States Seeking To Limit Abortion Rights To Unprecedented Degree In 2011: Report

In the wake of the election of a new wave of conservative state legislators, lawmakers across the country have advanced abortion-limiting legislation to an unprecedented degree, according to a new report.

Of the 916 measures related to reproductive health that have been introduced since January, a record 56 percent restrict abortion rights in one way or another, the Guttmacher Institute report found. In 2010, 38 percent of bills relating to reproductive health restricted abortion rights, according to the report.

"This is a big jump, and it says that anti-abortion legislators want to be very active on this issue and they have some momentum," Elizabeth Nash, a public policy associate at the Guttmacher Institute, told HuffPost. "They used to chip away at Roe v. Wade, and now they're hacking away at it with a cleaver."

More than 120 bills limiting abortion rights have been approved by at least one chamber of the legislature so far, and the 15 bills that enacted into law include a bill in Utah that limits abortion coverage in all private health plans and laws in Utah and Virginia that require their health departments to develop new regulations governing abortion clinics.

Some states are making it exponentially more difficult, both financially and psychologically, for a woman to have an abortion. In South Dakota, a woman now has to wait at least 72 hours after seeking an abortion to have the actual procedure and is legally required to obtain counseling from a "crisis pregnancy center" -- which are unregulated by the state and have the explicit goal of talking women out of abortions -- before having the procedure.

South Dakota has also mandated that the physician performing the abortion counsel the patient in person about the health risk factors relating to abortion prior to her 72-hour waiting period. This limitation, in a rural state like South Dakota with very few abortion providers, can put an unnecessary burden on low-income women trying to balance work and childcare.

"In South Dakota, there's one provider and he flies in once a week, so in practice what would happen is that a woman would go on a Saturday or a Friday, get the counseling, and then have to wait at least a week for the provider to come back," said Nash. "They're saying the three day waiting period is no big deal, but it is, particularly for women who aren't well off and can't take off work and have to deal with childcare. A lot of burdens are placed on a woman when she has to make these two trips."

In addition to imposing pre-abortion waiting periods, legislators in 13 states have introduced laws forcing women to obtain an ultrasound procedure before having an abortion. Bills in seven of those states -- Alaska, Indiana, Kentucky, Montana, Ohio, Rhode Island and Texas -- would require the woman view the fetus and hear a detailed verbal description of it before undergoing the mandatory waiting period.

"This bill just allows them to see the child inside of them, so it's not just out of sight, out of mind," said Alabama State Sen. Clay Scofield (R-Albertville). "It's critical in their decision-making process."

Conservatives are also trying to impose gestational limits on abortions at an unprecedented rate, according to the Guttmacher report. Legislators in 17 states have introduced 35 measures patterned on a 2010 Nebraska law that bans abortion at 20 weeks, based on the presumption that a fetus feels pain at that point. Two of those measures would ban abortions beginning at 18 weeks.

Nash, an expert on state abortion policy, said she sees the wave of new legislation seeking to roll back abortion rights as a result of several factors: the recent influx of conservative state legislators (Republicans picked up 20 state legislative chambers in the 2010 elections); the health care law, which spotlighted abortion as an insurance issue; and a few recent anti-abortion legislation successes at the state level that are serving as model legislations.

"Over the past several years, states have been successful in adopting some abortion restrictions, so they're building on that success and pushing the envelope on what new kinds of restrictions they can adopt," she said. "They want to make these restrictions even more onerous."

A spokesperson for NARAL Pro-Choice America told HuffPost they are currently focusing on 374 anti-choice bills introduced so far in the 2011 legislative session, compared to a total of 174 in 2010.

"Anti-choice politicians in the states are mimicking the extreme, far-reaching agenda that Speaker Boehner and his allies are advancing in Congress," said Nancy Keenan, president of NARAL. "Much like their counterparts in Washington, state lawmakers have abandoned their promise to focus on jobs and the economy, and instead have opened the floodgates on a wave of bills that interfere in women's personal, private decisions."

I have been unable to find our exchange on this thread so will repost it here--

who38 I am saying that if one has the right to exist, they must have economic rights as well.  After all, it is impossible for a newborn to provide for its own needs.  And, if you  (the government) makes the decision that the child must be born, I assume that you are, also, willing to provide for its care.  Certainly, it is not the responsibility of the vessel (woman) who carried the child as she has been denied any opportunity to make a decisions; she is merely a surrogate who is carrying out the wishes of others.posted Apr 15, 2011 at 12:26:20    


Reply     Linklanded right My fault didn't understand what you meant but unless we talking about less than 1% of all abortions in which I truly feel very sorry for all involved, the vessel choose to have sex and there is accountability for all of our decisions. I believe the private sector would adopt more readily if so much power wasn't given to the natural mother where she can come back and legally claim guardianship years later. But your point is valid and I would propose we send the $300M we give to PP to medicaid for the expense of having a baby. After birth, the adoptive parents naturally assume all costs. Not perfect solution but do you think it has merit?

Who38:  What part of government funding to  Planned Parenthood CANNOT BE USED FOR ABORTIONS?  It is used to help women avoid pregnancy by practicing the PERSONAL RESPONSIBILITY of birth control, something that men generally fail to consider. (Also, it doesn't feel good.)

Regarding  the "merit" of your plan, I think that failing to support Planned Parenthood will result in even more unwanted children and that your $300 million proposed donation will not begin to solve the problem.

 US women who give up a child must sign forms indicating that they will not rescind their decision and many of the problems to date have come from "private adoptions" which may be more lenient in determining who can become an adoptive parent.

You can rationalize this anyway that allows you to live with yourself. But when that EGG has hands with fingers, a heart that beats, lungs that breath and a brain that dreams, it is more then just a fertilized EGG.

