.

Escorted by police but not handcuffed, Curatolo entered the courtroom in Perugia using a crutch, his white hair unkempt.

The defense had long sought to discredit him.

Giulia Bongiorno, a lawyer for Sollecito, said the hearing "marked an important step forward for the defense's arguments."

Chris Mellas, Knox's stepfather, said that "it couldn't go any better today."

"He confirmed that there were disco buses and that he saw the kids getting on and that it was Halloween. Perfect!" Mellas said after the hearing.

The bus detail is relevant because on Oct. 31 several shuttle buses took people to clubs around Perugia for Halloween parties, while the following night discos were either closed or had a slower night. The prosecution, however, maintains that even on Nov. 1 tourist buses, public transport and possibly shuttle buses for some discos could have been operating.

Prosecutors insisted Curatolo remained reliable, if not very precise.

Prosecutor Manuela Comodi said the confusion between Oct. 31 and Nov. 1 is a moot point as it has already been ascertained that Knox was somewhere else – in a pub where she worked – on Oct. 31 and so could not have been seen in the square.

"What's certain is that she couldn't have been there on Halloween night," Comodi said. "There is no such thing as a perfect witness, save for one who has seen the crime. What matters is that a witness doesn't lie, and why should Curatolo lie?"

Francesco Maresca, a lawyer for the Kerchers who are civil plaintiffs in the case, told reporters that Curatolo was as reliable now as during the first trial. He noted that Curatolo said it was not raining when he saw Knox and Sollecito, which would confirm Nov. 1 since it wasn't raining that night but it had been raining on Oct. 31.

Knox and Sollecito have been behind bars since November 2007. Sollecito, who turned 27 Saturday, was also convicted of murder and sexual assault and sentenced to 25 years in prison.

The next hearing is on May 21, when experts reviewing DNA evidence will report their findings to the court.

Knox's young sister Deanna, who arrived in Italy this week, also attended the session.

There are so much questionable, contrived, deviations in the Italian prosecutor's case, it would not pass the smell test in many countries. The fact that the evidence was destroyed, missing or allowed to degrade is bad enough, but the way Knox was interrogated without legal counsel is a dead give-a-way.

The lack of forensic professionalism is clear such as missing fiber analysis from clothing which was never done, suspicious and inconclusive DNA tests do not prove Knox was guilty. Under this appeal she will be found not guilty or there is no justice in Perugia.
The fact that the prosecutor was found guilty of abuse of power is another important factor and the guy is attempting to silence critics by shutting down the blogger site by censoring, threatening to sue Google? Come on-this guy should be in jail for wrongful accusations!

While Amanda Knox languishes in an Italian prison after being convicted of a brutal murder, a retired FBI special agent familiar with the case has come forward to say he firmly believes the 23-year-old American college student is innocent. FBI veteran Steve Moore told "Today" that the evidence in Knox's case was "flawed and manipulated," and possibly even planted. Furthermore, Moore argued, the evidence and testimony that was presented over the course of the trial was still too scant to prove Knox's guilt -- yet sufficient enough to convict Rudy Hermann Guede, a drifter who had been present at the apartment at the time of the murder.

It's just not fair that they feel like their theory of Amanda, Raff, and Rude working together has been proved. When in fact it hasn't. There is still a burden of proof. That being the consesus, Amanda should be freed; without having to prove there were other people involved instead of them. If the defense cannot place anyone else there besides Rudy, they have already made up their minds, it seems. I have not given up hope. I wish the judge would throw out that theory and just convict Rudy, over turning Amanda's conviction. I hope they don't leave it up to that jury of 10 again. That is too many people against her.

The police even questioned Amanda for deleting a text she received from her boss, that said she didn't have to come into work. I do it all the time due to limited space in my phone's inbox.
And with messages I don't need or want to save. They tried to use Everrythingg against her.

Thank you for that J. Butler. For shedding some light on areas and filling in some gaps. Some of the info has been a bit spotty that I've found. Anyhow, just wanted to say also that the prosecution was suspicious of Amanda at every turn. If it was Rudy who broke in, raped Meredith and killed her? And they are saying A & R allegedly cleaned it up for him afterwards. Then why is Amanda getting 26 years, Raffiello 25 yrs., and Rudy- 30 yrs., only having to serve 16?

Good point: How do you clean up a crime scene as to remove all traces of Amanda and Rafaelle, and only leave Evidence of Rudy Guede's behind. (that is Impossible). and clearly shows that Amanda and Rafaelle were "not there" when this most Horrendous crime occurred.

