Delaware Same-Sex Civil Unions Law Heads To Governor For Signature

DOVER, Del. -- A bill that makes Delaware the eighth state to allow civil unions or domestic partnerships for same-sex couples has cleared the legislature and Gov. Jack Markell said Thursday he looks forward to signing the measure into law.

House members debated for about three hours and rejected nine amendments before approving the bill on a 26-to-15 vote, prompting supporters in the balcony erupt in cheers and applause. The Senate last week had approved the bill.

Opponents warned that the bill carries unintended consequences that will result in confusion in family law courts and likely will lead to lawsuits over religious liberties for those opposed to same-sex unions.

"Mark my words, there will be litigation over this," said Douglas Napier, an attorney with the Alliance Defense Fund, a conservative religious rights organization.

With Markell's signature, the bill will take effect Jan. 1. The legislation gives gay couples the same rights and obligations of those who are married. But it makes clear that marriage is between a man and a woman. Five other states and the District of Columbia allow gay marriage.

"I think it's time for this bill to be passed, and it's going to be good for so many Delawareans for years to come," said Markell, a Democrat. "I'm really pleased with it."

Supporters say the measure provides equal rights for homosexuals in committed relationships.

"We were all created with special, unique, beautiful differences," said chief House sponsor Rep. Melanie George, D-Bear. "Our government respects those differences."

Others argue it is a prelude to establishing gay marriage in the small state of about 885,000 people.

"Don't be deceived. This bill is a precursor to same-sex marriage," Napier said.

Lawmakers voted mostly along party lines Thursday, with Democrats in favor and Republicans voting for amendments opposed by the bill proponents.

New Castle County Republicans Nick Manolakos and Michael Ramone broke ranks with the GOP caucus to vote for the bill, while conservative Democrats William Carson of Smryna and John Atkins of Millsboro voted against it.

"I truly believe in my heart it's the right thing to do," Manolakos said.

Eight of the nine amendments were offered by GOP lawmakers, including two similar to those that were rejected in the Senate last week. One would have authorized civil unions for man-woman couples, not just those of the same sex. The other would have required that Delaware voters approve civil unions in a statewide referendum before they could take effect.

Lawmakers also defeated an amendment offered by Carson stating that no one could be held liable for refusing, for religious reasons, to participate or assist in any event related to a marriage or civil union.

George said Carson's amendment would allow a business owner to refuse service to an interracial couple or to a married couple of different faiths on the grounds that it offended his religious sensibilities. She suggested that such discrimination would roll back the progress made in civil rights over recent decades and take society back "to a dark place in our country's history that we fought to get rid of."

"That is not what Delawareans want," she said.

Critics also said the financial impact on businesses and the state, which will face added costs for health care benefits for partners of state employees, has been underestimated.

Frankly, I don't care what it's called so long as I get to be by my partner's side in an emergency. Oh, yeah, and all those tax breaks that teh str8s get would be nice, but I'm not holding my breath.

I think we should just get the government out of the marriage business. Civil Unions for all, if you want to "get married," go to a church or institution to get a "ceremony" and "certificate." The government should end this controversy by calling them Civil Unions and just dealing with the legal aspects.

Nope. Here in Massachusetts, we solved the problem by having marriage for everyone. Churches still marry who they want to marry, and everyone ends up married. Just like always. I'm married and an atheist. There was nothing religious about my wedding. And no one cared until the issue of same-sex couples marrying was raised.

Religion doesn't get to take over a word that never belonged to it.

Pretty much this. Marriage has been primarily a civil matter, and began as one. And not all religions are against gays getting married. Not to mention, any straight couple of any other religion (or lack thereof) can marry, so stopping gay civil marriage on religious grounds is pure BS.

Don't you just love how some people just don't do equality well. I see no reason to let the homohaters have their way. Anyhow, they lie when the say it's just the word marriage that they object to. They fight civil unions as well.

The main reason the Federal government has to get involved on this issue is because, with a marriage certificate comes a whole array of benefits that Civil Unions do not provide. That's the crux of the Same-Sex Marriage issue.

If with a Civil Union certificate I could get the same Federal and State tax deduction a married couple gets, and the right to add my spouse to my health insurance plan, wonderful! However, it does not work that way.

Civil Unions is just a mock marriage; together in paper, without the most important benefit attached to it...

Ridiculous!

The health insurance plan business is between you and your employer. One of my employers was very progressive and allowed any gay person, upon providing an affidavit regarding their status, and with some evidence (letters addressed to both parties at the same address, bills for joint expenses, etc.) would provide domestic partners with all the health insurance benefits that were provided to married couples. If that were also the case with Medicare and Medicaid, it would be good.

Tax deductions should be the same, but it's a ways yet to those aspects of equality. Interestingly enough, once you explain the benefits angle, most REASONABLE people support marriage equality. The tide is turning. Another 5-10 years, and gay marriage will be legal in the entire US, just as it's been in Holland and, what, Paraguay? for years now.

What I'm talking about is making the word "marriage" meaningless before the law. Civil Unions carry the same protections "marriage" carries now. So if a couple wants a tax break, they get a civil union, gay or straight. Then if they want a ceremony, they can do one, but that would have no legal meaning, the civil union would.

Thank you, Delaware, for promoting equal rights at a time when the news would lead one to believe that there is little hope for political progress in our great country. Me and my fellow progressives are deeply grateful.

Yes, because two people you don't know of the same sex getting the ability to file taxes jointly are taking away your religious freedom. Because though some conservatives don't realize that the sodomy laws were repealed years ago.

Since I am not a religious person, I am not hung up on the word "marriage", while I realize it is a sticking point for many on both sides of the argument. As long as all are offered the same rights I'm ok. The article points out something important that always seems to be overlooked in all of the debate, namely, while civil unions do provide the equal rights that Gays are d@mn sure entitled to, along with it comes a new set of responsibilities. Responsibilities that all legally bound couples have. The amendments to the legislation that were quite rightly defeated were an attempt to diffuse, confuse the issue and make it unpalatable., Equal rights, equal responsibilities. I have been in a civil union with my partner for almost 20 years. Problem is, it is only recognized in his home country, The Netherlands, and certain other European countries.We may in fact like to spend our retirement in Europe, (quite a few years off), but would want to do so by choice, not by necessity.I'm happy that individual states are making progress, but will only be truly satisfied when if becomes Federal law.

Best wishes to you both, and congratulations on your long and happy marriage! Isn't it hilarious that all the str8 folks seem to think our community is promiscuous by definition, yet all the gay people I know are in long-term relationships, I mean seriously long-term. I only know one str8 couple who is still together after 20+ years, but all my gay friends seem to have signed on to go gray together.

There's the problem right there. "Liking" has nothing to do with it. I suspect all these anti-gay types are deeeeeep in the closet and terrified that their secret gayness will SHINE LIKE A THOUSAND SUNS if anybody else in the world is "allowed" to be openly gay.

Yes, awesome news..... that there are some in this country with hearts, compassion, empathy, and a brain, to know that we all should be afforded the same rights and privileges under the law! Way to go, I applaud you!
