Supreme Court Casts Doubt On States' Global Warming Suit

WASHINGTON — The Supreme Court appeared deeply skeptical Tuesday about allowing states to sue electric utilities to force cuts in greenhouse gas emissions from power plants.

Both conservative and liberal justices questioned whether a federal judge could deal with the complex issue of global warming, a topic they suggested is better left to Congress and the Environmental Protection Agency.

The court heard argument over whether to end the lawsuit by six states, New York City and three conservation groups against four private companies and the federal Tennessee Valley Authority, the five largest emitters of carbon dioxide in the United States.

The Obama administration has joined with the companies in asking the high court to throw out the lawsuit. The administration says EPA already is considering setting emission standards that would accomplish what the states are seeking.

Why let the lawsuit go forward, when "the agency is engaged in it right now?" said Justice Ruth Bader Ginsburg.

The lawyer representing the states acknowledged that the case was before the high court at a "peculiar moment," but said the court should block the lawsuit only if the EPA actually issues regulations. In Congress, Republicans are leading an effort to strip EPA of the authority to regulate greenhouse gases, but that was not discussed at the court Tuesday.

No statute or rule "currently regulates the emissions of existing power plants," said Barbara Underwood, the New York solicitor general. Underwood said the plants operated by the companies and the TVA account for 10 percent of all carbon dioxide emitted annually in the U.S.

"This court should not close the courthouse door at the outset," Underwood said.

Lawyers for the companies and the administration focused on the enormity of the climate change issue to argue against the lawsuit.

"You have never heard a case like this before," Neal Katyal, the acting U.S. Solicitor General, said. The term global warming, Katyal said, "tells you all you need to know."

The case is the second climate change dispute at the court in four years. In 2007, the court declared that carbon dioxide and other greenhouse gases are air pollutants under the Clean Air Act. By a 5-4 vote, the justices said the EPA has the authority to regulate those emissions from new cars and trucks under that landmark law. The same reasoning applies to power plants.

Ginsburg was among the justices in the majority in 2007. Two others in that majority, Justices Stephen Breyer and Anthony Kennedy, also expressed doubts about the states' case Tuesday.

Breyer questioned whether a judge even would have the authority to issue the kind of order the states want.

Until now, pollution cases in the federal courts typically have involved a power plant or sewage treatment plant that was causing some identifiable harm to people, and property downwind or downstream of the polluting plant.

Peter Keisler, representing the companies, said global warming suggests a more complex problem in need of a comprehensive solution that includes an evaluation of the "way we use and pay for energy." Courts are ill-equipped to make that determination, Keisler said.

The private defendants in the suit are American Electric Power Co. of Ohio, Cinergy Co., now part of Duke Energy Corp. of North Carolina; Southern Co. Inc. of Georgia, and Xcel Energy Inc. of Minnesota.

Eight states initially banded together to sue. They were California, Connecticut, Iowa, New Jersey, New York, Rhode Island, Vermont and Wisconsin. New Jersey and Wisconsin withdrew this year after Republicans replaced Democrats in their governor's offices.

Justice Sonia Sotomayor, who was on the federal appeals court panel that heard the case, is not taking part in the Supreme Court's consideration of the issue.

A decision is expected by late June.

The case is American Electric Power Co. v. Connecticut, 10-174.

Yes I believe there is global warming. I heard on the news that in the artic the snow is melting and you can see tree that were there millions of years ago question is was that global warming caused by dino farts that that ice melted and trees can grow. We had an ice age in ohio what i have been told is that how the great lakes were formed and the ice sheets were a 1000 feet thick. Now the question is how much is cause by man and how much is the way the earth works. My biggest gripe is that In the USA we have people protesting american factories. they go to the rallies with thier made in china clothes. thier made in china phone and computers. Why are they not protesting them did not you watch the olympic and see the air pollution there

China very recently finally surpassed us in CO2 emissions. But guess what? They have more than 1.3 billion people. On a per capita basis, the United States is STILL the villain.

Furthermore, and this is really interesting, China currently spends more on renewables than any nation on the planet. And within the past couple of weeks one news story was that since the nuclear problems in Japan are making that technology look far less desirable, they are now committing to a green energy production crash course, where they're looking at spending trillions.

Now of course, the not-entirely-amusing irony here is that we will no doubt be buying a lot of the green products we need from them. Unless we choose to buy from frigging Denmark. Even that tiny country is looking better than we are.

