Brazil Approves Same-Sex Civil Unions Despite Catholic Protests

SAO PAULO -- Brazil's high court ruled that same-sex civil unions must be recognized, a decision welcomed as a watershed by gay activists who also hope it will cool rising violence against homosexuals in Latin America's most populous nation.

The ruling, however, stopped short of legalizing gay marriage in Brazil, which has more Roman Catholics than any other country. The Catholic Church fought the measure.

In a vote late Thursday, all but one of the 11 Supreme Court justices backed civil union rights for same-sex couple. One justice abstained.

The court ruled that gay couples deserve the same legal rights as heterosexual pairs when it comes to alimony, retirement benefits of a partner who dies and inheritances, among other issues.

In Latin America, gay marriage is legal only in Argentina and Mexico City.

Same-sex civil unions granting some rights to homosexual couples are legal in Uruguay and in some states of Mexico outside the capital. Colombia's Constitutional Court has granted same-sex couples inheritance rights and allowed them to add their partners to health insurance plans.

Brazil's ruling sets a judicial precedent that must be honored by all public institutions, including notary publics where civil unions must be registered.

"This is a historic moment for all Brazilians, not just homosexuals. This judgment will change everything for us in society – and for the better," said Marcelo Cerqueira with the gay rights group Grupo Gay da Bahia. "Gays, lesbians and transsexuals will be recognized as being more human. We'll be more accepted by having our rights honored."

Grupo Gay da Bahia said in a recent report that 260 gays were murdered in 2010 in Brazil, up 113 percent from five years ago, including recent high-profile cases that made headlines.

On April 5, the body of 16-year-old girl was found in a remote area of Brazil's Goias state. The father and brother of her teenage girlfriend were arrested. Less than two weeks later, security cameras captured the beating death of a 24-year-old transvestite in northeastern Paraiba state.

Gay activist Cerqueira said he hoped the ruling would be the start of an end to such violence.

"This ruling will help. The violence comes about because of impunity for those who commit it," Cerqueira said. "When a country judges a case like this in favor of us, it will have an impact across the judicial and law enforcement sectors."

The request for the Supreme Court to recognize civil unions came two years ago from the Brazilian attorney general's office, largely because legislation that would give same-sex couples the rights enjoyed by married heterosexual couples has been stalled in Congress for more than a decade.

Brazil's constitution defines a "family entity" as "a stable union between a man and a woman." But the attorney general's office argued the clause is only a definition and not a limitation, and thus the charter does not say a stable union can "only" be between a man and a woman.

The attorney general also argued that the constitution does not specifically forbid a civil union between people of the same sex – and that failing to recognize same-sex unions violates the charter's defenses of human dignity and equality.

A lawyer representing Brazil's National Conference of Brazilian Bishops, Jose Sarubbi de Oliveira, argued to the court that the constitution recognizes only a legal partnership between a man and a woman and that the justices would be wrongly interpreting the document to rule otherwise.

Oliveira said the document's lack of an explicit statement that a family partnership is limited to those between a man and a woman did not mean that "every type of union has to be considered."

Ralph Lichota, a lawyer representing religious groups, told the court the legal recognition of same-sex couples should be left in the hands citizens.

"Power emanates from the people, and the Brazilian people are Christian," he said. "God created marriage when he created Adam and Eve. Just like the Brazilian people aren't ready to legalize marijuana, like they're aren't prepared to have abortion, we're not ready for homosexual marriage."

Luis Roberto Barroso, a law professor at Rio de Janeiro State University, argued in a friend-of-the-court appearance before the justices that allowing same-sex civil unions would mean "overcoming historical discrimination."

"The implications of a homosexual relationship are the same as those of a heterosexual one. To not recognize that is to say that the affection they (gays) have has less value and can be disrespected," said Barroso.

Yet another nail driven into the papal church's coffin. Note how rapidly THE most Catholic country next to Ireland has come into the 21st century. As Benedict and his Hierarchy of Reprobates and Clowns languish in the 16th century and earlier.

And this is the old man who is going to lead the charge with Muslims, Orthodox, Jews, and other religious groups to turn Europe and the West away from barbarism, a world of decadent, sensate self-centeredness? Don't bet the family jewels on it.

I am a cultural Catholic. You know? And I remember in 1978 cheering when JP2 became Pope (I am Polish, as well). But as things went on, he got more and more confusing, mystical and downright reactionary. I think this was because of advisors as well as his conservative Polish Catholic background, effective as it was against the Nazis, but none the less not as progressive as Leo XIII, John, XXIII, Paul VI and JP-one. When I was sitting at the kitchen table, I remember the voice saying "Habemus papam... Josefum... Cardinale Ratzinger" I hit the table and swore, because I knew he was the head of the "Congregation for the Doctrine of the Faith" AKA Holy Inquisition. At that point, while I had toyed with the idea of coming closer to the community of the Church, I just threw up (not literally) my hands and gave up on ever feeling part of that mess again. From Constantine to Theodosius (murderer of Arians), to Innocent III (murderer of Cathars), to the Roman Inquisition to the Church of the 20th Century and now this, the RCC never changes and it will never be for the People as Jesus had thought, as St. Francis had prayed and as Bishop Tutu had hoped. Meh. To heck with the Brazilian Catholic Church, just as to heck with the US Catholic Church. We will make our own. ;0) BZ.