We all demand that people think about what they do. That is why we have laws. And this law is about to change. Just because I support your right, does not mean I support them in ALL situations. There is a point beyond which a spanking becomes child abuse and there is a point beyond which an abortion become a crime and a point beyond that when it becomes murder. These points will be determined.

Don't need to know anything about a criminals life to demand that they obey the law.

To the Zealots that want to complain that people should just use protection or get them selves fixed here's a fact for you, protection isn't full proof. Add to that if you're a woman good luck finding a doctor that will tie your tubes if you are

A) below the age of 30
AND
B) don't already have a kid

Heck I have a friend that is 31 doesn't have kids and doesn't want kids and the docs still won't tie her tubes for her. Oh and by the way she has to rely on Planned Parenthood for the birth control pills because she doesn't have insurance.

Are all of you Zealots out there going to make her have a baby that she has been trying to NOT have for years just because your moral blinders won't see the whole picture

Yes! You are correct in that it is INCREDIBLY DIFFICULT for a childfree woman to get sterilized. There is an assumption in society that we'll eventually change our minds. Well, they're wrong. I was 33, no children, and I had to beg for my tubal. I think that one reason why I was able to get one was because i was going in for another surgery, but I thank G*d everyday I was able to get a tubal.

Similar here, I was 26, had one child and was having issues with the pills and seriously didn't want any more kids. I had to go to four different doctors before one would finally tie my tubes. What right does the medical establishment have to deny us our choice in this.

Rachel did a great piece on this last night. There are about six states where it is vitually impossible to get an abortion right now. But, because of the makeup of the current Supreme Court (since Alito came on borad), no one is willing to file suit against these new laws.

Women have the right to choose an abortion because it is their bodies that are involved in the pregnancy. For those of you who are uninformed, a person's body belongs to themself. Yes, that's right. No one else. Until a baby is seperate from the mother, that baby is part of and involved with that particular woman's body, and she alone has the final right to say what will be done to it, because it intrinsically involves herself. A woman who is pregnant has the right to decide what to do with the pregnancy because it is her body that is involved until the baby is born, or not born. If a man wants to become involved in the decision of abortion, he cannot; it does not at that point involve his body any longer. He can decide to have sex (with consent), or not. If a woman becomes pregnant and decides to keep the baby, then he is, along with her, legally and morally responsible for the care of that child. If a man does not want to take that risk, then he shouldn't have sex. Period.

Note the States which most want to limit, or make abortion illegal with few exceptions are among:

1. Highest instances of poverty in the U.S.
2. Highest instances of early death in the U.S.
3. Biggest proponents of capitol punishment in the U.S.
4. Lowest high school graduation rates in the U.S.
5. Highest instances of gun deaths in the U.S. by population
6. Highest levels of obesity in the U.S.

This is purely a religious issue. Roe v. Wade decided this matter once and for all. The matter should be closed and women have a right to choose.

Couldn't agree more!  This is what happens when you can only teach abstinence as a form of birth control in school health programs.  It is ridiculous to think teenagers with raging hormones are going to be playing tiddlywinks instead of looking for more ways to grope each other.

I once read a statistic that was very sobering. Eighty (80) percent of the people who come to Planned Parenthood have already been sexually active before they enter the premises. PP is not encouraging sexual activity. they are simply trying to ensure people don't have to make a really tough decision about abortion in the future.

Notice every legislative measure these radical religious fanatics are taking is to "deny" WOMEN or to "force" WOMEN.

This is the religious right's puritan war on women, to "put us in and keep us in our place" as they see it.

Deny Contraceptives and then
Deny abortions!
Deny Insurance for Contraceptives and abortions
Deny Public School sex and health education
Deny condom education and free clinics supplying them for protection.
Deny equal pay
Deny Public School teachers (who are mostly women) benefits, reduce their pay, and deny them the right to bargain for those things and lay them off....in fact get rid of Public School altogether.
Force women to give birth
Defund therefore DENY poor women's children's school lunches, after school care, Food Stamps and MEDICADE.
Force women to have Ultrasounds they do not need AND can't afford, because Conservatives have forced Government Health Care Plans to not provide funds to cover anything that has to do with abortions, and shut down the Planned Parenthood Clinics designed to provide medical services for low income WOMEN'S needs.
Force women to pay for their reproductive services out of pocket by DENYING them PRIVATE Health Insurance to cover the costs.
Force grown adult women to watch "Government ordered" ultrasounds and listen to "Government" ordered lectures.

Pay attention women...AND men who care about women and their rights in America.

The resulting outcome of all these attacks on women's Rights and Freedoms, if they succeed, is OBVIOUS.

Passed in AZ....gender and race specific abortions...against the law. I live here and this is the first time I've heard we have a problem. Maybe all this is political theater, or maybe we're moving towards a form of govt like theocratic fascism (is there such a monster)? If not we'll invent it. What ever happened to freedom of choice? Why would women allow this cr@p to continue? Come on Girls, you're 51% of the population don't let someone else, (probably a rich white guy) tell you what's best for you. Most telliing we have a woman governor, she lets this cr@p go on, heck if you look close you can barely see her strings!

Why is it only women who should start yelling about this issue? Men should start yelling too, not only because they respect women and are concerned about protecting women's Freedom and Rights as well as their own, but because if we women lose these particular Rights, they need to seriously consider exactly how it WILL affect them too.

Bunch of lying fanatics who have latched onto one facet of this issue and will say "anything" to emotionally milk it for votes.

Conservative's pretense of caring about "life" sickens me as they are now as we speak, praising a budget plan that takes the food right out of the mouths of BORN BABES with their BUDGET CUTS as well as the Health Care those babies need, and BTW those BORN baby's MOTHERS need too, and actually be PROUD of their cuts to the very programs that help those children who ARE born survive.