You see, the U.S. is the only country who insists that one's view of science is contingent on one's political persuasion. No other nation on Earth thinks there's actually a global warming "debate."

Of couse they spend more on renewables than we do they have taken all are jobs and they are buliding new plants ever day. but the air there still looks worse than L.A. I would be afraid to swim in the rivers and in someplaces I would be afraid to drink the water for all the lead and other waste from thier plants. The point is when all this polution was going on why were were the tree hugger buying made in china goods and not protesting them. So you know I have not problem with china but we need a level playing field so when you protest make sure you do all the places that are dirting up the air and water and land not just the U.S.

There will be 50 million people displaced by 2010.......What, that didn't happen.....I mean 50 million people will be displaced by 2020, and the glaciers in the Himalaya's will be gone by 2035......what, you mean that prediction has no basis in fact? GLOBAL WARMING?
Electric cars, light bulbs and solar panels won't change anything as weather becomes extreme. It will worsen as China and India's 2,500,000,000 people move up the success ladder and demand more energy.
Check all earth sciences and you will discover everything in the process of collapse due to over population of the planet including starvation, which has been going on for years, will pick up momentum.
Dufar in the Sudan looks on the surface to be ethnic cleansing. Next time you look, look not at the starving people but the desert they live in that won't support the winners of this war.
The Sahara is moving south at 20 miles a year. Soon they will all starve while in China, 37% of the ground water is not fit for human consumption and 34% of that is not fit for irrigation.
Because of religions grip on procreation, people continue reproducing at a breakneck pace. They refuse to recognize that this planet can’t sustain 7,000,000,000 devouring everything like a plague of locus in a wheat field.
Extreme weather at this point is beyond human reach to repair it. It’s picking up momentum as anything does when going down hill. We don't have 100's of years left in spite of what many people want to believe.
The planet will continue to heat up for the next several thousand years since it is now running on automatic and regardless of what you hear not much can be done about it.

1,000,000 sq miles of highly reflective mylar (for countering negative albedo) aught to do the trick of prolonging the inevitable, at least until the "big boys" run out of gas. Then we have the ardious task of sequestering a few hundered million years worth of excess CO2, from the air... somehow.

Yep, I agree, not that we shouldn't go all out for massive RE, electric cars and efficiency, but that we really are doomed if we can't figure out how to get rid of all that excess CO2 (and how to maintain a possible million sq mile mylar trash problem, not to mention other GW related problems!).
However, there is still time to enjoy and hope that the resulting "negative" feedback loops (such as glacier melt causing more snow in this stage) will give our kids more time... to figure it out.

And not only that, the EPA is taking its frigging time. This state suit makes eminent sense to me and I agree with their lawyer completely when he states the court should block the lawsuit only if the EPA actually issues regulations.

Well, this is definitely the bottom line: "Until there is regulation imposing controls on emissions, there isn't regulation imposing controls on emissions," says Kimberly Massicotte, assistant attorney general for Connecticut. "Our point is that the law allows us to pursue this case until there is."

And if there is one thing we know about the Obama Administration, it has in common with the Republicans a divinely inspired foot-dragging when it comes to doing absolutely anything whatsoever that might make corporate elites take any responsibility for the damages their activities impose upon the commonwealth.

It is unfortunate to see just how offensive the Obama Administration will make itself in order to protect that corporate status quo, and it make it very difficult to believe there is any reason behind the systematic, expensive, and carefully calculated foot dragging but a concern for maybe grasping a few more dollars to reach the billion mark for Nov. 2012.

Kimberly Massicotte, Connecticut Asst. Attorney General, obviously has more courage and decency than the entire Obama Administration, and the entire ruling elite of the Democratic Party.

If ordinary democrats want to do something for their party, they can scream and yell to the high heavens about all that official indecency while officially changing their party registration to non partisan.

Great post but I don't entirely agree with your conclusion. We need to be a bit more than merely nonpartisan. That plus a dime will only give us Ron Paul. We actually need a candidate.

I would be upset if we were all dead because of the big "threat" of the ozone holes... all those doomsayers were getting alot of press and all that science backed up all their theories... "Golly Sarg what happened to the holes???"

I presume that the same doomsayers are behind the bad science of the fake global warming "science."
