House Votes To Terminate Obama Administration's Anti-Foreclosure Program

The U.S. House of Representatives voted Tuesday to terminate the Obama administration's signature anti-foreclosure effort, the beleaguered Home Affordable Modification Program. The 252-170 vote broke down mostly along party lines, with Republicans in favor of ending the program.

HAMP, as it's known, has been widely criticized for being far off track from its ultimate goal of modifying mortgages for 3 to 4 million struggling homeowners. Republicans repeated the program's latest statistics on the House floor during debate before the vote: Since the program launched in 2009, fewer than 600,000 homeowners are in permanent modifications as of February, while more than 800,000 homeowners have had their modifications canceled.

"The intent was to help homeowners, but two years after the fact we're left with the cold hard fact that this program has hurt more people than it's helped," said Rep. Patrick McHenry (R-N.C.), sponsor of the HAMP Termination Act, which is unlikely to prevail in the Senate and would almost certainly be vetoed by the White House.

McHenry read an anecdote on the floor about a constituent who'd been trying to win a modification under HAMP for 14 months, a process that is not supposed to take longer than three months. "It's false hope that this program delivers," said McHenry, who also called the program "an epic failure."

Consumer advocates have attributed HAMP's shortcomings mostly to the fact that the Treasury Department, which administers the program, does nothing to punish banks who violate its guidelines. The Treasury Department, for its part, says it can't punish bad banks because the program is voluntary.

Homeowners who are eligible for modifications under HAMP are supposed to be put into permanent modifications if they successfully make reduced payments during a three-month "trial" modification, but homeowners' stories of mixed signals and lost paperwork from their mortgage servicers are legion. Government auditors have reported that the program sometimes lures foreclosure-bound homeowners into making futile extra payments, and that in some cases the program even causes the foreclosures it's designed to prevent. Several homeowners have sued their banks over HAMP mods gone awry.

An internal report prepared by the Treasury Department's fledgling consumer protection bureau found that banks have saved $20 billion since 2007 by taking shortcuts in the processing of struggling borrowers' loans.

"We strongly oppose the action taken today by the House of Representatives to terminate the Home Affordable Modification Program," said Treasury honcho Tim Massad in a statement. "This program has helped hundreds of thousands of families across the country avoid foreclosure, and each month it continues to help tens of thousands of additional homeowners. Moreover, it has helped establish better standards for the mortgage industry that have resulted in millions more being able to stay in their homes."

Democrats criticized Republicans for pushing to eliminate HAMP without offering any sort of alternative anti-foreclosure effort.

"It makes no sense to say to 500,000 people, 'We want you to be homeless. Good luck, you're on your own." That's basically what they're saying," Rep. Jim McDermott (D-Wash.) told HuffPost. (The bill would not end the program for homeowners who are already in HAMP loan mods; the Congressional Oversight Panel estimated in December that altogether 800,000 homeowners could potentially receive HAMP modifications.)

McDermott has emerged as a HAMP defender in recent weeks. "You got to get the servicers to play better with the program. They simply don't want to do it."

A coalition of 50 Democrats, led by Rep. Maxine Waters (D-Calif.), sent a letter to the Treasury Department Tuesday outline recommendations for improving the program, among them a single point-of-contact for homeowners applying for a mods and eliminating the "dual track" that allows the foreclosure process to proceed at the same time as the modification process, a point of confusion for many borrowers.

Waters, a senior Democrat on the House Financial Services Committee, which approved the HAMP Termination Act earlier this month, proposed an amendment to require the Treasury Department to notify all HAMP applicants "that they will not be considered for a modification due to termination of the program, and that they can contact their Member of Congress for assistance in negotiating with, or acquiring a loan modification from, their servicer." The amendment was approved.

The Congressional Budget Office estimated that the HAMP-killing bill would save $1.4 billion.

For once, I'm in agreement. I went thru it and I know that in most cases people were either turned down - or strung along until they lost their home anyway. This was a plan with no teeth and the banks took full advantage of it :-(

The President's plan MHA/HAMP worked for me! 2% for 5 yrs..no higher than 4% afterwards. Unfortunately, my hrs were cut recently (casino) cannot pay both mortgage & condo fees. I'm in the process of doing the NJ Homekeepers Program..offers up to $48 thous. (no interest) for those who lost their jobs or underemployed. Pray it all goes well...it's my last resort.

I think that Pres. Obama meant well when he establised the Modification Program for Mortgages. Unfortunately, as citizens commenced the process, there was much confusion coming from the public because of all the contradicting statements issued by reliable sources that this program has been detrimental to citizens applying because banks/servicers/lenders have documentation which has been lost, deliberately or not, and therefore has been used against the applicant. This has created a lack of confidence in the program and the banks/lenders who handle it. I am not sure what Maxine Waters proposed and received approval will resolve this terrible, terrible situation where banks/lenders/servicers are in effect getting away with denying applicants due to no documentation on file which would favor the applicant to the point that judges are refusing to process the foreclosures applications from banks/lenders/servicers. More and more it seems that banks, etc. are getting away from what they are supposed to be doing and, on top of that, they were bailed out. Citizens in need should be given bailouts, just as the banks got - most of them doing extremely well now. We must stop this situation! And...furthermore, what is going to happen to us whose mortgagor is Freddie Mac because the mortgage was transferred to them without informing us. I t has been announced that Freddie Mac is no longer going to be under the Government's conservatorsip. This is a mess!

It's time for HASB. Housing Assist to Sue the Banks! remember, every promissory note issued by a bank to a "borrower" becomes an ASSET in the banks books. There is another unknown set of books, called liabilities. That means the bank owes the borrower the amount of the loan, because the Bank uses the note, when deposited, as a cash asset,that it can sell, or lend out 9x the amount of the loan, thereby collecting the original amount, therefore there is no debt to the borrower. The borrower, can make a demand upon the Bank,for that amount to be refunded to them.