Someone here said that Rudy threw a rock in the window from outside. yet they never found a rock. And just because it was his MO doesn't mean anything. Just as they say Amanda could have allegedly staged a break in, so could Rudy. When you have this many people involved, if they were all guilty, they would all be turning eachother in with certain details. Noone, except Rudy has done that because he knew he was in jeopardy. And I have yet to hear anything someone stated that Raffiello said against Amanda. Only that he went back and changed his story to the police the first time, later he lied and chose not to confirm Amanda's alibi. Which was that they were at his house sleeping all night. No cell phone calls to Rudy from her phone, or vice/versa? How? If these 3 people were supposedly in kahootz? Use common sense. Use old cases as reference material. I watch a lot of Dateline, 48 Hours, and Unsolved Mysteries. They really freaked those kids out. It was something that was so wrong that in my gutt I know and feel that Amanda did not do Anything! After reading my sources of reference, it only convinced me more.

My recollection is that the police found a rock in Filomena's bedroom.  Amanda and Rafaele's defense team asserts that that rock was thrown by Rudy from outside.  That is how he gained entrance, they say.  The prosecution didn't have evidence that the couple were present during the murder.  So, they had to dismiss the notion there was a break in.  But they couldn't say it was impossible for Rudy to have come in through the window.  All they could say was that it was "unlikely."  I have addressed this in depth elsewhere, but according to the guidelines in this blog, I can not re-post.

THEY DID FIND A ROCK! Team Mignini claim that the crime scene was staged as a mean to implicate Amanda and Rafaelle to the crime, Judge Massei in his report used conjecture and illogical assumptions to justify that the rock was thrown from the inside.

Crime scene photos clearly shows glass shards all the way across the room, and away from the window, which could only be achieved if the glass had been shattered with a projectile coming from the outside (in this case the Rock)

This website (TJMK) has proven time and time again not to be Reliable, They do have a copy of the Massei report, but that does not make them "legit" as you say. It is also home to Harry Rag the infamous Amanda Denigrator. thank you.

True. The glass in the pictures looks as if it was thrown from outside, shatterring inward. I did not know that site was unreliable, or that there was a rock found. Thanks for that. That would seem their case against Rudy Guede would be easier to prove. Are they done with putting him on trial? What does this mean for Amanda Knox? They can't get away with putting her away for this crime; she is innocent. She is so young, vibrant and beautiful. It would be a shame for her to spend her days in jail, only to be released when she is old and beat up. How sad.

Nutting. If you read the other posts you will see that there is no alterior motive here. Why is everyone so presumptious? We are doing it out of the kindness of our hearts. It is a very rare thing in the World today. Nothing to gain, believe it or not. I am personally very anxious over this case.

I have never met her , but I feel a close bond to Amanda. I can't explain it. This case gives me nightmares and it wakes me up at night. I feel a kinship to her and I pray for her that she will be okay. Some kind of kindred spirit. I have children her age and my heart goes out to her. It was not fair what happened to Amanda but I do not see Amanda's involvement in the loss of Meredith's life. It is sad that it was cut short by violence. Someone will pay for their sins one day when they meet their maker. Just as {rosecutors thata cut an innoceent girls life short by locking her up forever like some kind of vendetta, is also wrong.Mignini is on a mission. He presumed Amanda guilty even before lab test results for Rudy Guede's dna came back. Amanda had no motive. This was senseless. Good night.

From what I've viewed they do not have a strong case against her. Amanda has no chance in hell going up against these "Big Wigs" in the Italian court. I do think that she has been through Hell. It is unfortunate. I have compassion. It saddens me. I am only expressing my view. And I would appreciate you stop replying to my comments. I don't find them amusing. If you don't agree with them, then please keep your opinion to yourself.
Thank you very much, I have enough stress in my life and do not have any interest in your rude remarks. I will not stop visiting this site because I wake up at night with much anxiety over this case. I feel a special bond with this girl, I can't explain why. I believe in her innocence. She reminds me of my daughter-in-law. I wish there was more I could do, but I can't.
I feel for Amanda Knox and her family. I also feel badly for Meredith Kercher and her family. I don't see that putting 3 people away for life, 2 of which are innocent, 1 being guilty, for the murder of their daughter.
I don't care about your belief in Amanda's guilt. Honestly, I know in my heart that she is innocent. .
I guess we will just have to wait til after the appeal to see what the verdict will be. I will be very happy if she is freed. Good-bye.

We have been reading Mr Butler's comments in regards to this case for quite some time, Mr Butler has demonstrated a high level of integrity in dealing with Facts, and his interpretations of the conjecture associated with this case has proven to be 100% Correct.

Can you please post your Sources of reference? Void the prosecutions attempt to present insufficient, inadequate and innaccurate evidence. What proof are you referring to exactly?