The Catholic Church's only future is for the ordinary people in the pews to throw off the Roman yoke, establish their own communion built upon the scriptures and the early Church fathers. There are plenty of clergy and bishops ready to be part of that move.
Waiting for Rome to change is like waiting for Gadot. It will never come about while the laity languish and allow "Father to do it". Too many Catholics are total
philistines and lazy as hell. They get the Church they deserve.

Brazil still falls short on legalizing gay marriage...because of the influence of of the RCC. Eventually people must realize that superstition and the supernatural are no way to guide the lives of 21st century people. There's no rational, legitimate reason to deny gay people the right to join their lives together...if that's what they desire to do. All opposition is emotional...and poorly serves the people. Millions of people will benefit from gay marriage...not one will be harmed. The US should view the subject with reason...not emotion...(sigh)

Agreed. But you know and I know that USers don't ever view things with reason. We are as a culture on the whole NOT reasonable, and at our worst, we have done terrible things based on the emotional hatred of others (I mean, the CSA). But as more and more women get educated, and as more and more boys get raised by these educated women, we will finally have real men (the Yiddish word for that is "Menschen") leading the Nation, not petty spoiled bullies. BZ.

Well, how else? If we don't vote to extend the civil rights to ourselves (the People), then others are going to TAKE our rights. Now, I get that you are saying that the vote could go the wrong way. But we have to look at it from the point of view that we don't have a king or a leader. We (the People) are the only leaders here. And the only thing that can make us great is good education. John Dewey has it right that an educated public is the only way to have good citizens. See Dewey's "Democracy and Education". There. BZ.

When I was growing up I often visted my grandmother in New York. She was a practicing Catholic all of her life, and even never ate meat on Fridays long after that rule was changed. She always had a a copy of "The Long Island Catholic" newspaper in the house. If we wanted to go to a movie, the first thing we did was check the reviews in the LIC. Any movie they had rated as "Condemned" was on the top of our list. We never told her which movie we went to.

we should for legal purposes call ALL unions civil unions, then let the couple go to their minister to get a certificate of marriage. Then only the term civil union would hold any meaning in court.

To rename all matrimonial unions as "civil unions" is to give credence to the religious dingbats' assertion that you're trying to "redefine" marriage. Because you would be literally redefining "marriage" by playing around with the word used to describe it.

I shudder at the thought of churches being responsible for issuing marriage certificates. Marriage certificates have always been issued by the State in the United States, even before it was an English colony. This makes the most sense in terms of record keeping for numerous purposes of the state regarding property rights, duties and obligations of the married, and for the legal proceedings surrounding divorce, among others. Despite that churches may consider marriage as a sacrament (the Catholic Church didn't up until the 16th century), and whatever wedding ceremonies they may hold, the church does not own marriage, nor own the right to say who can and who cannot get married. That has always been a state function, where it should remain. And I promise you, it will.

What the supporters of same-sex marriage are asking for is inclusion into the rights and protections of marriage, not a redefinition of it. Marriage will remain the same as it has been for hundreds of years now.

Agree with nearly everything you're saying, except you left out one important fact: marriage has never included same sex unions in this country. If it did, then this debate would not be going on.

By the states and feds using a legal term, civil union, then we'd have true separation of church and state on this matter anyway.

My suggestion was not that marriage be the legal responsibility of the church, but that the term marriage no longer be the legal term in the courts. Only civil unions would be recognized and the legal norm, with marriage relegated to the level of a baptismal record. Then a marriage record would have no more weight in court or society then a baptismal record. There are churches that will marry same sex couples. Wouldn't even be necessary unless they were religulous. Don't think atheist would care one way or the other.

You do know that a couple can get a divorce in court and still be forever more married in the eyes of the Catholic Church, unless the Church grants an annulment. But that “marriage” means nothing in court.

Actually using this religious term is unconstitutional and violates the principle of separation of church and state. Yes I know atheist get “married”, they just haven't considered the religious ramification yet else they would have taken it to court themselves and forced the government to stop using this religous term.

EXACTLY. Civil rights should NEVER be voted on via the "will of the people." Civil Rights should be observed for everyone and protected against the tyranny of the majority. If we listened to religious bigots we'd still be burning witches and punishing left handed people because they didn't choose to be right handed. I'm glad Brazil knows how to distinguish between the church and state and keeps a wall between the two. It's amazing how much deference the U.S. gives to churches when they are consistently wrong and hypocritical on so many issues.

The "will of the people" didn't want interracial marriage to be legal 60 years ago. The Supreme Court came to the conclusion that bigotry is not a rational basis to discriminate against people.

By the way, how EXACTLY has same-sex marriage negatively impacted on your life? Did your marriage fall apart? Have divorces skyrocketed? Have straight people suddenly turned gay? What is your "rational basis" for condemning gay people to second-class citizenship?

You cannot change the sexuality of people. It is what it is. A person is born homosexual or heterosexual or bisexual. The stimulus helped save millions of jobs, fact! Talk to any economist sweetheart and you'll see that the recession BUSH got us into would have been much worse without this money. Hats off to the Democrats and the President on doing the right thing and saving American jobs instead of sending them overseas. I say kudos to the people of Brazil for realizing that everyone is entitle to certain rights and that those rights should not depend on your sexual orientation or sexual preferences. It is nice to see there is a country with more balls than the United States when it comes to recognizing the rights of the GLBT population.

Just because a union is same-sex, does not necessarily mean the couple is gay or lesbian, the couple could be bisexual instead.

Again, congratulations Brazil! My hope, this will make a massive impact on Civil Union & Civil Rights issues in the US.