Not for us. Saved our home with a permanent modification starting at 2% and topping at 5%, with no balloon payment, paid in full in 23 yrs. It was a huge success for us and we are most grateful.

I was turned down for modification (not enough income) - yet I was able to refi with the same bank. Saved my home and got 3.875 percent for the life of the loan.

The whole problem lies in the word voluntary. The fact that the banks are still steering the ship is what will cause it to sink. It should not be optional. Banks should be required to participate. I tried to get a mod because the bank is charging me a ridiculous amount of interest, but I was denied.

Yes, the interest rate I got was the best anyone would do for me. I am paying 7.75% on a 15 year mortgage. I needed the mortgage because we built a house and the construction loan was coming due. The bank made promises to me that they didn't keep. I thought I'd be helping the local economy by keeping my mortgage local. I was suckered into an ARM loan years ago on my old house, and refinanced to get out from under it. Now I have no idea who owns that note since the company I worked with went bankrupt and the VP is in prison for mortgage fraud.

I had heard somewhere that the banks are only modifying 4 percent of all the applications. Sounds true - modify just enough so that they can't be blamed for not modifying at all. The whole thing is kind of a nasty joke on us :-(

There is only one way: refinance with a credit union. I left Bank of America and Citibank behind, and you can too. Only a fool stays in an abusive relationship, and our banks have been abusing us.

THE TRUTH IS: 1. Obama is confused about the cause of all the foreclosures and does not know how to deal with the problem. He lacks the guts and leadership skills to force the banks to back off abusing the homeowners they hurt and provide real modifications on a case by case basis.

THE TRUTH IS: 2. The Republicans and Conservatives are also confused as to the guilt of the banks and wall street and regard any attempt to reign them in as an attack on capitalism. BE CAREFUL PEOPLE because the next thing the Republicans will try to pass is a bill which allows the banks to bulldoze all the people in foreclosure and take their homes without due process of law. They have been attempting that in many states under the guise of speeding up the overburdened legal system when it really is an attempt to allow banks to abuse people without the protection of the courts.

THE TRUTH IS: We are all in DEEP DOO DOO ...Have no leadership and before it's over we will have a civil war that will rock the world we live in.

HAMP did more harm than good. Truth is that it gave too much control to the banks since it has been proven that the BANKERS in league with Wall Street CAUSED the Housing Bubble by creating a money machine that distorted the supply demand factors of the housing market. The Banks pushed mortgage instruments such as the subprime loans which were designed to force the borrower to refinance. Low income borrowers should have never been given loans which increase the principal and payment in a short time. This caused the defaults when the interest rates spiked. What did the banks expect? HAMP was a prime example of President Obama's lack of experience, leadership and backbone because it allowed the banks to harass and toy with innocent Americans, since they were given all the controls. President Obama should have set up a formula with rules for both homeowners and the banks to follow. Homeowners need real modification and not just those in default since many honest homeowners have been hanging on by a thread. The banks also must me forced to prove that they are the rightful owners of the property since in many cases they transferred ownership to foreign investors through securitization and lastly, MERS (mortgage electronic registration system) should be uniformly declared illegal and recognized as a cloud of the title of every mortgage containing that language and the banks should be forced to accept the losses that result for their greed.

The US has only 3% of the world's oil reserves, but uses 25% of the supply. There is no way on god's green earth that we can 'solve our oil issues' by drilling, even if we could wave a magic wand and miraculously access every drop of oil available to us tomorrow.

I agree for the most part, but there are parts of Alaska that could hold much more crude than we know at this point and time. If the US sent the message that we were going to aggressively extract oil from all known sources, and explore those regions that are currently off-limits the spectulators would not be able to drive the price up as easily. Our country was built on cheap energy, low (or no) taxes and a very strong military machine. It will take the same to fix what's broken in our economy. Unfortunately, the current administration lacks a special leader that has the skills necessary to bring us all together to insure success in these very important areas.

Oh boy - that is SO true. We almost had developers take over half the city here a few years ago. Thankfully thru a grassroots effort we got a referendum to stop them! You have to have eyes in the back of your head these days!

The banks made a joke of this program. I tried modification but was turned down because my income was too low (I'm retired). But the very same bank allowed me to refinance my home at a lower rate and they sure scooped in those closing costs. The whole thing was dirty - and I'm glad this program is gone! I doubt it helped very many people.

They did the same thing to my neighbor,These Banks are destroying peoples lives and our leaders are allowing them to get away with it.To me it's inhuman.But to them it's all about the money,not about the familys displaced.But we need to remember one thing,What comes around goes around.One day their world will come to a crash,and when it does,no one will be willing to help them either.

Just for the record that was Bank of America THE very worst! I was too poor for a modification but not too poor to refinance and pay them lots of closing costs. At least I managed to save the roof over my head.

I know many people who lost their homes through foreclosure. We still have many homes around my area with foreclosure signs on them!

Anyone and everyone newly at risk of foreclosure should simply stop making mortgage payments. The average distressed property is 17 months behind on payments. In early 2010 it was 11 months. With a few exceptions, you're likely to be able to keep living in the home for two or more years without making a mortgage payment. Then what you do is save every penny you can after covering property taxes and minimal maintenance.

Just before they do finally get around to kicking you out, take the 24+ months of saved mortgage payments and either rent one of the many available homes or jump on a nearby foreclosure at auction. If you do it right, you can get into a new place for 40-50% of your current valuation, have a big down payment from the 24 months of no-mortgage-payments, and then sit pretty in your nice new home while giving a firm middle finger to your old bank.
