Eric Holder Lashes Out At Congress Over Decision To Try KSM In Military Tribunal

WASHINGTON -- After announcing it would try 9/11 mastermind Khalid Sheikh Mohammed and four alleged conspirators by military commission rather than in a civilian trial, the Obama administration quickly scapegoated Congress to explain the decision.

Attorney General Eric Holder announced Monday that his department was scrapping its November 2009 decision to hold Mohammed’s high-profile trial just blocks from the World Trade Center. Instead, they were moving the venue to Guantanamo Bay. Holder and other administration officials said the policy reversal was due to congressional interference in executive counterterrorism efforts and “needless” drumming-up of controversy.

“The reality is, I know this case in ways that members of Congress do not,” Attorney General Eric Holder said during a press conference. “I have looked at the files. I have spoken to the prosecutors. I know the tactical concerns that have to go into this decision. So do I know better than them? Yes.”

The attorney general said had not arrived at the decision comfortably. Had he had his druthers, Holder claimed, he would have kept the trial in its original setting, but the legislative branch controls the money for transferring the prisoners and securing the site.

The Ike Skelton National Defense Authorization Act for Fiscal Year 2011 prohibits use of funds to transfer defendants from Guantanamo Bay to the United States. In a file dismissing the indictment of Mohammed and the four alleged conspirators sent to the Southern District of New York on Monday morning, members of the U.S. Attorney’s Office pointed to the act as the prohibitive restriction preventing a federal trial.

Before Holder’s announcement, a Department of Justice official said that a military commission trial had become the “only option available given congressional restrictions.” If the message wasn’t clear enough, White House Press Secretary Jay Carney cited “congressional reaction to some of the goals that were laid out” as one of the reasons for the reversal. Asked whether blaming Congress was going to be the simple pushback, another official replied, “We're just explaining the facts.”

“[Congress has] taken one of the nation’s most tested counterterrorism tools off the table and tied our hands in a way that would have serious ramifications,” Holder said. “We will continue to seek to repeal those restrictions.”

If the Obama administration were seeking to make a villain out of the legislative branch, they had willing partners in some congressional lawmakers. Senate Minority Leader Mitch McConnell (R-Ky.) took a break from budget negotiations to praise the administration for following the will of an “overwhelming bipartisan opposition from the American people and their elected representatives here in Congress.” Senator Chuck Schumer (D-N.Y.) called Holder’s announcement the “final nail in the coffin of that wrong-headed idea,” referring to the possibility of a civilian trial. Rep. Peter King (R-N.Y.), chair of the Homeland Security Committee, described the change as “a long-awaited step in the right direction.”

Others in Washington seemed to agree with Holder that Congress had played a guiding role in the reversal of course. “I believe that the Congress forced the president into this decision,” Col. Lawrence Wilkerson said, “first, by their abject lack of courage in not wanting [Mohammed] tried ‘in their city, in their courtroom,’ and, second, by their inability to present the president with an alternative other than the military system.”

But Wilkerson, a onetime chief of staff to Secretary of State Colin Powell, refused to absolve the Obama administration entirely. “Of course the president, in complying, demonstrated a decided lack of moral courage as well,” he said.

It appears debates over the legal parameters of national security law don’t break down perfectly either along party lines or between branches of government. And while the vast majority of lawmakers praised moving Mohammed’s trial back to Guantanamo, others expressed both disappointment with the development and with what they considered to be Obama’s willingness to let it happen.

"I felt that if the scene of the crime was New York, why not try him in New York?" Rep. Jose Serrano (D-N.Y.) said. “I don't think we should do anything that gives the terrorists the ability to say they've disrupted the normal way we do things. Normally, we would have tried [Mohammed] at the scene of the crime.”

Michael Ratner, president of the Center for Constitutional Rights, said, “Had [Obama] showed some courage to begin with on these national security issues, I think he could have made huge gains.” But, he added, “Obama backed down every time there was a whiff of an oppositional problem on national security.”

Two border agents were murdered by weapons allowed by the DOJ to be sold to straw purchasers who were already known to be running guns to Mexican drug cartels. The DOJ had to be Congressionally SUBPOENAED in order to FORCE them to release information that turned out to be missing 400 pages of what Congress requested and here's Holder squirming to explain the DOJ's actions.

