Wisconsin Union Law Challenge Dismissed By Judge While Additional Lawsuits Remain Pending

MADISON, Wis. — A judge on Thursday dismissed one of three lawsuits challenging Wisconsin's divisive law restricting union bargaining rights, but left open the possibility it could be filed again with slightly different plaintiffs.

Dane County Circuit Judge Maryann Sumi dismissed the lawsuit filed on behalf of the county by Democratic County Executive Kathleen Falk. The judge said Falk can't sue because state law forbids an agency or arm of government – like a county – from challenging the constitutionality of state laws.

Falk and Dane County Board Chairman Scott McDonell, however, also have requested to challenge the law as private citizens. Sumi said she was not yet considering that request and a hearing on that issue had not been scheduled as of Thursday.

Falk's lawsuit alleged both that lawmakers broke Wisconsin's open meetings law and violated the constitution by passing the collective bargain bill without the proper quorum.

Republicans said they stripped spending items from the bill so it could pass with the lower quorum requirement while all 14 Senate Democrats were on the run in Illinois. Falk alleged spending items remained, requiring at least 20 senators to be present for the vote.

Falk issued a statement saying Thursday's ruling doesn't resolve the questions she raised in the lawsuit.

State Department of Justice spokesman Bill Cosh said the agency was pleased with the ruling, but the department would continue efforts to defend the lawsuit should it be kept alive with Falk and McDonell named as plaintiffs in their capacity as private taxpayers.

Another lawsuit brought by the Dane County district attorney, also alleging the state open meetings law was violated in the process of passing the bill, is ongoing. Sumi indefinitely blocked enactment of the law earlier this month while she considers that case.

A third lawsuit challenging the law pushed by Republican Gov. Scott Walker has been brought by firefighters and other public workers.

The law in question takes away nearly all collective bargaining rights from public workers and also forces state employees to contribute more toward their pension and health care benefits, amounting to an 8 percent pay cut. Those deductions were supposed to have started earlier this month but are on hold per Sumi's earlier ruling.

The Walker administration is asking the Wisconsin Supreme Court to dismiss the original lawsuit brought by the Dane County district attorney and undo the order putting the law on hold. The court has not said whether it will take the case or not.

Republican legislators passed the law in March despite a bitter standoff that resulted in 14 Senate Democrat fleeing to Illinois for three weeks and pro-union protests that drew as many as 85,000 people to the Capitol.

Another rally organized by tea party supporters and featuring former vice presidential candidate Sarah Palin was expected to attract thousands to the Capitol on Saturday.

'Wisconsin Unions Get Ugly
Now they're threatening businesses that stay neutral in the state's budget battle.

'Having lost their fight in the legislature, Wisconsin unions are now getting out the steel pipes for those who don't step lively to their cause. A letter we've seen that was sent to businesses in southeastern Wisconsin shows that Big Labor's latest strategy is to threaten small businesses with boycotts if they don't publicly declare their support for government union monopoly power.

'Dated March 28, 2011, the letter is addressed to "DEAR UNION GROVE AREA BUSINESS OWNER/MANAGER," in Racine County. And it begins with this warm greeting: "It is unfortunate that you have chosen 'not' to support public workers rights in Wisconsin. In recent past weeks you have been offered a sign(s) by a public employee(s) who works in one of the state facilities in the Union Grove area. These signs simply said 'This Business Supports Workers Rights,' a simple, subtle and we feel non-controversial statement given the facts at this time."

'The missive concludes by noting that, "With that we'd ask that you reconsider taking a sign and stance to support public employees in this community. Failure to do so will leave us no choice but do [sic] a public boycott of your business. And sorry, neutral means 'no' to those who work for the largest employer in the area and are union members." '

LEAD STORY:
The suit dismissed was a second suit filed by our county exec..thanks Kathleen!

The REAL SUIT which has barred enactment of the union-busting law remains in court, and there is a restraining order in place until SCOTT, SCOTT and CO. waive their 'right' to immunity while the state legislature is in session, and face the charges in court.

There couldn't be anyconflict of interest here right!

Maryann Sumi the judge that has ruled against the state has a clear conflict of interest. Her son is a political operative who also happens to be a former lead field manager with the AFL-CIO and data manager for the SEIU State Council. Both the SEIU and the AFL-CIO have members who are public-sector employees in Wisconsin. In fact, as a federation, the AFL-CIO can boast of several member-unions that represent public-sector employees. Maryann Sumi is hardly an unbiased judge in the matter. She's the same judge that helped the unions get a law passed that FORCED all public employees to pay dues to a union - even if those employees didn't want to join.

Wisconsin open meeting law. Any meeting to pass legislation has to be posted for 24 hrs. They just called the meeting when no dems were there and passed it with no prior notification; this nullified their protest, the point of their not having a quorum. It was a parlimentary illegal trick.

Story line....."A decisive new governor, trys to destroy long standing unions in his state, and while all the people of his political party are cheering him on, the majority of the citizens are up in arms against him. He is called to Washington to testifiy in front of a House Commmittee about his actions. Col Walkers views himself as a rising new political figure, with aspirations of running for President.
When he arrives in front of the House Committee, he is is not greeted as a rising new political figure, as the questions he is answering, proves he was lieing to the public about his intentions .........What will Col. Walker do, and how will he get out of the mess he created??"

This would be a great movie, if it wasn't true...but it is true, and it proved that he lied to the citizens about what he was going to do...and it never had to do with the budget.....

That would be too little, too late. There is much to do before the vote if you want success. Do you think the corporate powers are going to just wait for the election? Please don't be chumps. Organize and keep those recalls on track! You are going to be challenged all the way in ways you can't even imagine yet!
