LGBT Adoption Bill Introduced In The House

WASHINGTON -- As several states have moved to make it harder for same-sex families to adopt children or become foster parents, Rep. Pete Stark (D-Calif.) introduced legislation on Tuesday that would make such discrimination illegal across the country.

The Every Child Deserves a Family Act would "ban discrimination in adoption or foster care placement based on the sexual orientation, marital status or gender identity of the potential parent, or the sexual orientation or gender identity of the child," according to a statement from Stark's office. It has 33 Democratic co-sponsors in the House, and Sen. Kirsten Gillibrand (D-N.Y.) will introduce a companion bill in the Senate in the coming weeks.

When asked why he decided to introduce the measure, Stark cited the "homophobic opposition that has tried to decide that gay people aren't suitable adoptive parents."

"I take exception to that," Stark told The Huffington Post. "We have a tremendous need for adoptive parents in this country. We've got thousands of kids who would otherwise be stuck in foster care, which isn't a very good place for them to end up. This is a human rights issue."

The legislation comes as Virginia's State Board of Social Services rejected adding protections against discrimination in adoption proceedings on the basis of sexual orientation, gender, age, religion, political beliefs, disability and family status. Currently, the state prohibits discrimination on national origin, race and color.

Last month, Arkansas' high court struck down the state's law barring same-sex couples from adopting. In an opinion published without dissent, the court argued that the law violated individuals' right to privacy.

Addressing conservative Iowa group the FAMiLY Leader in a speech Tuesday, possible GOP presidential candidate Rick Santorum spoke out against single people and gays as parents. According to video shot by Igor Volsky at ThinkProgress, Santorum told a story about how he recently told a lesbian woman that it was a "privilege," not a "right," to be a parent.

"I think he's crazy," Stark said. "I don't know where he comes up with those ideas."

Jennifer Chrisler, the executive director of the Family Equality Council, which advocates for LGBT families, also took issue with Santorum's comments.

"What planet does he live on?" asked Chrisler in a statement. "The simple truth is that today's modern American family is made up of all types of configurations. One in four children in this country is currently being raised by a single parent. Two and a half million families are headed by single dads and one a half million kids are being raised by grandparents. The only traditional family unit that exists is in the 1950s show 'Ozzie and Harriet' and in Rick Santorum's head. How dare he question the ability of single parents to provide loving stable homes to their children? How dare he!"

The prospects for Stark's bill seem slim. Currently, there are no GOP co-sponsors, although Stark said he has heard from a few Republicans who may support it.

According to the Family Equality Council, one million LGBT parents in the United States raise two million children.

Science shows that children raised by same-sex couples do as well on average as children raised by two parents of different genders. A study in the Journal of Marriage and Family last year challenged the notion that children with same-sex parents are at a disadvantage compared with children who live with a mother and a father.

Thank you. Fanned and faved. GLBT people have families as well, families that are not respected or adequately protected under US law. The first cannot be mandated, but the second most certainly can. There is no reason for our families to be under the same protections that govern straight families. PROTECTION FOR ALL US FAMILIES. NOTHING LESS.

One correction. Ozzie and Harriet actually were "not" the classic American family as envisioned by the trailor park party. Ozzie & Harriet sent their children to school.

Using the concept of a slippery slope...Santorum's argument that the 'right' to parenthood (and as follows..the right to reproduction) is a privilege and not a right is akin to certain European philosophies that were in place in the 1930's and 40's. Is there a litmus test that is being designed by the far right to determine the composition of the electorate in the future....inquiring minds want to know. Thanks to the other posters who opened up the idea.

Rick Santorum is an absolute nut. It's easy to see why Pennsylvania did not re-elect him. Children need parents who will love and protect them. This doesn't have a thing to do with sexual orientation. His type of conservatism scares me to death!

Fanned and faved. When I read last week in these comments that when one of their newborn infants died, they took the corpse home to "introduce" it to their living children, I knew that at least one of these people who have or have had legislative power are insane. It is very frightening to think how many people think like these sick individuals.

As long as the adoptive parents are loving and provide any adoptees with a loving, protective home atmosphere, I don't see a problem. Many of these children have congenital or inherited health/development issues or have been abused--if a same-sex couple can provide the loving home they so badly need, why not?

They only want government "off our backs" if "our" consists of white, heterosexual, married Christians. Anybody outside of that circle is cast is THE OTHER and must either be controlled or destroyed; if THE OTHER cannot be destroyed, then they must be stripped of their rights. Research outcomes do not matter. Reality does not matter. Human rights do not matter. Civil rights do not matter. All that matters is protecting a fantasy that "we" (white, heterosexual, married Christians) are superior and THE OTHER is an abomination that must be controlled, destroyed or both.

So becoming a parent is a privilege? Who, exactly, in a Santorum run government will be responsible for deciding who is rich enough, white enough, Christian enough, and straight enough to be parents? This has got to be one of the most anti human rights statements he's ever made.
As a parent, I consider it a great privilege, unfortunately in the context he was speaking he obviously thinks of privilege as something for which one must qualify, most likely under his warped rules.

The right to marry and the right to have a family have both been defined by the Supreme Court as "fundamental rights."

By The Frothy Mix's "logic," possession of fundamental rights is the unique privilege of heterosexuals. Why heterosexuals? Because America no longer allows folks like Rick to grant themselves special legal rights for being white and male.

Is the conversation back to here? Last night someone questioned whether my bi status was a result of my pain and some weird way of coping with the fear of another pain like that. I need to assure them, and the rest of the crowd, that is certainly not the case. My ex-wife and I were both openly bi (maybe not the best arrangement for a marriage) before we ever got hitched.

I've just gotten pickier about what I want in a man v what I want in a woman and I might have met my adonis at the Milwaukee BHD today. *flutter* The man looks like a young James Dean crossed with James Franko with an earring and one of those silly tribal tattoos and a softtail switchback (he let me ride :D:D) 6 pack abs and he smells like happiness.

The GOPers better not shut down my big gov't medicine, I need to see Paul more, and more often.

Really, so all those hetro couples having children it isn't their right to do so? So since it's a privileged the state can just come in and remove children for any reason, since it's not a right.
