Extended Benefits: Confusion As Federal Jobless Aid Expires In Tennessee [UPDATE]

Stephenie Dodson read in the newspaper earlier this month that some 28,000 Tennesseans will lose their federal unemployment benefits because of the state's improving economy. Notices would start hitting mailboxes within a week, the paper said.

The Nashville resident, who lost her job running an after-school program in July 2009, soon received a letter that gave her the impression that benefits would continue. She had been receiving aid from the federal Extended Benefits (EB) program, which can provide 20 weeks of checks for people who go through up to 53 weeks of federal Emergency Unemployment Compensation and 26 of state benefits. The following week, though, Dodson got a letter saying that, as of April 16, she'd be cut off.

Tennessee is one of three states where where the EB program ended this month. These federal benefits expired less because of job gains than because state lawmakers let them die.

When Dodson received the second letter, she called the Tennessee Department of Labor and Workforce Development to ask what was going on. After sitting on hold for 30 minutes or so, Dodson was connected with an agency employee who tried to set her straight.

"She said, 'I don't understand this completely, but to my knowledge the state has run out of money and there's no money for that,'" Dodson told The Huffington Post. "I said, 'But wait, it's a federal thing.'"

Dodson was right. The EB program is a federal thing.

Its benefits are funded with federal dollars (though states do pick up the cost of EB claims from people laid off by local and tribal governments, typically 2 percent of all claims), and the federal money hasn't run out. Even though the EB program expired in Tennessee, with little to no public debate, it didn't have to. State lawmakers could have passed a law to keep the program.

Yet Tennessee's Republican House Speaker Beth Harwell didn't see things that way. Reached at home on Friday morning, Harwell told HuffPost in a brief conversation that there was no reason for the state legislature to get involved, because it's up to Washington to determine whether the EB program expires.

The U.S. Congress invited states to keep the EB program from expiring prematurely. In December, shortly after Congress passed a law reauthorizing federal unemployment programs for a full year, the U.S. Department of Labor sent a memo to state workforce agencies advising them that they'd lose eligibility for these federal benefits unless local legislatures took action. The memo explained exactly what lawmakers would need to do to take advantage of the new law and even provided draft language for new state legislation.

"For this reason, we know that every state agency was on notice about the need to adopt the new federal option," emailed Attorney Rick McHugh of the National Employment Law Project, a New York-based worker advocacy group.

McHugh suggested a few contributing factors for why some states had allowed the EB program to lapse. "[M]ost state agencies have suffered many retirements of experienced staff and are still working under severe claims load. How information gets transmitted from [workforce] agencies to governors and legislators varies widely by state. And, the fact that most public officials won't listen to you more than 30 seconds, means this is an issue that gets filtered out."

"Finally," McHugh wrote, "some states do not make taking care of jobless workers a big priority."

Rep. Harwell's said the Tennessee governor's office was aware of the EB program's expiration, but a spokesman for GOP Gov. Bill Haslam had no comment. A representative of the Tennessee Department of Labor and Workforce Development speculated that state officials took no action because they didn't want to burden the federal government, according to local TV station WVLT.

And, contrary to the newspaper article Dodson read, the EB program is not expiring in Tennessee because of recent job gains. The state's unemployment rate has held steady at 9.5 percent for the past two months, after rising from 9.4 percent in January.

The EB program is expiring only because the unemployment rate hasn't risen dramatically and -- even if it had not fallen at all -- the benefits could still have expired. A state's eligibility is based partly on whether the current unemployment rate is 10 percent higher than it was in either of the two previous years. Congress said states could remain in the EB program if state lawmakers moved their eligibility baselines back three years instead of just the past two. Compared with three years ago, unemployment rates in hard-hit states are much higher now.

Dodson, for her part, said she's in a tight spot without the $275 per week she received in benefits. "I don't know how I'm going to pay my electric bill," said Dodson, whose checks from the EB program ended this week.

Although Dodson has a temporary gig lined up for the summer, she doubts that she'll be able to find permanent work soon. "It's all about the lack of degree," said Dodson. "I'm 57 years old and I have no college degree. I'm a single mom."

"You know the story," she said, "because it's the American story now."

Correction: An earlier version of this story incorrectly reported that EB is fully funded by the federal government. In fact, states pay the cost of EB claims from people laid off by state, local and tribal governments, which typically amount to 2 percent of all claims, according to the National Employment Law Project.

I do not see a difference in the unemployed collecting a check and the politicans who run the country into the ground getting paid and the banks getting bonuses.
The unemployed use the money to pay bills where as the banks may invest in wall street or devious ways to rip people off.
The whole country is based on welfare whether it goes to politcans, banks, subisidies, dictators or corporations who take years to wage wars.