This is just outrageous! Where is the coverage of this? HOLDER MUST BE FIRED!!!

Terror Trials Move Again

JUSTICE AND FAMILY FUN COEXIST

In another government shutdown threat by the Tea Party, President Obama and Attorney-General Holder agreed to move the terrorist trials again. Extreme right wing pressure have kept Gitmo open and prevented the trials in New York - now, the President finally threw in the towel.

Meeting the Tea Party demand, the President agreed to hold the trials in the Ark Encounter exhibit in the Kentucky Creationism Theme Park.

A beaming Rand Paul (R-KY) said "We are all Kentuckians today. The world will see benevolent Christan justice when we hold hands in prayer just before the executions occur at the park's Tower of Bable". Paul added "I probably shouldn't be disclosing this publicly as the park won't open until 2014".

The judges will consist of three Pastors who will be on-duty that day - and in the finest example of democracy, the 12 jurists will be randomly selected from the park-goers - the jury members, however, must be at least 4 foot 3 inches tall.

KSM, the 9/11 Mastermind Killer and Muslim Islamic Extremist seemed worried by the change of venue. He breathed a sigh of relief when told the other venues considered were Pete King (R-NY) IRA's office in Tipperary, Ireland and Temple Square, Salt Lake City.

FOX News reported that Kentucky's senior Senator Mitch McConnell said he "just cannot wait to see the 2 turtles they pick for Noah's Ark".

Justice system in America is a LAUGHING STOCK!

We used to have the BEST Justice System in the World.

Now we just want to have a quick trial OFF-SHORE followed by a QUICK Execution. How can you fairly try people you have tortured for 9 years? Torture ends any chance of a fair trial.

Justice in USA Disappeared when Bushco was NOT brought to trial, with Obama saying, “We MUST LOOK FORWARD!”

Well, see, that would be unconstitutional as well as illegal. Summary executions are what happens in Taliban-controlled Afghanistan. We would be literally no better than they are if we started doing that too.

Holding them in Guantanamo indefinitely without trial, however, may have a legal basis in the Geneva Convention. You see, the detainees, being civilians, not wearing a uniform, not adhering to a command structure, etc. are considered unlawful combatants. The Geneva Convention allows nations to try any unlawful combatants in either military or civilian court for violations of domestic law (such as murdering Americans), and can also just hold them until the end of the conflict if they wished. Since the War on Terror is likely to go on indefinitely, we can invoke the Geneva Convention to hold these people indefinitely.

Let me get this straight. Holder can't hold terror suspects trials on US soil because congress won't pay for it? Seriously!? So the Democratic Process is being held hostage by Politicians. Really!? Holder says he knows more...that I know is true. He can actually put a name and a face to the person responsible for killing US citizens and bringing our towers down. And it's not KSM. KSM is known as the "PAYMASTER" but the "PAYEE" was Ali saleh Kahlah al-Marri. The now convicted terrorist whom next to nothing is known by the American Public. When the powers that be deny the facts to see the light of day, that can only be gotten in an open and transparent forum, such as a US court room. the powers that be are denying the Democratic Process itself. Further more, when those who know fail to inform the people of the actions of pricnipal players in 911, it gives the appearance of manipulating and or preventing an open dialog that is a guarenteed right of the US citizen. The FBI claims that al-Marri was taken into federal custody on Dec.12, 2001. This is not the whole truth! He was actually captured at Detroit Metro Airport on Nov.27,2002. This fact was documented by 5 different agencies. I know this to be true, bec I'm the one responsible for his capture! The American people must demand an open forum, answers,starting with who is Ali al-Marri.!??

And yet we hear the news media blaming Obama for not keeping his promise when it was Congress that prevent it. Obama could have left them in limbo, but at least he is trying. I agree with what Holder is saying.

You going to wait until he is out of office and done nothing he promised to criticize or hold him accountable - when it no longer matters? When there is no longer any possibility of pressure to make it happen? If you had an employee not doing what you told him to do on a daily basis, would you wait 4 years to say anything or try to get him to do his job? Geez, with people like you giving politicians a free pass, no wonder our government doesn't work. Those people were voted in by us to work for us to do the things they promised, not to whine about how hard it is and then roll over at the drop of a hat rather than fight to make it happen.