I have engaged in countless posts about unemployment extensions and have seen the democrats on this board showing care and compassion for the unemployed, and wanting our government to help the unemployed, while the republicans show anger and resort to name-calling to the unemployed. The democrats want to help the unemployed, while the republicans want to block any legislation to help them

The republicans also want to take away medicare and next social security, while the democrats want to save these valuable programs for our elderly.

The republicans want to give this money to the wealthy who don't need this money, while the democrats want to help those who need help, including the poor, unemployed, middle class, and the elderly, just to name a few groups.

This is the difference between the democrats and the republicans.

The democrats will have my vote in 2012 and for life!

I cannot directly reply to Hotness' last excuse for an intellectual reply, but just imagine her sitting on the sidelines of the breadlines in the great depression screaming "Get a Job loser." That about covers who she is a person. Now let's analyze her "logic." First of all UI benefits are a great investment in the economy costing tax payers much less than say tax cuts, or wars etc etc. This in turn stops the economy from continuing to spiral downwards, since we all know less consumption=less revenue. Second payroll taxes have declined which has contributed to the lack of solvency. I agree; I can't understand why she is putting people down (99ers) who at the moment and for quite some time for many; haven't received not one single penny from unemployment nor any other program for some! Doesn't she comprehend that!

I agree 100% with your post. I feel like republicans are somehow jealous of the unemployed, thinking that the unemployed sit around and live a lavish lifestyle, drinking champaign, going on vacation, partying, and living life to its fullest, while the republicans are out working and being the heroes to society. I also feel like republicans just listen to their leaders and go along with whatever the leaders say, and these leaders include Fox News and conservative talk radio.

The complete lack of compassion for their fellow man who is struggling to take care of their families during the worst recession in decades is absolutely heartless. This again is a fine example of Ebeneezer Scrooge in the Christmas Carol, or how Jesus lectured the wealthy to give what they have so that the poor can get help. This was Jesus's answer to how to get into heaven.

Nobody is asking people to give up their entire fortune to help the unemployed, but rather, allow our government to help the unemployed during this massive recession, until they can get back onto their feet again. I paid half the unemployment compensation out of my paycheck every week for over 20 years, the employers paid the other half. So I am just asking that this fund be used to help me until I find a job. Remember there are millions of more people out of work than there are jobs for them to take.

The reasonyou see the UE line is DUE TO THE FACT that the DOL-WFD office has not answered their telephone since October 2008. They laid off so many workers, the phone lines are always busy, they are DISALLOWED to write responses to UI recipients via email, and the elected officials KNOW NOTHING about how the UI system works or rather, DOES NOT WORK in Tennessee.


Those people in line likely voted for Teabaggers - thinking - or not thinking - they would do "something" to help. Teabaggers and the Rethuggery Obstructionist Party of Teabagging Fewls LIED they way through the 2010 election from the statehouse to the USHouse and USSenate.

The republicans are going to pay such a high price in 2012. Just look at what is happening with their support for the Ryan plan. Seniors and town halls are beginning to reflect the distaste the public has for cutting off their lifelines like this.

THANK YOU! I read your blog one time and enjoyed it and now will go back and become a regular reader. As I recall, you are in Clarksville - which to those who do not know: Clarksville, Tennessee is the SAME TOWN as Fort Campbell, Kentucky (101st Air Assault, USArmy - Screaming Eagles). I live in Cheatham County, so I am STUCK with Marsha as well. People do not realize that she is a complete traitor to Tennesseans. Her district is gerrymandered from the south in Williamson County (the wealthiest county in TN), goes northward and curves AROUND Nashville - which is BLUE (Jim Cooper is Blue Dog) and straight up to Ft. Campbell. It triangulates west to Memphis - Blue again - in other words - Marsha's district is MOSTLY RURAL, unemployed, uninsured, drug addled, high teen pregnancy and drop-out rate, domestic violence, et al.

Marsha has YET to come around to Ashland City - which was DEVESTATED by the Great Flood last year and thousands lost their jobs permanently. She stays in Williamson or comes to the Pegram-Kingston Springs area - never comes to the PEOPLE who need help in her district.

It's really stupid of them though, because the UI benefits boost the economy all-around, which helps the wealthy even more. 28,000 people is over $7 mil. a week that the unemployed in TN won't have to spend. That's going to hurt really, really bad. Not just mom-and-pop businesses, but places where the wealthy have their money invested, too.

This is just pure stupidity.

This is what is so hypocritical about the republican party. They don't enact the legislation that will help our economy go in the right direction, including deficit reduction, reducing unemployment, etc. The republican party has no problem giving billions and now a trillion dollar plan to help the rich, but blocking legislation to help the unemployed with unemployment extensions.

This is not only cruel for a human being to treat their fellow human beings in need this way, it is also fiscally bad economics.

The democrats will kick butt in 2012!

There's an annual model airplane event in Johnson City, Tennessee. It's not fair, but when my husband and I were reviewing all of the pro's and con's of making this long trip again, he asked why he would want to support the right wing ugliness that has become Tennessee. I'll tell you what got him thinking like that -- we went to the Toledo, Ohio, area and stayed at La Quinta. The cable selections were sports, sports, sports, Fox, sports, and not much else. If the idea was to offend people who aren't defined by those things, it worked. We agreed that if we go back, we're not staying there any more.

Agreed. We are starting to witness the same thing in Nevada. The state, little inclined to address operational proficiency, has experienced a rapid rise in population and then the real estate black swan. Vital personnel are being cut. Example: The state requires all business entities (corps, partnerships, LLCs, LLPs, etc.) to file an annual list of officers/members. In the past the Sec't of State's office has sent out annual notices to renew. I know of five business that have not rec'd their notices and were dinged with fines equivalent to 3 times the original annual fee. Most small businesses, around here, rely on the state notices to remind them it's time to renew. The state says they're still sending the notices. Local experience says otherwise - and of course - the state has discovered how to acquire additional revenues from the process.

Actually, like so many states, the maroons in TN voted TEABAGGERS into the statehouse for the first time in TN history. It is WORSE than you can imagine - and it LACK of trained state workers and the FACT there were thousands in the UE office laid off. It has been this way since September 2008 and not getting better.

AquarianinExile, imagine the anger and feelings of helplessness the democratic voters of TN feel right now. They voted democrat, those who voted for the teabaggers outnumbered them. So many did make a mistake in voting for the republicans and tea baggers, but there are many who are victims of this bad judgment as well. My heart goes out to them.

Now they'll be forced to go out and get a six to seven dollar and hour job just to make ends meet, which they can't on those wages. This is the goal, of the wealth controlled government, in this country. Put us all back in a feudal system where we are at the whims of our lords. You should've voted for anyone except the Democrat or Republican. You had a choice and you keep making the same insane mistake over and over. The Dems and Repubs are the same; only care about getting re-elected and making the contributors happy. Wake up, America. Vote Green, Independent, or anyone with a lick of common sense.

Much worse than that - I was laid off the first time in October 2008 - and received 13 weeks of UI and got the extensions by half due to the way they figure UI in this state.


I am now working in a professional job (35 yrs exp and degree) for EXACTLY ONE-HALF of the salary I was being paid in 2008. Most jobs for professionals in TN are now going for $10.00 an hour, no benefits, and Form 1099s which means you are not being counted at all in the workforce or the unemployed.


These Right-To-Work states actually mean, Right-to-be-Fired-for-No-Reason and "we don't have to pay you because we can get away with it".

I too lost my job, but it was in December 08. I had noticed our customers were losing their customers and so it happened, the money dried up.

I went back to school and earned my degree. I still can't find the job with the degree and find myself applying for jobs that are paying less than I was making, even less than what I was making 10 years ago and that is before I ever had a degree.

So the republicans say, go work at mcdonalds, and build yourself back up. Basically work for less money than you can survive on and take the next 10 years working for less than what you normally make. Remember, each employer will pay you nearly identical what your previous employer paid you (unless you are lucky to find that job similar to what you did before and might be able to convince that employer to pay that salary).

If they can find a minimum wage job. Many people assume that "overqualified" laid off workers can just waltz into a retail store or fast food place and be put to work. It usually doesn't work that way. Just look at your local fast food place or national chain retailer. It is doubtful that the place has been overrun with displaced older professional workers.

Minimum and low wage jobs will not hire professionals who make a lot more money, why, because they know the professionals will take the higher paying job the second it arrives, and why shouldn't the professionals take these jobs?

And the republicans often think all you have to do is walk into a job and apply or use that clever republican talk to convince them to hire you and you will be immediately hired. I want to see republicans lose their jobs so they can experience what it's like to deal with overloaded human resource departments who look at hundreds of resumes for each job and never give many of us a chance to even present ourselves.

And these same Red Staters tend to complain the most about the nearly non-existent taxes that they pay. Face it, if many Red States didn't have Blue States to prop them up, their economies, education, and health care systems would be even worse than the near third world levels they currently dwell on. And if those funds evaporated and they had to actually start pulling their own weight, then maybe those states would see the light and stop voting for a GOP that doesn't care about their needs.

Now everyone is going to see what Obama's stimulius prevented from happening much sooner. The bible belt is determined to cut off their nose to spite their faces, trying to prove that they don't need the federal goverment.
